No. 655 /4/, C, CITY OF SHAKOPEE Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Peter Vickerman: Planner I-GIS SUBJECT: Amendment to the Zoning Map - Rezone property from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone MEETING DATE: January 21, 2003 CASELOG NO.: 03-003 INTRODUCTION: Scott Wirth of Wirth Properties is requesting that the City amend its zoning map to rezone property currently zoned Old Shakopee Residential (RI-C) to Medium Density Residential (R2) Zone. The property is located north of 4th Ave, east of Adams St, south of3rd St,and west of Harrison St (Exhibit A). The Comprehensive Plan guides this area for Medium Density Residential purposes. PLANNING COMMISSION RECOMMENDATION: At its January 9,2003, meeting, the Planning Commission took public testimony and reviewed this request. After review and discussion, a motion to recommend approval of the rezoning request was approved by a vote of6-1. Provided for your reference is a copy ofthe January 9,2003 ALTERNATIVES: 1. Approve the request to rezone property from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone. 2. Deny the request to rezone property from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone. 3. Table the decision and request additional information from the applicant and/or staff. ACTION REQUESTED: Offer and approve a motion to approve Ordinance No. 655, approving the request to rezone property from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone. Peter Vickerman Planner I-GIS ORDINANCE NO. 655, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC. 11.03 BY REZONING LOTS 2, 3, 4, BLOCK 9, KOEPERS ADDITION FROM OLD SHAKOPEE RESIDENTIAL (R1-C) ZONE TO MEDIUM DENSITY RESIDENTIAL (R2) ZONE WHEREAS, Scott Wirth of Wirth Properties, applicant and Ernest M. Lebens & Violet Lebens Estate, property owner, has requested the rezoning of land from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone; WHEREAS, the subject property is legally described as follows: Lots 2,3,4, Block 9, Koepers Addtions and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on January 9,2003, at which time all persons present were given an opportunity to be heard; and WHEREAS, the City Council heard the matter at its meeting of January 21,2003, and found that the proposed rezoning is consistent with the Comprehensive Plan for the area of the City within which it is located. THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That the zoning map adopted in City Code Sec. 11.03 is hereby amended by rezoning the property referenced herein, from Old Shakopee Residential (RI-C) Zone to Medium Density Residential (R2) Zone. Section 2 - Effective Date. This ordinance becomes effective from and after its passage and publication. The property is located north of 4th Avenue, between Adams St and Harrison Street. (please see Exhibit A). The property to be rezoned currently is a vacant lot. The applicant wishes to rezone the property to allow a greater residential density in order to build two duplexes on the site. The current zoning (RI-C) allows up to 7.5 units an acre. The proposed zoning (R2) allows up to 8.0 units per acre. The property size is approximately .517 acres. With 4 units (2 per duplex) the proposed density would be 7.73 units per acre. Property to the south of this site is zoned Medium Density Residential and new townhomes have recently been constructed. Property to the north and west are zoned Old Shakopee Residential but have multi-family structures (actual number of units and density wasn't determined). Further west the land is zoned Multiple Family Residential (R3). The comprehensive plan guides this area for Medium Density Residential Use. The City's Comprehensive Plan sets basic policies to guide the development of the City. The purpose of designating different areas for residential, commercial, and industrial land uses is to 1 promote the location of compatible land uses, as well as to prevent incompatible land uses from being located in close proximity to one another. The Zoning Ordinance is one of the legal means by which the City implements the Comprehensive Plan. Under Mirmesota statute, zoning is to conform with a city's comprehensive plan. The proposed rezoning is consistent with the adopted land use plan. Exhibit B provides a listing of the uses, both permitted and conditional, that are allowed in the Old Shakopee Residential (RI-C) and Medium Density Residential (R2) zoning districts. FINDINGS: The criteria required for the granting of a Zoning Ordinance Amendment are listed below with proposed fIndings for the Commission's consideration. Criteria #1 That the original Zoning Ordinance is in error; Finding #1 The original zoning ordinance is not in error. Criteria #2 That significant changes in community goals and policies have taken place; Finding #2 Significant changes in community goals and policies have not taken place relative to the subject property. Criteria #3 That significant changes in City-wide or neighborhood development patterns have occurred; or Finding #3 Zoning of the subject property to Medium Density Residential (R2) will be consistent with desired development patterns for this area of the City. Criteria #4 That the comprehensive plan requires a different provision. Finding #4 The requested zoning is consistent with the adopted Comprehensive Plan land use map. ALTERNATIVES: 1. Recommend to the City Council the approval of the request to rezone the subject property, from Old Shakopee Residential (RI-C) to Medium Density Residential (R2). 2. Do not recommend to the City Council the approval of the request to rezone the subject property from Old Shakopee Residential (RI-C) to Medium Density Residential (R2). 3. Continue the public hearing and request additional information from the applicant or staff. 4. Close the public hearing, but table the matter and request additional information. STAFF RECOMMENDATION: Staff recommends Alternative No.1, recommend to the City Council the approval of the request to rezone the subject property from Old Shakopee Residential (RI-C) to Medium Density Residential (R2). ACTION REQUESTED: Offer and approve a motion to recommend to the City Council the approval of the request to rezone the subject property from Old Shakopee Residential (RI-C) to Medium Density Residential (R2).
