CONSIDERATIONS
Homes By Chase has made application for final plat approval of Wynd am Ponds 2nd Addition.
The proposed development is located south of 17th Avenue and north of Valley View Road
(Exhibit A). The development, as proposed, would consist of 39 single family residential lots
(Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat.
Shakopee Public Utilities has commented that it is in the process of reviewing the UG Electric
Charge, Trunk Water Charge, and Water Connection Charge policies. Possible increases will
apply to all projects retroactive to January 1,2003.
ALTERNATIVES
1. Approve Resolution No. 5857, approving the Final Plat of Wynd am Ponds 2nd
Addition subject to the conditions presented.
2. Approve Resolution No. 5857, subject to revised conditions.
3. Do not approve the final plat and direct staff to prepare a resolution consistent with the
direction of the Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approval of Resolution No. 5857, approving the Final
Plat of Wynd am Ponds 2nd Addition.
ACTION REQUESTED
Offer a motion approving Resolution No. 5857, approving the Final Plat of Wynd am Ponds
2nd Addition, and move its approval.

RESOLUTION NO. 5857
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF WYNDAM PONDS 2ND ADDITION
WHEREAS, , Homes By Chase, applicant and Calben Corp., MBC Corp., and
Mattamy Partnership ,property owners, have made application for final plat approval of
Wyndam Ponds 2nd Addition; and
WHEREAS, the subject property is legally described as:
Outlot A, Wyndam Ponds rt Addition, according to the recorded plat thereof, Scott County,
Minnesota; and
WHEREAS, the Planning Commission recommended approval of the proposed
preliminary plat with conditions; and
WHEREAS, on March 18, 2003 the City Council reviewed the proposed final plat,
and found it to be generally consistent with the approved preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that final plat of Wynd am Ponds 2nd Addition is hereby approved
subject to the following conditions;
I. Sidewalks shall be constructed along Wyndham Drive from 18th Avenue to Thrush
Street.
II. Temporary street signs are required.
III. The submitted preliminary grading, preliminary plat and preliminary street and
utility plans have separated the street and utility plan view sheet from the profile
view sheets. The applicants engineer needs to combine street and utility plan and
profiles. Also, the street and utility profile sheets, as submitted, do not show
watermain. Watermain will have to be incorporated in the plan and profile sheets.
IV. No site grading will be allowed until Preliminary plan and profile sheets for street
and utilities have been submitted and approved by the City Engineer.
V. Additional storm water calculations will need to be submitted before any grading
is allowed. These calculations shall include but are not limited to, the 100 year 10
day snowmelt event (7.2").
VI. Prior to construction, surveyor's bench loop notes shall be submitted showing the
benchmark elevations used for this site have been established using the City of
Shakopee's approved bench mark system.
VII. With the final plat, a final determination on the size and extension of sanitary
sewer to property for future development( s) to the southeast and east of this
development needs to take place between the applicant or the applicants engineer
and the City of Shako pee's Engineering Dept.
VIII. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developers Agreement with provisions for Plan A and Plan
B improvements, as well as payment of engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, security for the
public improvements, engineering review fees, and other fees as
required by the most current City of Shakopee adopted Fee
Schedule.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve the
Final Construction Plans and Specifications.
7. Park dedication requirements shall be met through cash dedication.
Park dedication fees shall be paid at the time of recording of the
final plat in an amount consistent with the adopted fee schedule in
place at that time.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. The easement along the westerly side of Lot 18, Block 3 shall be increased
to 10 feet.
E. The developer shall provide electronic AutoCAD files of the Final Plat to
the Engineering Department.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
