The Engineering department has provided comments that have been attached for the Council's information. ALTERNATIVES: 1. Approve Resolution No. 5887, approving the Final Plat of Whispering Oaks subject to the conditions presented. 2. Approve Resolution No.5887, subject to revised conditions, 3. Do not approve the final plat and direct staffto prepare a resolution consistent with the direction of the Council. 4, Table the matter and request additional information from staff and/or the applicant. STAFF RECOMMENDATION: , Staff recommends Alternative No.1, approval of Resolution No. 5887, approving the Final Plat of Whispering Oaks. Michael Leek Community Development Director - 2 - G: \CC\2003\05 -06\FPWhisperingOaks.doc CONSENT RESOLUTION NO. 5887 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF WHISPERING OAKS WHEREAS, Tollefson Development, mc., applicant and property owner, has made application for final plat approval of Whispering Oaks; and WHEREAS, the subject property is legally described as: WHEREAS, the Planning Commission recommended approval of the proposed preliminary plat with conditions; and WHEREAS, on May 6, 2003 the City Council reviewed the proposed final plat, and found it to be generally consistent with the approved preliminary plat. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that final plat of Whispering Oaks is hereby approved subject to the following conditions; I. The following procedural actions must be completed prior to, or at the time of the recording of the final plat: A. Approval of title by the City Attorney, B. Deletion of the Planning Commission signature block. C. Execution of a Developers Agreement which shall include provisions for security for public improvements within the Final Plat, the payment of engineering review fees, and any other fees as required by the City's adopted fee schedule. D. Payment of Trunk Sanitary Sewer Charges and Trunk Storm Sewer Charges shall be made, as required by the most current City of Shakopee Fee Schedule. E. Park Dedication shall be accepted in the form of 8.75 acres ofland. F. Record a deed restriction, in a form acceptable to the City Attorney, to allow access for utilities maintenance purposes on the following lots; Lots 1,2,3,4,5,20,21,25,26,35 & 36, Block 1 Lots 4 & 5, Block 2 Lots 6, 7,8, 12, 13, 17, 18,22 & 23, Block 3 Lots 1,2, 14, 15, 19 & 20, Block 4 Lots 3, 4,5, l4, 17, 18 & 19, Block 6 - 3 - G: \CC\2003\05 -06\FPWhisperingOaks.doc CONSENT II. Following approval and recording of the final plat the following conditions shall . apply; A. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utilities Commission Utilities Manager approve the Final Construction Plans and Specifications. B. Houses on lots immediately adjoining the CSAH 18 right-of-way shall be equipped with STC 30-rated windows. In addition to the installation of STC- 30 rated windows, the developer shall construct a sound mitigation fence along CSAH 18 for those lots immediately adjacent to CSAH 18 south of Horizon Drive. The applicant should provide the City with details ofthe planned sound fence prior to application for building permits for the affected lots. C, Responsibility for other noise mitigation measures that may be required in the future shall rest with the developer or its assigns, D. Distinctive and informative Conservation Easement Markers will be developed with City staff, and installed at the conservation easement areas and relevant property lines at the time of building permit issuance. E. The Shakopee Public Utilities Commission/City of Savage water services agreement and the City of Savage/City of Shakopee sanitary sewer service agreement shall govern charges for sanitary sewer service and water service. F. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission, G, Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. H. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. I. Installation of streets, sanitary sewer and storm sewer systems in accordance with the requirements of the Design Criteria and Standard Specifications of the City of Shakopee. J. Park and trail improvements shall be installed as recommended by the Park and Recreation Advisory Board, and as outlined below; 1. The developer shall install all trails and playground/recreation equipment in the proposed park. 2. All playground equipment and materials shall meet the Consumer Product Safety Commission's standards, the American Society for Testing Materials and general park development standards used in the Shakopee Park System. 3. Bituminous trails shall consist of at least 6 inches of Class 5 gravel with at least 2 inches of asphalt paving. 4. Ground cover in the active use areas of the park shall consist of at least 6 inches of topsoil, and a sunny seed mix of Kentucky Blue Grass and Rye Grass. K. Temporary street signs must be displayed. III. Prior to any site grading, the following actions must be completed; A. Submit the City of Shakopee Wetland Application, and receive approval of the wetland mitigation plan. - 4 - G:\CC\2003\05-06\FPWhisperingOaks.doc CONSENT B. Payment of grading fees will be required per the most current City of Shakopee Fee Schedule. C. No grading shall occur until the grading plan and storm water issues have been reviewed an approved by the City Engineer. D. Earthwork balance calculations need to be shown on the grading plan. The calculations should show the amount of import and export of the different fill materials needed to balance the site. The source of fill materials shall also be indicated on the grading plan. E, Project benchmark information is needed on the grading plan, and requires a registered land surveyor's verification. Proj ect benchmarks need to be tied to the City's approved benchmark system. A surveyor's bench loop notes will have to be submitted showing how the project benchmarks have been established. F. Additional storm drainage calculations need to be submitted including the 100- year and 1 a-day snowmelt event. G. Pond outlet rate shall not exceed 1/10th cfs per acre. H, The grading plan should be revised so that grading for ponding areas does not occur in the Scott County right-of-way. After reviewing the referenced application, I have the following comments for the applicant, and for the planning department: Site Gradin2 Grading plan has been looked at and a grading permit has been issued by Engineering. Street and Utility Plans Engineering has reviewed final construction plans and have corrections that need to be done before approval by the City of Shakopee engineer and before installation and construction of street and utilities can begin. Ponding is part of this development so no ponding fees will be required. Trunk sanitary sewer and trunk storm sewer charges are applicable to this plat.
