for Extension of Preliminary Plat Approval

INTRODUCTION:
Dahlgren, Shardlow and Uban (DSU), on behalf of V alley Green have submitted a request to extend
the period of approval of this preliminary plat for two additional years, i.e. until June 5, 2005.
Attached for the Council's information is a copy of the reduction of the approved preliminary plat.
Council will remember that at the time of the preliminary plat approval, the plat contemplated
business park development on the majority ofthe site and commercial development adjacent to
CSAH 83.
ALTERNATIVES:
1. Offer and pass a motion extending the approval period for the preliminary plat of Valley Green
Corporate Center 18t Addition to June 5, 2005.
2. Do not grant the requested extension.
3. Table the matter for additional information.
STAFF RECOMMENDATION:
Staff recommends alternative No.1.
ACTION REQUESTED:
Offer and pass a motion extending the approval period for the preliminary plat of Valley Green

Honorable Mayor and Council Members:
On behalf of Valley Green Business Park Limited Partnership we are writing to request an
extension of the preliminary plat approval for Valley Green Corporate Center 1 st Addition. . The
preliminary plat was approved by the Shakopee City Council by Resolution 5539 on June 5,
2001, on recommendation from the Planning Commission on March 8, 2001.
Section 12.10 of the City's Subdivision Regulations (see attached) governs the approval period
and extensions for plat approval by the City, providing for an approval period of two years for a
preliminary plat.. The approval for Valley Green Corporate Center 1 st Addition runs until June 5,
2003. Weare requesting an extension of the preliminary plat approval for an additional two
years, until June 5, 2005.
The reason for our request is that the property has been the subject of an extended and
complex approval process for the Valley Green Corporate Center project proposed by Ryan
Companies, which has an option to purchase the property. After the Valley Green Corporate
Center 1 st Addition plat was approved and Ryan Companies entered the picture, we believed
the original two-year approval period would be more than sufficient to allow Ryan's project to be
heard and approved or denied. The Ryan project has experienced delays and has undergone
revisions responding to community requests and changing market conditions. It is clear that we
cannot expect complete City review and approval by June 5, 2003. An extension of the
underlying plat approval is therefore reasonable under the circumstances.
Please schedule our request before the City Council at your earliest convenience.

SEC. 12.10. EFFECT OF PRELIMINARY AND FINAL APPROVAl.
Subd. 1. Approval Period. City Council's approval of a preliminary plat shall remain in effect for a
period two (2) years from the date of approval. City Council's approval of a final plat shall remain in
effect for a period of two (2) years from the date of approval. Prior to recording of a plat, the
Developer may withdraw the plat, in which case City Council's approval of the plat is void.
Subd. 2. Extension of Approval. Upon request by the Developer, the City Council may extend the
approval period for a preliminary of final plat, subject to all applicable performance conditions and
requirements. A request for an extension of approval must be filed on or before the expiration date
of the preliminary or final plat. If the approval period has expired, the City Council may require a new
submittal unless substantial physical activity or investment has occurred in reasonable reliance on
the approved plat and the Developer wiil suffer substantial financial damage as a consequence of a
requirement to submit a new submittal.
Subd. 3.Aut~matic Extension for Preliminatrv Plats. The approval period fOla preliminary plat
shall be automatically extended for an additional twelve (12) months each time the City Council
approves a final plat for any portion of the land included in the preliminary plat.
Subd. 4. Riahts Durina Approval Period. During the approval period set forth in Subdivision 1
. above, unless the Developer and the City. Council agree otherwise, no amendment to .a
comprehensive plan or other ordinance shall apply to or affect the use, development density, lot size,
lot layout, or dedication or platting required or permitted by the approved plat.
