Valley View Road Condemnation Awards for Right-of-Way Project 2001-5 15 · c. ~ CITY OF SHAKOPEE CONSENT Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Approval of Payments from the Award of Commissioners on Condemnation Acquisition for Valley View Road, Project No. 2001-5 DATE: April 1, 2003 INTRODUCTION: Attached to this memo are the notice of filing of award from commissioners for the condemnation hearings for right-of-way acquisition associated with Valley View Road improvement, Project No. 2001-5. The purpose of this agenda item is for City Council to approve the payments of award to the property owners and accept the filing of commissioner's award. BACKGROUND: Associated with the Sarazin Street and Valley View Road improvement project, a number of easements were needed to construct the road and utilities. The City did enter into eminent domain proceedings by filing a petition of condemnation on April 26, 2002, and did provide a "quick take" on parcels that were needed on this project on July 24, 2002. The following property owners and parcel numbers and file compensation were determined by condemnation commissioners and attached as follows: Property Owner Parcel No. Amount Robert W. Berg and Gail S. Berg 9 $2,949.00 Jesse J. Kahnke and Dawn R. Kahnke 14 $5,032.00 * William G. Schmitz 16 $ 442.00 Terry L. Hauer and Kitty S. Hauer 17 $4,122.00 * * In addition the City shall reimburse the property owner for appraisal fees in the amount not-to-exceed $500.00. The City has made previous payments for right-of-way acquisition associated with the "quick take" just compensation for these parcels as follows: Name Parcel No. Amount Robert W. Berg and Gail S. Hauer 17 $1,510.00 The City has the right to appeal to the District Court the commissioner's report and their determination of award. However, the City Attorney's recommendation is that the amount of the award increase is not worth the potential additional expense by going to Court. The recommendation is to accept the commissioner's award and authorize payment to the property owners in the amount of award minus previous payments made. ALTERNATIVES: 1. Approve a motion authorizing the payments from the award of commissioners on the condemnation hearings to the property owners on Parcel No.'s 9, 14, 16 and 17 on Right-of-Way Plat No.1 in the City of Shakopee, minus any previous payments made to the property owners for right-of-way acquisition. 2. Do not approve payment based on the commissioner's award, however, appeal the commissioner's decision to the District Court. 3. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1, as the additional increased costs is not enough to warrant to going to District Court and the additional costs associated with that action. The City has made previous payments, and the filing of commissioner's award does spell out the payments due to the property owners for property acquisition and any additional reimbursement costs such as appraisal fees.
