Cox, City Clerk SUBJECT: Premises Permit - Minnesota Jaycees Charitable Foundation DATE: April 10, 2003 INTRODUCTION AND BACKGROUND: The Minnesota Jaycees Charitable Foundation is making application to obtain a premises permit in order to sell pull tabs at Silvers Cue Club, 1141 Canterbury Road. The permit will ultimately be issued by the State Gambling Control Board. When application is made, the Board requires that the local unit of government pass a resolution specifically approving or denying the application. The applicant has been advised of the City's requirement that each licensed organization conducting lawful gambling within the City shall expend 75% of its expenditures for lawful purposes on lawful purposes conducted or located within the city's trade area. Alllicensed organizations are required to submit monthly reports to the City so this requirement can be monitored. The trade area for the City of Shakopee includes the municipalities that are contiguous to the City of Shakopee. AL TERNA TIVES: 1. Approve the application 2. Deny the application 3. Table for additional information RECOMMENDED ACTION: A] Offer Resolution No. 5877, A Resolution of the City of Shako pee, Minnesota, Approving Premises Permit for the Minnesota Jaycees Charitable Foundation, and move its adoption. OR B] If Council adopts Ordinance No. 661, limiting premises permits to on-sale intoxicating liquor establishments, direct staff to prepare a resolution denying the premises permit for the Minnesota Jaycess Charitable Foundation. JSC/js I:LicenseslPremisesMinnJCs RESOLUTION NO. 5877 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING PREMISES PERMIT FOR THE MINNESOTA JAYCEES CHARITABLE FOUNDATION WHEREAS, the 1990 legislature adopted a law which requires municipal approval in order for the Gambling Control Board to issue or renew premises permits; and WHEREAS, the Minnesota Jaycees Charitable Foundation is seeking a Premises Permit for the site at Silvers Cue Club, 1141 Canterbury Road, Shakopee, Minnesota. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, AS FOLLOWS: That the Premises Permit for the Minnesota Jaycees Charitable Foundation at Silvers Cue Club, 1141 Canterbury Road, Shakopee, Minnesota, be approved. Adopted in adj. regular session of the City Council of the City of Shako pee, Minnesota, held this 15th day of April, 2003. Mayor of the City of Shakopee ATTEST: City Clerk
