Staffhas prepared a draft text amendment that proposes revisions to the wall signage requirements within the commercial zoning districts. The intent of the revisions is to provide consistency and clear up some typographical errors. ALTERNATIVES: 1. Approve Ordinance No. 653, approving the text amendment as presented. 2. Approve Ordinance No. 653, approving the text amendment with revisions. 3. Do not approve the proposed amendment. 4. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed and recommended approval of the text amendment at its December 5, 2002, meeting. A copy of the staffreport from the December 5 Commission meeting is attached for the Council's reference. ACTION REQUESTED: Offer and pass a motion to approve Ordinance No. 653, ending City Code Sec. 11.70 as presented. g:\cc\2003\O 1-21 \tawallsignage.doc 1 ORDINANCE NO. 653, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CHAPTER 11.70 SIGNS THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter 11, Zoning, Section 11.70, is hereby amended by adding the language which is underlined and deleting the language which is struckthrough. Section 11.70, Subd. 8.A. Wall Signs. (Neighborhood Commercial, Community Commercial, and Central Business District Zones). A. Wall Signs. 1. On the front of the building. a. The front of the building shall be defined as the wall of the building with the main entrance. b. One and one-fourth (1-114) square feet of sign age shall be allowed for every linear foot of the building wall. c. Maximum of 125 square feet of signage. d. Business complexes shall be allowed one (1) oquare foot per linear foot of building wall on vlhich the signs is mounted up to a maximum of 100 square feet per tenant on a side of the building other than the front. 2. Not on the front of the building. a. Signage shall be allowed on a building wall other than the front if the wall faces a street or there is a public entrance on that side of the building. b. One (1) square foot of signage for each linear foot of building wall on which the sign is located. c. Maximum of 100 square feet. d. Business complexes shall be allo'tved one (1) square f-oot per linear f{)ot of building wall on which the sign is located up to a maximum of 100 square f-eet per tenant on a side ofthe building other than the front. 3. Business Complexes. a. Shall be allowed one (1) square foot per linear foot of building wall on which the sign is mounted up to a maximum of 125 square feet per tenant, whichever is less, on the front ofthe building. b. Shall be allowed one (1) square foot per linear foot of building wall on which the sign is located up to a maximum of 100 square feet per tenant, whichever is less, on a side of the building other than the front. Business complexes shall be allov/ed two (2) square feet per linear foot of building wall on which the sign is mounted up to a maximum of 200 square feet per tenant on a side ofthe building other than the front. 2. Not on the front of the building. a. Signage shall be allowed on a building wall other than the front if the wall faces a street or there is a public entrance on that side of the building. b. One (1) square foot of sign age for each linear foot of building wall on which the sign is located. c. Maximum of 100 square feet. d. Business complexes shall be allowed one (1) square foot per linear foot of building wall or up to a maximum of 300 square feet, whiche'/er is less. 3. Business Complexes. a. Section 2 - - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota, held the day of ,2003. A concern identified by thp C{ll lmission was how the proposed language would address signage for tenants within a larger retail use. For instance, a TCF Bank within a Cub Foods store. It is staffs opinion that the proposed text would allow a maximum sign area for a walVbuilding and that any signage for additional tenants would need to be provided for within that maximum. It is not the intent to allow additional signage for each interior tenant. On September 5, 2002, the Planning Commission reviewed a proposed text amendment regarding wall signage. Since that time, staff has reviewed the current ordinance governing wall signage and has identified other issues requiring attention and possible revision. As a result, staff is withdrawing the original request for text amendment and has renoticed a public hearing for the revisions before the Commission this evening. The original request only dealt with the wall signage provisions for Highway Business (B 1) and Major Recreation (MR) zoning districts. A separate portion of the zoning ordinance addresses wall signage in the Neighborhood Commercial (NC), Community Commercial (CC), and Central Business (B3) zoning districts. With this proposed revision, staff will be addressing wall signage in all of the aforementioned districts. The current provisions of the City Code are as follows: Section 11.70, Subd. 8.A. Wan Signs. The intent ofthe proposed revisions are to provide clarity and uniformity to the 1) "per tenant" regulations, 2) business complexes regulations and 3) front wall and not the front wall regulations. Specifically, staff is recommending the proposed language changes below. Language which is underlined is proposed and language which is struckthrough is proposed for deletion. City Code states that the City Council may grant a zoning ordinance amendment when it finds that one or more of the following criteria exists. Staff has prepared draft findings for the Board's reference: Criteria # I That the original zoning ordinance is in error; Finding # J The original zoning ordinance is in error. Criteria #2 That significant changes in community goals and policies have taken place; Finding #2 Significant changes in community goals and policies have not taken place. Criteria #3 That significant changes in City-wide or neighborhood development patterns have occurred; or Finding #3 Signfficant changes in development patterns have not occurred Criteria #4 That the Comprehensive Plan requires a different provision. Finding #4 The proposed text amendment is not in conflict with the Comprehensive Plan. AL TERNA TIVES: l. Recommend to the City Council approval of the proposed text as presented. 2. Recommend to the City Council approval of the proposed text amendment with revisions. 3. Do not recommend to the City Council the approval of the proposed amendment. 4. Continue the public hearing and request additional information from staff. 5. Close the public hearing, but table the matter and request additional information.
