McQuillan, Natural Resources Director Subject: Pheasant Run Park Master Plan and Funding Date: May 6, 2003 INTRODUCTION The Shakopee City Council is asked to approve the Park Master Plan for Pheasant Run Park and to increase the budgeted amount for improvements to Pheasant Run Park from $70,000 to $85,000. BACKGROUND At its February 18, 2003 meeting, the City Council authorized staff to hire Loucks Associates to prepare a Park Master Plan and construction documents for Pheasant Run Park. A Neighborhood Park Planning Committee has been working with Loucks and Associates to develop the master plan. The attached plan is the result of several meetings with the Committee and staff Pheasant Run Park is located at Cardinal Drive and Teal Street. It is .88 acres in size or the size of fOur City Lots. The current topography of the park is more conducive for houses with walkout basements than a park. Despite the challenges, the park consultant did a marvelous job incorporating the difficulties ofthe.property to conform with the objectives ofthe Committee. Staffhas sent Request For Proposals out to four different playground distributors. The Committee will meet May 13th to evaluate and select play equipment. It is anticipated that the Committee would bring their recommendation of purchase to the May 20,2003, City Council Meeting. Base on the estimates provided to us by our consultant, the cost for landscape materials, sidewalk, retaining walls and labor might cost $27,000 and that does not include grading costs, The estimated cost of playground equipment and auxiliary materials is about $49,000. The City has budgeted $70,000 for the project. Staff recommends that Council increase the budgeted amount for improvements to Pheasant Run Park from $70,000 to $85,000 to insure completion of the project. Staff will be obtaining price quotes for all concrete and landscaping work as well, Funding for this project is from the Park Reserve Fund. The current fund balance of the Park Reserve Fund is $2.1 million. In 2003, the Park Reserve Fund is funding Soccer Facility Improvements at $660,000 and Land Acquisition at $1 million. RECOMMENDATIONS At its Apri128, 2003 meeting, the Parks and Recreation Advisory board recommended the City Council approve the Park Master Plan for Pheasant Run Park. Staff recommends increasing the budgeted amount for improvements to Pheasant Run Park from $70,000 to $85,000. ACTION REOUESTED Move to approve the Park Master Plan for Pheasant Run Park and increase the budgeted amount for improvements to Pheasant Run Park from $70,000 to $85,000 with funding from the Park Reserve Fund. ~ ~ Mark J. Michael Leek, Community Development Director SUBJECT: Final Plat of Whispering Oaks MEETING DATE: May 6, 2003 REVIEW PERIOD: March 27,2003 - May 26,2003 INTRODUCTION: Scott County Highway Department submitted additional comments on March 6, 2003 requesting additional conditions of approval of this preliminary plat. These have been added to the draft resolution attached to this report (see underlining). ALTERNATIVES: 1. Approve Resolution No. 5887 as revised for the table, approving the Final Plat of Whispering Oaks subject to the conditions presented. 2. Approve Resolution No,5887, subject to revised conditions. 3. Do not approve the final plat and direct staffto prepare a resolution consistent with the direction of the Council. 4. Table the matter and request additional information from staff and/or the applicant. STAFF RECOMMENDATION: Staff recommends Alternative No.1, approval of Resolution No. 5887 as revised for the table, approving the Final Plat of Whispering Oaks. ACTION REQUESTED: Offer a motion approving Resolution No.5887 as revised for the table, approving the Final Plat of Whispering Oaks, and move its approval. 4~~ R. Michael Leek Community Development Director MEMORANDUM AND RESOLUTION FOR THE TABLE 14.A.l RESOLUTION NO. 5887 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE FINAL PLAT OF WHISPERING OAKS WHEREAS, Tollefson Development, Inc., applicant and property owner, has made application for final plat approval of Whispering Oaks; and WHEREAS, the subject property is legally described as: WHEREAS, the Planning Commission recommended approval of the proposed preliminary plat with conditions; and WHEREAS, on May 6, 2003 the City Council reviewed the proposed final plat, and found it to be generally consistent with the approved preliminary plat. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that final plat of Whispering Oaks is hereby approved subject to the following conditions; 1. The following procedural actions must be completed prior to, or at the time of the recording ofthe final plat: A. Approval of title by the City Attorney, B. Deletion of the Planning Commission signature block. C. Execution of a Developers Agreement which shall include provisions for security for public improvements within the Final Plat; the payment of engineering review fees and any other fees as required by the City's adopted fee schedule; and a cost participation agreement between the applicant/developer. Scott County, and the City of Shakopee for the closure of full access at Whispering Oaks Trail and CSAH 18, MEMORANDUM AND RESOLUTION FOR THE TABLE 14.A.l D. Grant and record a "sight distance easement" to Scott County from Whis-pering Oaks Trail to 700 feet south of the intersection of Whispering Oaks Trail and CSAH 18. E. Payment of Trunk Sanitary Sewer Charges and Trunk Storm Sewer Charges shall be made, as required by the most current City of Shakopee Fee Schedule. F, Park Dedication shall be accepted in the form of8.75 acres ofland. G. Record a deed restriction, in a form acceptable to the City Attorney, to allow access for utilities maintenance purposes on the following lots; Lots 1,2,3,4,5,20,21,25,26,35 & 36, Block 1 Lots 4 & 5, Block 2 Lots 6, 7, 8, l2, 13, 17, 18,22 & 23, Block 3 Lots l, 2, 14, 15, 19 & 20, Block 4 Lots 3, 4, 5, 14, 17, 18 & 19, Block 6 II. Following approval and recording of the final plat the following conditions shall apply; A. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utilities Commission Utilities Manager approve the Final Construction Plans and Specifications. B, Houses on lots immediately adjoining the CSAH 18 right-of-way shall be equipped with STC 3D-rated windows. In addition to the installation of STC-30 rated windows, the developer shall construct a sound mitigation fence along CSAH 18 for those lots immediately adjacent to CSAH 18 south of Horizon Drive, The applicant should provide the City with details of the planned sound fence prior to application for building permits for the affected lots. C. Responsibility for other noise mitigation measures that may be required in the future shall rest with the developer or its assigns. D. Distinctive and informative Conservation Easement Markers will be developed with City staff, and installed at the conservation easement areas and relevant property lines at the time of building permit issuance, E. The Shakopee Public Utilities Commission/City of Savage water services agreement and the City of Savage/City of Shakopee sanitary sewer service agreement shall govern charges for sanitary sewer service and water servIce. F. Street lighting to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. G, Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. H, Water system to be installed in accordance with the requirements ofthe Shakopee Public Utilities Commission, MEMORANDUM AND RESOLUTION FOR THE TABLE 14.A.l 1. Installation of streets, sanitary sewer and storm sewer systems in accordance with the requirements ofthe Design Criteria and Standard Specifications of the City of Shakopee, J. Park and trail improvements shall be installed as recommended by the Park and Recreation Advisory Board, and as outlined below; 1. The developer shall install all trails and playground/recreation equipment in the proposed park. 2. All playground equipment and materials shall meet the Consumer Product Safety Commission's standards, the American Society for Testing Materials and general park development standards used in the Shakopee Park System. 3. Bituminous trails shall consist of at least 6 inches of Class 5 gravel with at least 2 inches of asphalt paving. 4. Ground cover in the active use areas of the park shall consist of at least 6 inches oftopsoil, and a sunny seed mix of Kentucky Blue Grass and Rye Grass. K. Temporary street signs must be displayed. III. Prior to any site grading, the following actions must be completed; A. Submit the City of Shakopee Wetland Application, and receive approval of the wetland mitigation plan. B. Payment of grading fees will be required per the most current City of Shakopee Fee Schedule. C. No grading shall occur until the grading plan and storm water issues have been reviewed an approved by the City Engineer, D. Earthwork balance calculations need to be shown on the grading plan, The calculations should show the amount of import and export of the different fill materials needed to balance the site. The source of fill materials shall also be indicated on the grading plan. E. Project benchmark information is needed on the grading plan, and requires a registered land surveyor's verification. Project benchmarks need to be tied to the City's approved benchmark system. A surveyor's bench loop notes will have to be submitted showing how the project benchmarks have been established, F, Additional storm drainage calculations need to be submitted including the 100-year and 1 a-day snowmelt event. G. Pond outlet rate shall not exceed 1/10th cfs per acre, H. The grading plan should be revised so that grading for ponding areas does not occur in the Scott County right-of-way.
