INTRODUCTION Tollefson Development has made application for final plat approval of Westchester Estates. The proposed development is located south of the Providence Pointe development and east of County Road 79 (Exhibit A). The development, as proposed, would consist of 174 single family residential lots (Exhibit B). CONSIDERATIONS Drainage issues impacting this property and property owned by the School District have been under discussion since the application for final plat was filed. As of the preparation ofthis memo, the agreement had not yet been finalized. Prior to expiration ofthe standard 120 review, the applicant agreed to a 30 day extension to the review period for the drainage issue to be resolved. The extension expires on March 2, 2003 - prior to the next scheduled Council meeting. Given that timeline and the unresolved issues, staffhas prepared a resolution of denial of the final plat. Should the issue be resolved prior to the February 18 meeting or ifthe applicant wishes to postpone action on this application in order to reach a resolution to the drainage issues, the applicant would need to provide, in writing, an extension to the review period. ALTERNATIVES 1. Approve Resolution No. 5861, denying the Final Plat of Westchester Estates. 2. Accept an extension to the review period from the applicant. STAFF RECOMMENDATION Staff recommends Alternative No.1, approval of Resolution No. 5861, denying the Final Plat of Westchester Estates. ACTION REQUESTED Offer a motion approving Resolution No. 5861, denying the Final ~lat of Westchester Estates, and move its approval. g:\cc\2003\02-18\fpwestchesterestates.doc RESOLUTION NO. 5861 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA DENYING THE FINAL PLAT OF WESTCHESTER ESTATES WHEREAS, Tollefson Development, applicant and property owner, have made application for final plat approval of Westchester Estates; and WHEREAS, the subject property is legally described as: The South Half of the Northwest Quarter of Section 18, Township 115, Range 22, Scott County, Minnesota; and WHEREAS, the City Council reviewed the final plat request at its meeting ofPebruary 18, 2003; and WHEREAS, the agreement regarding drainage issues affecting the property and property owned by Independent School District 720 has not yet been finalized; and WHEREAS, without a further extension being granted by the applicant, the review period for this application will expire on March 2, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKO PEE, MINNESOTA, as follows: That the final plat of Westchester Estates is hereby denied.
