Michael Leek, Community Development Director SUBJECT: Set Additional Public Hearing for Vacation of Easement north ofCR 42 and east and west of CSAH 17 MEETING DATE: January 7, 2003 INTRODUCTION: On July 2, 2002 the City Council opened a public hearing on the application of Julie and Brian Welch for vacation of a blanket drainage easement within property they own along County Road 17, north of County Road 42 (see Exhibit A). The public hearing was subsequently closed, and action taken on the request on October 1, 2002. However, Council directed that another public hearing be set, and residents of the Weinandt acres plat receive individual notice. The attached resolution sets a public hearing for February 4,2003. ACTION REQUESTED: Offer Resolution No. 5839, A Resolution Setting the Public Hearing Date to Consider the Vacation of Easement north of CR 42 and east and west of CSAH 17, and move its adoption. #~- ~ -/) ~~. ~ R. Michael Leek Community Development Director G:\CC\2003\0 1-07\vacsetph Welch. doc RESOLUTION NO. 5839 A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE VACATION OF EASEMENT NORTH OF COUNTY ROAD 42 AND EAST AND WEST OF CSAH 17 WHEREAS, it has been made to appear to the Shakopee City Council that easement north of County Road 42 and east and west of CSAH 17, City of Shakopee, County of Scott, State of Minnesota, serves no public use or interest; and WHEREAS, a public hearing must be held before an action to vacate can be taken and two weeks published and posted notice thereof must be given. WHEREAS, two weeks published notice will be given in the SHAKOPEE V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin board on the main floor of the Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall, and individual notices will be mailed to residents of the adjacent Weinandt Acres. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, that a hearing be held in the Council Chambers on the 4th day of February 2003, at 7:00 P.M. or thereafter, on the matter of vacating a portion of easement within the above-described property in the City of Shakopee, County of Scott, State of Minnesota. Adopted in session of the City Council of the City of Shakopee, Minnesota held the _ day of ,2003.
