Holmes Street Shakopee MN 55379 RE: Public Improvement Project, Viking Steel Road/Sarazin Street Dear Mr. Loney: In 2002 the Shakopee Public Utilities Commissionacg,uired a 20 acre parcel of property a short distance north of 4 Ave and East of Viking Steel Road for a site for our new service center. The architect is now working on the Design Development phase of the building design, with contract award slated for June 2003. Occupancy is slated for August 2004. .. In searching for a site, the first consideration was for one that would meet the operational needs of the Utilities, now and _ future. However, the favorable view by the Planning Commission on our locating on the Viking Steel Road site was a -significant factor in the Utilities Commission's selection of that particular site. Construction of city water and sewer facilities in 2003 is - essential to our being able to occupy the service center as scheduled, and having a paved road by time of occupancy is important for both truck and customer traffic. The Utilities Commission asks that the Viking Steel Road/Sarazin Street Project be constructed as expeqitiously as possible. SHAKOPEE PUBLIC UTILITIES MEMORANDUM TO: LOU VAN HOUT - UTILITIES MANAGER ~ FROM: JOHN R. CROOKS - WATER SUPERINTENDENT ~ SUBJECT: INFORMATION FOR JOINT MEETING DATE: FEBRUARY 21, 2003 In preparation of the joint City Council! Shakopee Public Utilities meeting, I am providing information to assist in addressing long-term water issues. The two major items to be discussed are the Wellhead Protection Plan (WHPP) and the future plans for additions of water supply facilities and structures. With the tremendous growth within the City of Shako pee there may be concerns on the City's part that the water system can stay ahead of the progress. An important piece of the planning took place last October when the Water Department was granted an 80% increase in water allocation as permitted by the Department of Natural Resources (DNR). For several years the system had been exceeding their allotted production and had petitioned the DNR to increase the amount due to the growth in the City of Shakopee. The change last Fall in the D~'s permit will allow the future increase of the water supply without requiring yearly issues with the DNR water use appropriations. I have attached a copy of the memo to you regarding this important issue as well as the DNR letter stating the amendment to the permit. Also attached to this memo are the 2003 Capital Projects for the Water Department as wen as the 2003-2007 Capital Improvement Plan. Within this document are the planned improvements to the system that will allow the water supply to stay ahead of projected growth. These planned improvements are based upon the 2001 Comprehensive Water Plan as prepared by our consulting engineer Schoell and Madson and Utility Staff. The last item I have attached to this memo is the work plan as developed for the WHPP. Within the work plan are several main components that lead to milestones, as designated by Staff. Items which are marked with an asterisk are utility imposed milestones. Items in italics indicate Minnesota Department of Health (MDH) responsible scheduled tasks. As you are well aware the WHPP Part 1 has been . , . submitted to the MDH and the Utility is awaiting their response to the delineations. The pre-delineation meeting went well and it is expected to eliminate most issues and questions the MDH may have regarding Part 1. It is also expected the MDH will hold the scoping meeting for the WHPP Part 2 this Spring. These components are somewhat more involved and will require the Utility to develop a management plan to lessen possible impacts within the 10 year recharge areas for each 01 the wells used in providing water to the City of Shakopee. FROM: SUBJECT: DNR WATER APPROPRIATION PERl\fiT . , DATE: OCTOBER 30, 2002 Attached to this memo is the am~nded DNR water appropriation permit #80-6205. The purpose of the permit is for the DNR to set an authorized volume of appropriation expressed as both maximum pumpage in gallons per minute and as total pumpage authorized per year. The permit also acknowledges each current .D1unicipal water supply well the Utility uses. BACKGROUND The Utilities received amended permits in both 1995 and 1996 which only reflected the abandonment of Well 1 and the addition of Well 9, respectivdy. But with both of these amendments. the~e was n~ increase,in the authorized volume of appropriatio~. , The last time the DNR authorized an increase was in 1989 setting the volume at 1.2 billion gallons. Due to this level. of appropriation the Utility has exceeded this amount each of the last 2 years.' . The Utility petitioned the DNR with requests to increase the authorized volume for the prior 3 years, but with no action on the part of the agency. We r'epeated the process again m February of this year, submitting the required paperwork including water use projections b~sed on the 2001 Comprehensive Water Plan. It also included paperwork reflecting the additions of Wells 10, 11 and 12 and the sealing of Well 2 from the Mt. Simon aquifer. With this amended permit we have been allocated 2.159 billion gallons. This represents an 80% increase over the previous authorized volume of 1.200 billion gallons. The maximum gallons per minute allowed is based on the production capacity of each of the 11 water wells combined. The permit also refers to the fact the Mt. Simon aquifer production is limited to a usage of 624 million gallons. The Utility has kept well below the allocated amount of Mt. Simon water. , .' L . RECOMMENDATION Staff would like the CommiSsion to rec6gnize tills information as an important factor in the current nd proposed development of the water system as well as the rapid development within the City of Shakopee. It is at this time direction is sought as to where to direct the information contained within this amended water, appropria!ion permit. QUANTITY: The Permittee is authorized to appropriate water at a rate not to exceed 10 ,400 gallons per minute. (over, please) . i 3. PERMITTEE'S RESPONSIBILITIES; (a) FLOW METER. . -, . '. The Pemittee shall equip each installation for appropriating or using water with a flow meter, unless another method of measuring the quantity of water appropriated to within ten (10) percent of actual amount withdrawn is approved by the Department. (b) REPORTS. Monthly records of the amount of water appropriated or used shall be recorded for each installation. Such readings and the totai amount of water appropriated or used shall be reported annually to the Director of DNR Waters, on or before February 15 of the folJowing year, upon forms supplied by the Division. Any processing fee required by law or rule shall be submitted with the records whether or not any water was appropriated during the year. Failure to report shall be sufficient cause for terminating the permit 30 days following written notice. (c) TRANSFER OR ASSIGNMENT. Any transfer or assignment of rights, or sale of property involved hereunder shall be reported within 90 days thereafter to the Director 6f DNR Waters. . Such notice shall be made by the tra[1sf~ree (i.e., n~w owner) and shall state the intention to continue the appropriation as stated in the permit. This permit shall not be 'transferred or assigned except with the writt,en consent of the Commissioner. . (d) MODIFICATION. The Permittee must notify the Commissioner in writing of any proposed changes to the existing permit. This permit shall not be modified without first Obtaining the written permission from the Commissioner. . 4. COMMISSIONER'S AUTHORITY: (a) The Commissioner may inspect any installation utilized for the appropriation or use of water. The Permittee shall grant access to the site at all reasonable times and shall supply such information concerning such installation as the Commissioner may require'. (b) The Commissioner may, as he/she' deems necessary, require the Permittee to install gages and/or observation wells to monitor the impact of the Permittee's appropriation on the water resource and require the Permittee to pay necessary costs of installation and maintenance. (c) The Commissioner may restrict, suspend, amend, or cancel this pe'rmit in accordance with applicable laws and rules for any cause for the protection of public interests, or for violation of the provisions of this permit. 5. PUBLIC RECORD: . All data, facts, plans, maps, applications, annual water use reports, and any additional information submitted as part of this permit, and this permit -itself are part of the public record and are available for public inspection at the offices of DNR Waters. The information contained therein may be used by the Division as it deems necessary. The submission of false data, statements, reports, or any such additional information, at any time shalf be deemed as just grounds for revocation of this permit. 6. PUBLIC WATER SUPPLIERS: The permittee shall, whenever practical and feasibl~, employ water conservation methods and practices that promote sound water management, including but not limited to the reuse and recycling of water, water saving devices, water scheduling, and public education. 10. EMERGENCY AND CONSERVATION PLANS: -, Public water suppliers serving more than 1,000 people must have a water emergency and conservation plan approved by the Department. Plans must address water supply and demand reduction measures, allocation priorities, and identify altemative sources of water for use in an emergency. Plans must be updated once every ten years and submitted to the commissioner for approval every ten years. 11. MT. SIMON-HINCKLEY AQUIFER: , Water appropriations from the Mt. Simon-Hinckley aquifer are limited ,to domestic water uses for general household purposes for human needs such as cooking, deaning, drinking, washing, and waste disposal. Use "fwater from the Mt Simon-Hinc~ley aquifer for comrnercial, industrial, and nonessential purposes, including lawn watering, golf course irrigation, and vehicle washing, are prohibited by Minnesota Statutes. To meet this requirement, it has been determined that THE CITY OF SHAKOPEE IS NOT AUTHORIZED TO PUMP MORE THAN 624 MILLION GALLONS OF WATER PER YEAR (Shakopee CityWeils 3, and 10) FROM THE MT. SIMON-HINCKLEY AQUIFER. Increase in authorized volumes from the Mt. Simon-Hinckley aquifer will not be allowed in the future 'unless appropriate water conservation measures are implemented and feasible and practical altematives to the Mt. Simon-Hinckley aquifer are found to not exist after substantial effort has been made to search for such altematives. 12. DEMAND REDUCTION: . Public water suppliers serving more than 1,000 people must employ water use demand reduction measures before requesting approval from the Minnesota Department of Health to construct new public water supply weils, or requesting an increase in the authorized appropriation volume from the Department of Natural Resources. Demand reduction measures must include evaluation of conservation rate structures and a public education program that!1::@Y include a toilet and showerhead retrofit' program: , . 13. WATER USE RECORDS: Public water suppliers serving more than 1,000 people. must maintain records of the number of service connections, the volume of use by customer category, and the volume of unaccounted for water and submit this information with the annual water use report. 14.
