SUBJECT: Waiver of Minor Subdivision Criteria: 518-528 Dakota Street

INTRODUCTION
Wally Hafstad has submitted an application requesting approval of a waiver of criteria for
property located at 518-528 Dakota Street (Exhibit A). Mark & Mary Rein are the
current owners ofthe property, which had a duplex built on it in 1975. Apparently, the
property was split into two (2) lots at that time, but was combined in 1986. The applicant
and property owners are now requesting a split of this property, similar to that done in
1975. For this to occur, they are requesting a waiver ofthe minor subdivision criteria to
allow a minor subdivision that would create lots that do not meet the minimum lot width,
lot area and side yard setback.
BACKGROUND
The property in question is zoned R-3, Multiple-Family Residential Zone. The R-3 Zone
allows single family and two (2) family dwellings as permitted uses, and requires lots to
have a minimum 150 feet in width, 200 feet in depth and a minimum lot size of one (1)
acre. The minimum side yard setback is fifteen (15) feet. The proposed lots would be
60 feet wide, approximately 10,300 sq. ft. in area (.236 acres) and would share a common
side yard. The Iot(s) would be approximately 172 feet in depth.
The Building Official has provided a comment that separate sewer and water services
shall be provided.
The applicant has provided a copy of the current and proposed legal descriptions, as well
as a copy of the property survey. If the waiver of criteria request is granted, the applicant
will continue to work with staff on the minor subdivision process.
ALTERNATIVES
1) Approve the requested waiver of minor subdivision criteria for lot size, lot width
and side yard setback.
2) Do not approve the waiver of minor subdivision criteria.
3) Table the matter for additional information.
STAFF RECOMMENDATION
Staff recommends approval of the waiver of criteria request.
ACTION REQUESTED
Offer a motion consistent with the Council's wishes. If Council approves the requested
waiver of minor subdivision criteria, the applicant shall work with staff to complete the
minor subdivision process.

The above were recorded in 1975, the year
the Twin Home was built.
(3) 12885 transfers the south 60' from Son
to Parents
(4) 16906 merged the two parcels together,
upon the passing of Mr. Christensen.
