SUBJECT: Consider 2009 Regional Solicitation of Federal Transportation
Projects for the City of Shakopee

INTRODUCTION:
The City Council is being requested to consider projects that could qualify for the 2009
Solicitation of Federal Transportation Projects for the City of Shakopee.
BACKGROUND:
Every two years, the Metropolitan Council requests applications for a Regional Solicitation of
Federal Transportation Projects. For 2009, the Metropolitan Council has sent out solicitation
requests for Federal Transportation Projects that would be constructed in 2013-2014. The
regional solicitation process selects projects or programs to be funded by the Surface
Transportation Program (STP), the Congestion Mitigation! Air Quality Improvement Program
(CMAQ), the Transportation Enhancement Program (TEP), as well as the Bridge Improvement
or Replacement Program (BIR). The Transportation Advisory Board and Metropolitan Council
may award approximately $93 million from the STP, $55 million from the CMAQ and $17
million from the TEP to projects and programs in the seven County metropolitan area.
Applications are due on Monday, June 15,2009 at 5:00 P.M. for these programs.
Another program from the Minnesota Department of Transportation is the Highway Safety
Improvement Program (HSIP) and these applications are due July 2,2009.
Staff has reviewed the potential list of projects for these programs and has identified the
following potential projects:
. Quarry Lake Pedestrian Bridge and Trail over T.H. 169
. 12th Avenue Trail and Pedestrian Bridge over the Prior Lake Outlet Channel to Quarry
Lake Park
. Memorial Park Pedestrian Bridge Replacement
. CSAH 17 and Vierling Drive Intersection Improvements
. C.R. 15 Pedestrian Bridge and Trail Improvements
Ouarrv Lake Pedestrian Bride:e and Trail Proiect
Staff has submitted applications previously to the Metropolitan Council in 2005 and 2007 and
believes this would be a high priority project to submit again. Scott County will be including
this trail connection on its regional trail map that will be forwarded to the Metropolitan Council,
thus this trail would have a high ranking due to its regional significance. Staff is proposing that
this project application would be under the STP, which allows for a higher dollar amount to be
granted to a project of this type. The cap for a STP project of this type would be $5.5 million
and the Federal funds shall not exceed 80% of the project costs. The City would have to have
local matching funds, if successful in receiving this grant.
12th Avenue Trail and Pedestrian Bride:e over the Prior Lake Outlet Channel
stafr has identified this as a trail connection to connect C.R. 83 with the trail that would
ultimately connect to the Quarry Lake Pedestrian Bridge and Trail and could serve the Quarry
Lake Park. This project would be applied for under the TEP funding application which has a
maximum Federal participation of$l.O million.
Memorial Park Pedestrian Bride:e Reolacement
Staff has met with Scott County and Department of Natural Resources (DNR) staffto review the
potential DNR trail connection along C.R. 101 through Memorial Park and connecting to the
current DNR trail. The current pedestrian bridge is only five feet wide and does not meet ADA
slope on the south approach and the loading capacity is not known. Staff is working with the
DNR for the DNR to consider submitting for this project, as it will ultimately be a DNR regional
trail.
CSAH 17 and Vierline: Drive Intersection Imorovements
County staff is working with City staff to prepare an application that would be for the HSIP
application. Projects that can be funded under this program would have a maximum $1.8 million
dollars of Federal funds and the remaining would be local matching funds. At this time Scott
County is preparing the intersection improvements and the application in which the City could
apply for funding, since Scott County is also applying for Federal funds on the C.R. 17 project,
from St. Francis A venue to C.R. 42. The County cannot apply for two projects on the same
arterial, thus the City would be applying for this RSIP.
C.R. 15 Pedestrian Bride:e
This bridge improvement is to serve future growth in this area, in particular with the new
elementary school being proposed for 2011. At this time staff believes an application for this
project is premature and will be working with Scott County staff to look at other alternatives to
utilize the existing bridge width in order to move pedestrians and bicyclists along C.R. 15 over
T.R. 169 without a separate bridge.
In summary, staff would recommend that the City apply for the Quarry Lake Park
PedestrianfBicycle Bridge and Trail Project under the Federal STP funding application and to
apply for the CSAH17 and Vierling Drive Intersection Improvements under the HSIP funding,
with Scott County performing much of the preliminary work. With the Memorial Park
Pedestrian Bridge, staff would recommend working with the DNR or Scott County to prepare for
an application grant, as this will ultimately be a DNR regional trail. In staff s opinion, the other
two projects being the 12th Avenue Trail and Pedestrian Bridge and the C.R. 15 Bridge seem to
be premature to prepare an application and would recommend not to proceed with applications
for these two projects at this time.
AL TERNA TIVES:
1. Adopt a motion authorizing staff to prepare grant applications for the Quarry Lake
Park/T.R. 169 Pedestrian/Bicycle Bridge and Trail Project and for the CSAH 17 and
Vierling Drive Intersection Improvements.
2. Approve projects, as modified by the City Council, for Federal Transportation Project
Solicitation Funds.
3. Authorize the appropriate City officials to execute an extension agreement with WSB &
Associates, Inc. to prepare the Federal Transportation Fund Application for the Quarry
Lake Pedestrian Bridge and Trail.
4. Do not authorize an extension agreement with WSB & Associates, Inc.
5. Table for additional information.
RECOMMENDATION:
Staff would recommend Alternative No.1, to apply for the Quarry Lake Park Pedestrian Bridge
Project, which would need consultant staff to prepare the grant application which is estimated
not-to-exceed $2,000.00, and to submit for the grant application for the CSAH 17 and Vierling
Drive Intersection Improvements, in which much of the application work would be done by Scott
County.
ACTION REQUESTED:
1. Adopt a motion authorizing staff to prepare grant applications for the Quarry Lake
Park/T.H. 169 PedestrianfBicycle Bridge and Trail Project and for the CSAH 17 and
Vierling Drive Intersection Improvements.
2. Authorize the appropriate City officials to execute an extension agreement with WSB &
Associates, Inc. to prepare the Federal Transportation Fund Application for the Quarry
Lake Pedestrian Bridge and Trail.

Re: Estimate of Cost to Provide Engineering Services
Federal Transportation Funding Application
Dear Mr. Loney:
According to our Agreement for Professional Services within the City of Shakopee and Section
I-C-2 (Major Projects), this extension agreement is written to provide you with an estimate of
cost for engineering services for the above-referenced project.
The proposed project includes the preparation of a Federal Transportation Funds Application for
the Quarry Lake Park Bridge over TH 169. The funding sources will be applied for under the
Surface Transportation Program (STP).
We propose to conduct the work on an hourly basis with an estimated fee of $2,000. We will not
exceed this amount without your prior approval.
It is proposed that all work under the contract would be considered complete after the application
has been submitted to Met Council. The design and construction phase would be initiated if
funding is approved.
The City of Shakopee agrees to reimburse WSB & Associates for these services in accordance
with Section IV of the Agreement for Professional Services. If this agreement meets with your
approval, please sign below and return .one copy to our office.

The Metropolitan Council and the Transportation Advisory Board has released the 2009 Solicitation Package for
federal funds. The regional solicitation process selects projects or programs to be funded by the Surface
Transportation Program (STP), the Congestion Mitigation/Air Quality Improvement Program (CMAQ), the
Transportation Enhancements program (TE) as well as the Bridge Improvement or Replacement Program (BIR).
The Transportation Advisory Board and Metropolitan Council may award approximately $93 million from the STP-
Urban Guarantee program, $55 million from the CMAQ program and $17 million from the TEP to projects and
programs in the seven-county metropolitan area. The local Bridge Improvement or Replacement program may
award approximately $9 million. These amounts are estimates and are subject to change based on a number of
factors. These funds will be allocated in 2013 and 2014. The amount of funds available in these programs will be
based on the funding levels established by the reauthorization of the federal transportation act. Prior to selecting
projects, the funding level will be reviewed to ensure fiscal balance of the Transportation Improvement Program.
The selected projects and programs will be programmed for construction or implementation in 2013 and 2014 as
part of the region's Transportation Improvement Program (TIP) for 2011-2014. The 2011-2014 TIP will be
drafted in March 2010 and adopted in September 2010. Notification of applicants "to proceed" by MnDOT State
Aid is anticipated to occur in November or December of 2010. However, applicants are encouraged to contact
State Aid to begin project development as soon as they are ready to do so.
Potential applicants should carefully review the applications and all policies and qualifying criteria before
proceeding with an application. Metropolitan Council staff will also hold an information forum on the solicitation at
9:00AM on Friday, May 1 in the Metropolitan Council Chambers.
Highway Safety Improvement Program. (HSIP) Solicitation Has Been Released - Applications Due
July 2, 2009
The Metropolitan District of the Minnesota Department of Transportation has released the HSIP solicitation. The
announcement with directions to applicants and the application can be accessed below:

The Metropolitan Council is on schedule to approve the 2009 Regional Solicitation for Federal Transportation
Projects [Surface Transportation Program (STP), Congestion Mitigation Air Quality (CMAQ), Transportation
Enhancements (TE), Bridge Improvement and Replacement (BIR)] on April 8, 2010. A notice will be released on
April 10. Applications will be due on June 15, 2009.
