Michael Leek, Community Development Director SUBJECT: Preliminary Plat of Whispering Oaks MEETING DATE: December 3, 2002 CASELOG NO.: 03-011 REVIEW PERIOD: December 30, 2002 - April 29, 2003 INTRODUCTIONIDISCUSSION: The City Council is asked to consider approval of a preliminary plat for a single-family subdivision identified as Whispering Oaks. The subject property is located in the far southeastern comer of the City, and abuts the Cities of Savage on the east and Prior Lake on the south. Because of its distance from existing City of Shakopee sanitary sewer and water service, the plat would be served for the time being by the City of Savage. Attached for the Council's information is a copy of the report that went to the Planning Commission for the February 6,2003 public hearing. Three conditions were to be met prior to Council review. They were; A. The plat name shall be added to the preliminary plat drawing and related documents. B. Street names shall be added to the preliminary plat C. Lot 21, Block 2 shall be revised to meet the minimum lot width requirement of 60 feet at the front yard setback line. These have been complied with, although staff is still checking the proposed street names to confirm that they may be used. ALTERNATIVES: 1. Approve Resolution No. 5856, a resolution approving the preliminary plat of Whispering Oaks, subject to the conditions contained therein; 2. Approve Resolution No. 5856 with revised conditions. 3. Table a decision in order to allow time for the applicant and/or staffto provide additional information. PLANNING COMMISSION: Planning Commission recommended approval on February 6,2003. Muhlenhardt, property owner, has requested the approval of a single-family preliminary plat known as Whispering Oaks; and WHEREAS, the subject property is legally described as Outlot A, Horizon Heights 4th Addition, Scott County, Minnesota. WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on February 6, 2003, at which time all persons present were given an opportunity to be heard; and WHEREAS, the City Council heard the matter at its meeting of February 18, 2003, and recommended approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: I. The following procedural actions must be completed prior to the recording of the final plat: D. Approval of title by the City Attorney. E. Execution of a Developers Agreement which shall include provisions for payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. 1. Street lighting to be installed in accordance with the requirements ofthe Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements ofthe Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Installation of sanitary sewer and storm sewer systems in accordance with the requirements of the Design Criteria and Standard Specifications of the City of Shakopee. 5. The developer shall be responsible for payment of engineering review fees, and other fees as required by the City's adopted Fee Schedule. 6. Park Dedication shall be accepted in the form of 8.75 acres of land and park and trail improvements as recommended by the PRAB and as outlined below; G: \CC\2003\02-18\ppwhisperingoaks.doc 3 a) The developer shall install all trails and playground/recreation equipment in the proposed park. b) All playground equipment and materials shall meet the Consumer Product Safety Commission's standards, the American Society for Testing Materials and general park development standards used in the Shakopee Park System. c) Bituminous trails shall consist of at least 6 inches of Class 5 gravel with at least 2 inches of asphalt paving. d) Ground cover in the active use areas of the park shall consist of at least 6 inches of topsoil, and a sunny seed mix of Kentucky Blue Grass and Rye Grass. F. Final Construction Plans and Specifications must conform to City requirements and are subject to approval by City Engineer. Such plans as they relate to water or electricity are subject to the approval of the SPUC Utilities Manager. G. Temporary street signs must be displayed. H. No site grading will be allowed until preliminary plan and profile sheets for street and utility work are approved by the City Engineer. II. Following approval and recording of the final plat the following conditions shall apply; A. Houses on lots immediately adjoining the CSAH 18 right-of-way shall be equipped with STC 30-rated windows. As an alternative, or in addition to, the developer shall construct a sound mitigation fence along CSAH 18. B. Responsibility for other noise mitigation measures that may be required in the future shall rest with the developer or its assigns. C. Distinctive and informative Conservation Easement Markers will be developed with City staff, and installed at the conservation easement areas and relevant property lines at the time of building permit issuance. D. The Shakopee Public Utilities Commission/City of Savage water services agreement and the City of Savage/City of Shakopee sanitary sewer service agreement shall govern charges for sanitary sewer service and water service. III. Prior to any site grading, the following actions must be completed; A. Submit the City of Shakopee Wetland Application, and receive approval of the wetland mitigation plan. B. Payment of grading fees will be required per the most current City of Shako pee Fee Schedule. C. No grading shall occur until the grading plan and storm water issues have been reviewed an approved by the City Engineer. D. Earthwork balance calculations need to be shown on the grading plan. The calculations should show the amount of import and export of the different fill materials needed to balance the site. The source of fill materials shall also be indicated on the grading plan. Project benchmarks need to be tied to the City's approved benchmark system. A surveyor's bench loop notes will have to be submitted showing how the project benchmarks have been established. F. Additional storm drainage calculations need to be submitted including the 100-year and 10-day snowmelt event. G. Pond outlet rate shall not exceed 1/1 Oth cfs per acre. H. The grading plan should be revised so that grading for ponding areas does not occur in the Scott County right-of-way. The subject property is located in the far southeastern comer of the City, and abuts the Cities of Savage on the east and Prior Lake on the south. Basic site and development information is as follows: Site Size: 97.84 acres Proposed No. of Lots: 136 Proposed Density: Gross (per City Code): 1.39 dwelling units/acre G: \BOAA - P C\2 00 3 \02-06\ppwhisperingoaks .doc 1 Net (excluding ROW) 1.64 dwelling units/acre Range of Lot Sizes: 12,150 sq. ft./.28 acres - 148,191 sq. ft/3.4 acres Average Lot Size: 23,232/.53 acres CONSIDERATIONS: General: Along with the ACC 2nd Addition project on the west side of Marschall Road, which recently received preliminary plat approval, the proposed plat is among the first in the important, and attractive bluff areas of the City. As a result an important issue that has been under discussion for some time with City staff is the tree preservation and reforestation plans. Currently, about 47.99 acres/49.05% ofthe site is wooded. After development, about 26.19 acres/26.77% of the site will remain wooded. The Landscape/reforestation plan includes the use of several types of trees, including several varieties of oak and maple. Because CSAH 16 and 18 isolate the site, the provision of park and recreation opportunities is important to the site as well, and this concern has been addressed by the PRAB review and recommendation. The location of the play equipment and its protection from traffic on CSAH 18 may be an item the Commission wishes to discuss further. Engineering: The Engineering Department has submitted comments, a copy of which is attached. The proposed conditions have been included in the draft conditions of approval set for the below. Environmental Advisory Committee (BAC) Review: The EAC reviewed the proposed preliminary plat at its meeting of January 8, 2003 and made recommendations as presented in the attached memo from Natural Resource Director Mark McQuillan dated January 10, 2003. The recommendations have been incorporated in the draft conditions of approval set forth below. Park and Recreation Advisory Board (PRAB) Review: At its January 22, 2003 meeting the PRAB recommended that park dedication be accepted in the form outlined in Natural Resource Director Mark McQuillan's January 22,2003 memo, a copy of which is attached. The recommendations have been incorporated in the draft conditions of approval set forth below. Other Review Comments Received: Shakopee Public Utilities Commission submitted comments, a copy of which is attached. A condition is included in the proposed conditions for approval that addresses the charges related to sewer and water service. Conditions related to noise control and mitigation are included in the draft conditions of approval set forth below. Correspondence regarding CenterPoint Energy's comments is attached for the Commission's infonnation. Scott County has indicated that grading for the proposed ponds will not be allowed in the County's right-of-way, and so the plans should be revised accordingly. ALTERNATIVES: 1. Recommend to the City Council approval of the preliminary and preliminary plat of Whispering Oaks subject to the following proposed conditions: I. The following actions must be completed before review of the preliminary plat by the City Council: A. The plat name shall be added to the preliminary plat drawing and related documents. B. SUBJECT: Preliminary - Whispering Oaks Pill No.: 27-924013-0 DATE: January 27,2003 The application indicates a Preliminary Plat is proposed for Whispering Oa~s. After reviewing the referenced application, I have the following comments for the applicant, and for the planning department: General Comments: A. Site Grading: The applicant needs to submit to the City of Shakopee a Wetland Application and receive approval of wetland mitigation plan. There are some grading plan issues and storm water issues (see Storm Sewer/Ponding below) that need to have further review and be approved by the City Engineer. These issues involve several Regular (R) homes along Street 1 and Street 2 that need to be raised due to the basement elevations being too low as compared to the surrounding pond's High Water Levels (HWL). Earthwork balance calculations need to be shown on the grading plan. The calculations should show the amount of import and export of the different fill materials needed to balance the site. Also indicated on the grading plan should be the source ofthe fill materials. Project benchmark information is needed on the grading plan. Benchmark information needs a registered land surveyor's verification. Project benchmarks need to be tied to the City of Shakopee's approved benchmark system. A surveyors bench loop notes will have to be submitted showing how the project benchmarks have been established. B. Construction Plans: No street and utility construction will begin until final constmction plans have been approved and signed by the City of Shakopee' s City Engineer. The constructions plans - , ,. will meet the City of Shakopee standards for plan sets. The title sheet shall have a signature block for the City of Shakopee's City Engineer to sign. It is the applicant's responsibility to check with other agencies and get their approval before construction begins. Construction plans for street and utility work will contain plan and profile sheets for each street as well as cross section sheets. Plan and profile sheets will be 22" X 34" and not have a scale smaller than 1 "=100' horizontal and I "=10' vertical. Cross-section sheets will have a scale no smaller than 1 "=1 0' both in horizontal and vertical. Text size will not be smaller than 0.10". The construction plans shall contain an overall street and utility layout. c. Street Construction: The applicant's engineer will need to work with City of Shako pee Engineering staff, City of Savage Engineering staff and. Scott County Highway Department's Engineering staff to confirm access to local streets and County Roads. All permits from all agencies needed for the construction of this project are the responsibility ofthe applicant. D. Water/Sanitary Sewer The Shakopee Public Utility Commission must approve the water system necessary to serve the proposed development. AllY Trunk Watermain Charges shall be paid, as required by the Shakopee Public Utility Commission. A lift-station in the area of Street 2 and County Road 18 is being installed as part ofthis subdivision. All sanitary sewer from the lift-station will be pump through a forcemain to a sanitary manhole in Savage. At this time no joint agreement between the City of Shakopee and the City of Savage has been approved. Before installation of sanitary sewer this agreement will need to be in place. Sanitary Sewer Trunk Charges will apply to this plat. E. Storm Sewer/Ponding: The applicant's engineer will need to work with City staff and the City's engineering consultant on the storm sewer plan for this area ofthe City and to ensure that adequate easements are incorporated into the final plat. Final plat cannot be recorded until the easements are acceptable to the City Engineer. The applicant has submitted storm drainage maps and calculations, but there is some infonnation still needed and some design criteria that needs to be met. Additional storm drainage calculations need to include the 100 year, 10 day snowmelt event and pond outlet rates for this area need to meet the comprehensive stonn water plans requirement of not more that 1110th cfs per acre. The storm water plan should include a drainage map showing the piping and ponding system needed to control nmoff rates under a fully developed site. Stonn Water Trunk Charges will apply to this plat. Ponding Fees will not apply to this plat. McQuillan, Natural Resources Director Subject: Plan Review by EAC for Wispering Oaks - Development by Tollefson Date: January 10, 2003 INTRODUCTION/BACKGROUND At its January 8, 2003 Environmental Advisory Committee Meeting, the EAC review the Whispering Oaks Preliminary Plat. The developer had met with the EAC in December of 2002 to present a Conceptual Drawing of their plat. At that meeting, the EAC requested, that the developer to provide with their Preliminary Plat: 1. A reforestation plan, 2. A clarification of the delineated wetlands shown in their plans and Wetland Delineation Report by Aquatic Ecosolutions, Inc., and 3. To have the City responsible for enforcing restrictions within the Conservation Easement. During the January 8. 2003 presentation of the Preliminary Plat, Project Engineer Mr. Matt Weiland of Tollefson provided a detailed Reforestation Plan including a 48-page Tree Inventory. Tollefson is retaining 55% of the trees on site and adding 371 new trees with a 2.5-inch diameter trunk. In addition, the developer is proposing a Conservation Easement for much of the wooded areas. The EAC was very pleased with the Applicant's Reforestation Plan and information about the delineated wetlands and ponds. The EAC would like to review the Conservation Easement Agreement before final plat approvaL ENVIRONMENTAL ADVIOSRY COMMITTEE RECOMMENDATIONS At its January 8, 2003 meeting, The EAC moved to recommend the following conditions for the Whispering Oaks Plat: 1. That the proposed Conservation Easement areas, and Lots with a conservation easement, have Conservation Easement markers installed on the property lines at the time when a Building Permit is issued, 2. To install silt fencing or other acceptable fencing during construction to protect the conservation easement areas and trees being preserved, 3. To work with staff to design a Conservation Easement marker that will be distinct and informative. The EAC also approved the Reforestation Plan and proposed ponds and wetland areas to control water run-off. A ~ , I i \.. Date: January 22, 2003 INTRODUCTION/BACKGROUND At its January 27,2003 Parks and Recreation Advisory Board Meeting, the PRAB reviewed the Whispering Oaks Preliminary Plat for parks, trails and open space requirements. Tollefson proposes to develop 97.84 acres to include 136 lots for single- family homes. The developer proposes to dedicate 10.57 acres for park and to install trails and play equipment in the park. After considerable review, the Parks and Recreation Advisory Board recommended to the Planning Commission the following conditions for preliminary plat approval: 1. Accept the parkland proposed by Tollefson for Whispering Oaks minus the pond along Street #2. 2. Accept the Applicant's offer to install trails and playground equipment in the park. 3. Accept the trail proposed along the street referred as "Street 2". 4. That all playground equipment and materials meet the Consumer Product Safety Commission's standards, the American Society for Testing Materials and general park development standards used in the Shakopee Park System. 5. That all park improvements be reviewed and approved by staff. 6. That bituminous trails consist of a minimum standard of 6-inches of Class 5 gravel with two-inches of asphalt. 7. That groundcover in the active areas of the park consist of a minimum of 6- inches of topsoil and a sunny seed mix of Kentucky Blues Gras and Rye Grass. It has been the practice of the City not to accept ownership of ponds, but require an easement over the pond. It is my recommendation to the PRAB and City Council to not accept the pond as park but as open space attached to the adjacent Lots or under the Home Association. .' e Minnesota Pollution Control Agency January 7,2003 Ms. Julie Klima Planner IT City of Shakopee 129 Holmes Street South Shakopee,~ 55379-1351 RE: Review of City of Shakopee Rezoning Application Dear Ms. Klima: The Minnesota Pollution Control Agency (NIPCA) appreciates that the City of Shakopee (City) sends rezoning applications to the noise program for review and comment. Unfortunately because there is no noise analysis accompanying these applications the MPCA can do little more than reference the state noise rule. To prevent any delays in the review of final plats for the City, I would like to provide you with a summary of the MPCA noise rules and their applicability. Minnesota uses two different measurement metrics to define its noise levellimits, an LID and an Lso, both of which are measured in "A" weighted decibels (dBA). LIO means the sound level, expressed in dB (A), which is exceeded ten percent ofthe time for a one hour survey, as measured by test procedures approved by the commissioner. LSD means the sound level, expressed in dB (A), which is exceeded 50 percent of the time for a one-hour survey. The State noise rules are based on the land use activity at the location of the receiver. The residential noise level limits are as follows: Daytime Nigh ttime (7:00 a.m. to 10:00 p.m.) (10:00 p.m. to 7:00 a.m.) LSD LIO LSD LIO 60 dBA 65 dBA 50 dBA 55 dBA For a proposed development next to an existing roadway, it is the responsibility of the developer and the governmental unit that has land use authority to ensure that the State noise rules are not exceeded. Regarding rezoning issues, it should be noted that it is the responsibility of the City to comply with the State noise rules. 7030.0030 NOISE CONTROL REQUIREMENT. This easement is for a high-pressure natural gas transmission line and must be operated and maintained in accordance with the Code of Federal Regulations, Part 192, Title 49, "Transportation of Natural and Other Gasses by Pipeline: Minimum Federal Safety Standards. CenterPoint Energy Minnegasco's easement is 60.00 feet in width as shown on the plans. The easement is recorded with the Scott County Recorder in the Book of Easements on page 95. It was assigned to Minnegasco, Inc, now Reliant Energy Minnegasco, by Quit Claim Deed recorded as document number 234171. The plat should reference "Reliant Energy Minnegasco per document number 234171. The name change to CenterPoint Energy Minnegasco has not yet been recorded as another corporate change is forthcoming. To aid in the development of the easement area, I have enclosed a copy of CenterPoint Energy Minnegasco's Guidelines for Construction and/or Encroachment within Gas Pipeline Easements. It appears the developer may already have a copy of these Guidelines. A preliminary review of the plats indicates that a few changes need to be made. , 1. The easement should be referenced as Reliant Energy Minnegasco easement per document number 234171 2. It appears that the grading where the transmission line crosses the street may be acceptable. However, the proposed change in grading immediately to the east may require modification of the pipeline. Any costs for this operation, if necessary, will be paid by the developer. The grading in the easement area to the west of the street may be acceptable and is still pending review by an Engineer. For your information, in accordance with the Code of Federal Regulations referenced above, CenterPoint Energy Minnegasco will soon be clearing all of the trees in the easement area within 10 feet on each side of the transmission pipeline.. CenterPoint Energy Minnegasco may inspect the area and review construction plans. Final construction plans must be reviewed and approved, in writing, by CenterPoint Energy Minnegasco prior to the start of any construction within CenterPoint Energy Minnegasco's easement. Grading and utility plans showing CenterPoint Energy Minnegasco's approval must be on site and available to Center Point Energy Minnegasco personnel during construction with the easement. 1. SoiL shaH not be removed or placed in a manner that will result in earth or pavement cover over the pipeline of less than three feet or more than five feet unless otherwise approved. A level area of not less than six feet on each side of the pipeline shalJbe maintained at all times. Slope beyond 6' from the pipeline shall n.ot be steeper than 4 to 1, unless otherwise agreed. Any amount of cut or fill, within the 4 to 1 slope area, shall increase the width of the level area on each side of the pipeline by that same footage of cut or fill. The pipeline must be fully accessible at all times before, during, and after the construction. 2. Landscaping over and within ten feet on each side of the piperine is restricted to grass cover only. Beyond ten feet on each side of the pipeline, upright plantings are restricted to, and shall not exceed an eventual growth height of six (6) feet. No trees shall be planted or remain within the easement. Any trees, removed by CenterPoint Energy Minnegasco from within the easement, while performing maintenance activities shall not be rep.laced by CenterPoint Energy Minnegasco or the current owner, their successors or assigns. 3. Any buried utility line installed across the in-place pipeline shall be placed with no less than one foot of vertical separation, padded with well compacted (95% Standard Procter) granular soil and cross at an angle between 450 and 900 from the pipeline. 4. With prior CenterPoint Energy Minnegasco approval by the Senior Administration Engineer or Right of Way Administrator, parking lots, perpendicular driveways or roadways of portland cement concrete or asphaltic concrete (or similar materials) may be placed within the easement, but shall be limited in width when crossing the easement to minimize the interference with or access to the pipeline for inspection and maintenance. Permanent structures including, but not limited to, buildings, signs, screen walls, decks, tennis courts, and swimming pools are not allowed under any circumstances within the easement. Installations including, but not limited to, retaining walls and fences crossing the pipeline require approval by the CenterPoint Energy Minnegasco Senior Engineer or Right of Way Administrator, before construction. All fences crossing the pipeline must have a 10-foot wide gate centered over the pipeline. All fences installed paralle! with the pipeline will maintain a minimum of 10 feet of separation from the pipeline. 5. Once CenterPoint Energy Minnegasco and the Owner, Developer or Contractor have reached an agreement, CenterPoint Energy Minnegasco shall be given at least two working days advance notice of planned construction activity so arrangements can be made for CenterPoint Energy Minnegasco Personnel to monitor the construction. Center Point Energy Minnegasco will locate and stake the pipeline, but will not assume responsibility to expose or backfill the pipeline or to determine the actual elevation of the in-place pipeline. Excavation to expose the pipeline shall be parallel to the pipeline. CenterPoint Energy Minnegasco Personnel must be present during this excavation. Backfill shall be compacted to 95% Standard Procter. 6. Any subsequent damage or removals caused by CenterPoint Energy Minnegasco in the exercise of its easements rights, of any and all of those certain foreign constructions (landscaping, driveway, roadway, utility lines, etc.) which may be permitted within the easement area, will be permanently repaired or replaced at the owner's or contractor's (not Center Point Energy Minnegasco'sl expense. 7. In accordance with Federal Department of Transportation Codes, CenterPoint Energy Minnegasco must place markers over transmission pipelines.
