Cox, City Clerkl SUBJECT: Temporary 3.2 Percent Malt Liquor Licenses - Shakopee Lions Club DATE: May 14, 2009 INTRODUCTION AND BACKGROUND: The Shakopee Lions Club has made application for temporary on-sale 3.2 percent malt liquor licenses for a softball tournament at Tahpah Park on May 29-31,2009. The application is in order and the certificate of insurance is on order. The Lions Club has requested that they be allowed to serve beer until 11 :00 p.m. on Friday and Saturday night and until. 8:00 p.m. on Sunday night. The Police Department recommends the sale of beer cease at 10:00 p.m. on Friday and Saturday night. The 10:00 p.m. hour is consistent with previous licenses issued to the Lions Club at Tahpah Park. See memo from Captain Robson, attached. The Lions Club would like to sell beer from two sites, one fenced in beer garden area adjacent to the concession stand and a new, second fenced in beer garden area between ball fields 6 and 7. Sales at the second site would be on Saturday only. Captain Robson recommends that the Lions Club staff two police officers on Saturday, May 30th from noon until 6:00 p.m. RELATIONSHIP TO VISIONING: Goal F: Housekeeping RECOMMENDED ACTION: Move to approve the application and grant a temporary on-sale 3.2 percent malt liquor license to the Shakopee Lions Club, for the designated, fenced beer garden adjacent to the concession stand at Tahpah Park, on May 29 from 5:00 to 10:00 p.m., on May 30 from 8:00 a.m. to 10:00 p.m. and on May 31 from 10:00 a.m. to 8:00 p.m., and also grant a license for the designated, fenced beer garden between field No.6 and 7 on May 30 from 11 :00 a.m. to 7:00 p.m., conditioned upon the Lions Club staffing two police officers on May 30 from noon until 6:00 p.m. and upon receipt of evidence ofthe required insurance. CITY OF SHAKOPEE MEMO POLICE DEPARTMENT DATE: May 14, 2009 TO: Judy Cox FROM: Craig Robson SUBJECT: Shakopee Lions Club -Temporary 3.2 percent malt liquor license The Shakopee Lions have applied for a temporary 3.2 percent malt liquor license for a softball tournament at Tahpah Park on May 29, May 30 and May 31. They are requesting hours of sales to be: Friday 4:00 pm to 11 :00 pm, Saturday 9:00 am to 11 :00 pm and Sunday 10:00 am to 8:00 pm. The Shakopee Lions wish to have the option to run two separate areas to sell beer from. The police department recommendation regarding this temporary liquor license is to allow alcohol sales consistent with state law, city ordinance and past license requirements. The police department recommends that: 1. Sales and consumption of alcohol should be confined to a fenced "beer garden" area within the park. The police department is not opposed to the Shakopee Lions Club having the option of operating two "beer gardens" within the park. 2. Sales of alcohol should be limited to park hours and Friday and Saturday alcohol sales should conclude by 10:09 pm. 3. The Shakopee Lions Club should staff two police officers on Saturday May 30 from noon until 6:00 pm.
