Cuddigan has submitted an application for rezoning of property from Agricultural Preservation (AG) Zone to Urban Residential (R-IB) Zone and Rural Residential (RR) Zone. The property is located at the northwest corner of County Road 78 and County State Aid Highway 17 (Exhibit A). The applicant is asking for a rezoning of the Marschall Farm site to RR Zone for a parcel (approximately 10 acres) located on the southeast portion of the property, with the balance (approximately 30 acres) to be designated R-IB Zone (Exhibit B). If approved, the applicant will proceed with a preliminary plat for the R- IB portion of the property (Exhibit C). PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed this project at their March 6, 2003 meeting, and by a 5-1 vote, recommended approval of the requested rezoning. A copy of the staff report to the Planning Commission is attached for the Council's information. ALTERNATIVES: 1. Approve Ordinance No. 661, approval of the request to rezone the subject property from Agricultural Preservation (AG) Zone to Rural Residential (RR) Zone and Urban Residential (R- IB) Zone. 2. Do not approve the request to rezone the subject property from Agricultural Preservation (AG) Zone to Rural Residential (RR) Zone and Urban Residential (R-IB) Zone. 3. Continue the public hearing and request additional information from the applicant or staff. 4. Close the public hearing, but table the matter and request additional information. Cuddigan, Cuddigan Custom Builders, applicant, and Roy, Danita, Elmer, Kathryn, Harold & Marie Marschall, property owners, have requested the rezoning of land from Agricultural Preservation (AG) Zone to Rural Residential (RR) Zone and Urban Residential (R-1B) Zone; WHEREAS, the subject property is legally described as follows: The Southwest Quarter of the Southeast Quarter of Section 18, Township 115, Range 22, Scott County, Minnesota; and WHEREAS, notices were duly sent and posted, and a public hearing was held before the Planning Commission on March 6, 2003, at which time all persons present were given an opportunity to be heard; and WHEREAS, the Planning Commission, at their March 6,2003, meeting, recommended approval of the rezoning request; and WHEREAS, the City Council heard the matter at its meeting of March 18, 2003, and found that the proposed rezoning is consistent with the Comprehensive Plan for the area of the City within which it is located. THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section I - That the zoning map adopted in City Code Sec. 11.03 is hereby amended by rezoning the property referenced herein, from Agricultural Preservation (AG) Zone to Rural Residential (RR) Zone and Urban Residential (R-lB) Zone (the South 911.61 feet of the East 512.53 feet of the Southwest Quarter of the Southeast Quarter of Section 18, Township 115, Range 22, Scott County, Minnesota is rezoned to RR, and the balance of the entire site is rezoned R-lB). Section 2 - Effective Date. This ordinance becomes effective from and after its passage and publication. Cuddiga.n has submitted an application for rezoning of property from Agricultural Preservation (AG) to Urban Residential (R-IB) and Rural Residential (RR) Zones. The property is located at the northwest corner of County Road 78 and County State Aid Highway 17 (see Exhibit A). The applicant had asked the Commission to table this item to a future date, which they did at their January 9, 2003 meeting. The applicant has now asked that this item be brought back before the Commission for review. The applicant is asking for a rezoning of the Marschall Farm site to RR Zone for a 10 acre parcel located on the southeast portion of the property, with the balance (approximately 30 acres) to be designated R-1B Zone (see Exhibit B). If approved, the applicant will proceed with a preliminary plat for the R-1B portion ofthe property (Exhibit C). The City's Comprehensive Plan sets basic policies to guide the development of the City. The purpose of designating different areas for residential, conunercial, and industrial land uses is to promote the location of compatible land uses, as well as to prevent incompatible land uses from being located in close proximity to one another. The Zoning Ordinance is one of the legal means by which the City implements the Comprehensive Plan. Under Minnesota statute, zoning is to conform with a city's comprehensi..ve plan. The proposed rezoning is consistent with the adopted land use plan. Refer to Section 11.22 (Agricultural Preservation Zone), Section 11.24 (Rural Preservation Zone) and Section 11.28 (Urban Residential Zone) for a listing of the uses, both permitted and conditional, that are allowed in these zones. Copies of the land use plans and the Zoning Ordinance are available for viewing at City Hall and will be made available at the March 6, 2003 meeting. Staff has received COlmnents from Shakopee Public Utilities (SPUC), Scott County Engineering and Scott County Environmental Health, and have attached those comments to this staff report (Exhibits D, E, & F, respectively). SPUC commented that there are no facilities in place to provide city water above the 920' elevation as the property is bisected by a water pressure zone boundaly. It was recOlmnended that the developer contact them for specific details. Scott County Engineering provided comments that included requirements for required right-of-way widths, street access locations, tuming lane requirements and buffering from 17 & 78. City Planning and Engineering staff have reviewed the conceptual plan with the developer and have suggested several changes which the developer will address in the preliminary plat, ifthe rezoning is approved. FINDINGS: The criteria required for the granting of a Zoning Ordinance Amendment are listed below with proposed findings for the Commission's consideration. Criteria #1 That the original Zoning Ordinance is in error; Finding #1 The original zoning ordinance is not in error. Criteria #2 That significant changes in community goals and policies have taken place; Finding #2 The applicant is proposing a development consistent with the adopted Comprehensive Plan. Criteria #3 That significant changes in City-wide or neighborhood development patterns have occurred; or Finding #3 Development of the subject property for residential use will be consistent with desired development patterns for this area of the City. Criteria #4 That the comprehensive plan requires a different provision. Finding #4 The requested zoning is consistent with the adopted Comprehensive Plan land use map. ALTERNATIVES: 1. RecOlllinend to the City Council the approval of the request to rezone the subject property, from Agricultural Preservation (AG) to Rural Residential (RR) and Urban Residential (R- IB) Zones. 2. CSAH 17 and CSAH 78 Dear Mark: We have reviewed the concept plan and although it is our understanding that they have not proceeded any further with this project, we would like to work closely with the City in addressing the following issues when the developer does proceed. + A minimum of75 feet from centerline shall be dedicated for CSAH 78 and CSAH 17 right-of-way. + The requested right-of-way only represents the needs for any future road expansion. AllY regional trail consideration may require additional right-of-way or a change in the existing easement location. We feel the County, City, and Three Rivers Park District should meet to discuss the trail issue before any application for preliminary plat. . The proposed street access to CSAH 78 is not in a desirable location. We recommend the street access be relocated across from the existing driveway on the south side of CSAH 78 just east of where the road is currently proposed. This location will allow for improved site distance at the intersection and serve as a better street location on the south side of CSAR 78 in the future. . The lots along CSAR 78 and CSAH 17 of the development do not provide any buffering between the highways and the residential lots. Noise and highway light issues may arise from this development without a screening plan. W~ encourage the City and developer to develop a plan to address these issues. We are willing to work closely with you on developing a plan. . A right turn lane and left turn lane will be required on CSAR 78 at the intersection of the proposed road.
