CONSIDERATIONS
Associated Capital Corp. has made application for final plat approval of Ae.e. Second
Addition. The proposed development is located south of the Westchester development and
west of cSAH 17 (Exhibit A). The development, as proposed, would consist of 72 single
family residential lots (Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat.
Shakopee Public Utilities has commented that it is in the process of reviewing the UG Electric
Charge, Trunk Water Charge, and Water Connection Charge policies. Possible increases will
apply to all projects retroactive to January 1, 2003.
The Natural Resources Director has commented that a legal description ofthe conservation
easement area must be submitted and that the City Attorney is drafting a conservation
easement agreement.
The preliminary plat had originally included several outlots, which staff recommended be
included with the residential lots. Ultimately, the preliminary plat was approved allowing the
outlots to be included in the plat separate from the residential lots. The developer has opted to
include the outlots into the residential lots. The Final Plat has been revised to include this
change.
Scott County Highway Department has provided comments (attached as Exhibit C) which the
City has responded to (Exhibit D).
ALTERNATIVES
1. Approve Resolution No. 5875, approving the Final Plat of Ae.e. Second Addition
subject to the conditions presented.
2. Approve Resolution No. 5875, subject to revised conditions.
3. Do not approve the final plat and direct staffto prepare a resolution consistent with the
direction of the Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No. I, approval of Resolution No. 5875, approving the Final
Plat of AC.e. Second Addition.
ACTION REQUESTED

RESOLUTION NO. 5875
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF A.CoCo SECOND ADDITION
WHEREAS, , Associated Capital Corp., applicant and property owner, has made
application for fmal plat approval of AC.C. Second Addition; and
WHEREAS, the subject property is legally described as:
Outlot B, A. C. C. Addition, Scott County, Minnesota; and Outlot A, Beckrich Park Estates, Scott
County, Minnesota; and the Northeast Quarter of the Southwest Quarter of Section 18,
Township 115, Range 22, Scott County, Minnesota; and That part of the Northwest Quarter of
the Southeast Quarter of Section 18, Township 115, Range 22, Scott County, Minnesota,
described as follows: Beginning at the southeast corner of the Northwest Quarter of the
Southeast Quarter of said Section 18; thence North 02 degrees 29 minutes 12 seconds West, an
assumed bearing along the east line of the Northwest Quarter of the Southeast Quarter, a
distance of 515.00 feet; thence South 87 degrees 57 minutes 11 seconds West, a distance of 66.27
feet; thence North 88 degrees 10 minutes 08 seconds West, a distance of 133.34 feet; thence
North 74 degrees 15 minutes 32 seconds West, a distance of 473.47 feet; thence North 86
degrees 14 minutes 29 seconds West, a distance of 344.86 feet thence North 02 degrees 17
minutes 22 seconds West a distance of 135.00 feet, to its intersection with a line lying 460.05
feet southerly and parallel with the north line of the Northwest Quarter of the Southeast Quarter,
thence South 87 degrees 35 minutes 58 seconds West, along said line a distance of 340.00 feet
more or less to the west line of said Northwest Quarter of the Southeast Quarter; thence South 2
degrees 17 minutes 22 seconds East, along said West line of the Northwest Quarter of the
Southeast Quarter, to the south line of said Northwest Quarter of the Southeast Quarter, thence
Easterly along said south line to the point of beginning; and
WHEREAS, the Planning Commission recommended approval ofthe proposed
preliminary plat with conditions; and
WHEREAS, on April I , 2003 the City Council reviewed the proposed final plat, and
found it to be generally consistent with the approved preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that final plat of AC.C. Second Addition is hereby approved subject to
the following conditions;
10 The following procedural actions must be completed prior to the recording of
the final plat:
A Approval of title by the City Attorney.
B. Execution of a Developers Agreement which shall include provisions for
payment of engineering review fees, and any other fees as required by the
City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems in
accordance with the requirements of the Design Criteria and
Standard Specifications of the City of Shakopee.
5. The developer shall be responsible for payment of engineering
review fees, trunk storm sewer and sanitary sewer charges and other
fees as required by the City's most current adopted Fee Schedule.
6. Park Dedication fees shall apply to this plat in an amount consistent
with the adopted fee schedule in place at the time of recording and
shall be paid at the time of recording of the final plat, unless the
applicant requests in writing that they be deferred to the time of
building permit. If deferred, the fees due will be in an amount
consistent with the adopted fee schedule in place at the time of
building permit issuance.
7. A conservation easement shall be granted for the creek corridor.
8. A trail shall be constructed along the west side of Evergreen Lane
to the southern boundary of the development.
C. Final Construction Plans and Specifications must conform to City
requirements and are subject to approval by City Engineer. Said plans
shall include provisions for the extension of sanitary sewer and water to
Lots 6 through 10, Block 1, Hillwood Estates. Such plans as they relate to
water or electricity are subject to the approval of the SPUC Utilities
Manager.
D. Temporary street signs must be displayed.
E. No site grading will be allowed until preliminary plan and profile sheets for
street and utility work are approved by the City Engineer.
F. Shall provide electronic AutoCAD files of the final plat to the Engineering
Department.
G. A tree preservation plan consistent with the request of the EAC shall be
submitted.
1. Submit a Tree PreservationlReforestation Plan prior to issuance of the
grading permit.
2. The plan should identify all trees proposed for removal 6 inches in
diameter or greater at six feet above ground. (It doesn't matter what kind of
tree. Diseased trees and damaged trees by "acts of God" would not have to
be replaced.)
3. Reforestation means replacing healthy trees subject for removal- one for
one. The City's tree landscaping requirements can be applied to
reforestation.
4. The plan must show where the protective fencing will be placed for trees
being saved. The edge of woodlands and conservation easements should be
staked.
5. No grading permit shall be issued until the developer has the protective
fencing in place (consistent with the plan) and inspected and approved by
City staff.
6. The developer shall work with the Natural Resources Director to meet
the requirements of the woodland regulations.
H. The survey data (length and bearings) of the plat boundaries shall be
verified.
I. Easements must be shown on the final plat as approved by the City
Engineer.
J. In addition to the stormwater calculations submitted, a drainage map shall
be submitted. This information will need to be reviewed before
construction is allowed.
K. Prior to construction, surveyors bench loop notes shall be submitted
showing the benchmarks for this site have been established using the City
of Shakopee approved benchmark system.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. Further development to the south will not be permitted without a second access
to the development project.

Dear Julie:
We have reviewed the final plat and it appears a number of issues that we raised in our preliminary plat review were
not addressed with this final plat application. All comments that were submitted with the preliminary plat still
apply. The following are a couple issues that were not addressed from the preliminary plat.
. We had requested 75 feet from centerline along CSAH 17 for right-of-way dedication. The final plat does not
reflect this. Before the plat can be recorded, the right-of-way dedication should show the 75 feet from
centerline.
. We support the proposed interconnectivity between this proposal and the Beckrich Park Estates Development.
However, this proposal will have an impact on the existing Barrington Drive intersections with the County
Roadway system. Therefore, we recommend a right turn and bypass lane to be installed on CSAH 78 at
Barrington Drive as part of this development. We also recommend a right turn lane at CR 79 and Barrington
Drive.
. Hillwood Drive is an existing cul-de-sac off of CR 79. Again, we support road interconnectivity between
neighborhoods. We recommend that this development plan for Hillwood Drive to become a possible thru road
in the future.
. Has it been determined where construction vehicles will be accessing the site?
We are willing to meet with the City to further discuss our concerns with the project. Until we know the City's
response to these issues, we do not recommend approval of the final plat. Thank you for the opportunity to

Dear Craig:
The City has received your comments on the final plat of ACC 2nd Addition and has the
following responses to provide.
County comment:
We had requested 75 feet from centerline along CSAH 17 for right-of-way dedication.
The final plat does not reflect this. Before the plat can be recorded, the right-of-way
dedication should show the 75 feet from centerline.
City response:
The City aclmowledges the County's request. Because it is clear that this area of the plat
will require either a completely new preliminary plat, or at a minimum a revised
preliminary plat, that would include the two exception areas. At that time, the City can
best work with the developer to have the 75 feet ofright-of-way dedicated all along
CSAH 17.
County comment:
We support the proposed interconnectivity between this proposal and the Beckrich Park
Estates development. However, this proposal will have an impact on the existing
Barrington Drive intersections with the County Roadway system. Therefore, we
recommend a right turn and bypass lane to be installed on CSAH 78 at Barrington Drive
as part of this development. We also recommend a right turn lane at CR 79 and
Barrington Drive.
City response:
City staff has conferred with the City Attorney on this matter, and he has confirmed
staff's understanding, i.e. that because the proposed improvements are outside the
boundaries of th is plat, there is not a mechanism for requiring these improvements as a
part of this plat. In addition, this area of Shakopee has been guided for development

consistent with the proposed plat for a significant period of time. This guiding would
have allowed the County the necessary time to determine what improvements, if any,
would be required uponfull development of the area. Based on thefinal plat submitted,
the ADT expected from the development is less than 700. The City has not been provided
with any documentation that this level of ADT would provide impact at a level sufficient
to require the improvements suggesied.
County comment:
Hillwood Drive is an existing cul-de-sac off of CR 79. Again, we support road
interconnectivity between neighborhoods. We recommend that this development plan for
Hillwood Drive to become a possible thru road in the future.
City response:
Hillwood Drive provides access to an existing development that has been completely
developed with single family residences, and its connection to the proposed plat would
require acquiring additional right-ofway from 2 existing singlejamily properties.
County comment:
Has it been determined where construction vehicles will be accessing the site?
City response:
Construction vehicle access will be allowed per the City Engineer's comment and review
of plans. It is suggested that either Bruce Loney or Scott Smith be contacted for further
information about construction access.
