INTRODUCTION:
Attached is Resolution No. 5886, a resolution ordering the improvement, plans and
specifications for Valley View Road improvements, from the east plat line of Pheasant
Run 6th Addition to the east plat line of Greenfield, Project No. 2003-4.
BACKGROUND:
On March 18, 2003, the City of Shakopee ordered the preparation of a feasibility report
for the improvement of Valley View Road, from the east plat line of Pheasant Run 6th
Addition to the east plat line of Greenfield by Resolution No. 5867.
Valley View Road is a collector street on the City's Transportation Plan. This
improvement project would be for the reconstruction of Valley View Road from a gravel
road surface to a paved road surface meeting the Transportation Plan, with sidewalk, trail,
extension of utilities and storm sewer system for drainage improvements. Currently, the
Greenfield Addition is rapidly filling with housing starts and will be completed by the
end of this year. The developer of Greenfield has indicated a willingness to pay his
assessment by signing a petition and having the project completed. The property owners
to the south are currently farming their property and would be available for Green Acre
status in regard to the assessments.
The benefits of completing this project at this time would be as follows:
. A completed paved collector street adjacent to the housing being completed in
Greenfield Addition.
. Completion of the collector street system in this area of Shakopee, which would
disperse the traffic in the area of Prairie Village, Pheasant Run and Greenfield
Additions.
The one issue for City Council to consider is the assessments on the south side of Valley
View to the properties currently being used for agricultural purposes. It is assumed that
these assessments would be placed in Green Acre status until the property redevelops in
the future. The City of Shakopee would then have to front the costs of these assessments
until the properties develop to a higher use. Per Gregg V ox land, the amount the City may
need to finance the Green Acre assessments could be $10,500.00 annually.
Also, included is an extension agreement with WSB & Associates, Inc. to perform the
design engineering services, including easement acquisition coordination at a cost not-to-
exceed $40,000.00. Right-of-way acquisition is proposed to be done by Evergreen Land
Services Company with cost in addition to WSB' s proposal.
ALTERNATIVES:
1. Adopt Resolution No. 5886, a resolution ordering the improvement and the
preparation of plans and specifications for Valley View Road, from the east plat
line of Pheasant Run 6th Addition to the east plat line of Greenfield.
2. Deny Resolution No. 5886. This action will halt the project until such time as the
City Council reconsiders the resolution.
3. Table Resolution No. 5886, to allow time for staff to prepare additional
information and/or revise the feasibility report, as directed by City Council.
4. Authorize staff to execute an extension agreement with WSB & Associates, Inc.
for survey, preparation of easements, easement acquisition and design engineering
services, as necessary for the design ofthe improvements.
RECOMMENDATION:
Staff recommends Alternative No.1 and No.4, for Council to adopt Resolution No. 5886
ordering the improvement and plans and specifications for Valley View Road, from the
east plat line of Pheasant Run 6th Addition to the east plat line of Greenfield, Project No.
2003-4. Also, for the City to execute an extension agreement with WSB & Associates,
Inc. for engineering services to design the improvements, as necessary. If the City
Council does not wish to pursue this project, then the appropriate action would be to
move the approval of Resolution No. 5886 and vote against the motion.
ACTION REQUESTED:
1. Offer Resolution No. 5886, A Resolution Ordering an Improvement and
Preparation of Plans and Specifications for Valley View Road, from the East Plat
Line of of Pheasant Run 6th Addition to the East Plat Line of Greenfield, Project
No. 2003-4 and move its adoption.
2. Authorize staff to execute an extension agreement with WSB & Associates, Inc.
for surveying, preparation of easements, easement aquisition and design
engineering services, as necessary for this project.

WHEREAS, Resolution No. 5880 adopted on April 6, 2003, fixed a date for Council
hearing on the proposed improvement of Valley View Road, from the east plat line of Pheasant Run
6th Addition to thp. p.~d pl~t lim~ of eTreenfielcl, hy installation of sanitary sewer, watermain, storm
sewer, street reconstruction, bituminous paving, curb & gutter, concrete sidewalk, bituminous trail,
street lighting and any appurtenant work; and
WHEREAS, ten days published notice of the hearing through two weekly publications of
the required notice was given and the hearing was held on the 6th day of May, 2003, at which all
persons desiring to be heard were given an opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA:
1. That the improvement is necessary, cost effective and feasible and is ordered as
hereinafter described:
Valley View Road, from the east plat line of Pheasant Run 6th Addition to the east plat line
of Greenfield by installation of sanitary sewer, watermain, storm sewer, street
reconstruction, bituminous paving, curb & gutter, concrete sidewalk, bituminous trail, street
lighting and any appurtenant work
2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this
improvement. He shall prepare plans and specifications for the making of such improvements.
3. The work ofthis project is hereby designated as part of the 2003-4 Public Improvement
Program.
4. The City Council shall let the contract for all or part of the improvements as
authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of
this resolution

Valley View Road Improvements

Dear Mr. Loney:
According to our Agreement for Professional Services within the City of Shakopee and
Section I-C-2 (Major Projects), this extension agreement is written to provide you with an
estimate of cost for engineering services for the above-referenced project. We are
proposing to complete the work as detailed on the attached scope of services, Exhibit A.
The attached work plan describes the approach and tasks proposed to be completed by
WSB. It should be noted that the work plan includes engineering design for roadway plans,
storm sewer plans, sanitary sewer plans and watermain plans.
We propose to conduct the work on an hourly basis with an estimated fee of$36,300 and a
fee not-to-exceed $40,000. We will review our progress monthly and will not exceed this
amount without your prior approval.
The services for right-of-way acquisition will be processed under separate cover by
Evergreen Land Services Company. WSB's coordination of Evergreen and the land
acquisition process is included in our costs identified herein.
It is proposed that all work under the contract would be considered complete after the
preconstruction conference. The construction management phase would be initiated after
the preconstruction conference.
We are available to begin work plan as soon as authorized by the City, and we anticipate
completing the project according to the following schedule, assuming that we receive the
notice to proceed on May 7,2003.

WORK PLAN
. Project Management - This task includes planning and coordination of all work tasks, establishment
and monitoring of budgets, and correspondence with the City of Shakopee on a periodic basis. The
project manager will provide technical direction on all aspects ofthe project, review all work products,
and prepare monthly progress reports. The project manager will serve a primary role in the many design
considerations.
. Data Collection - Available data will be collected from the City, Scott County, Mn/DOT, private utility
companies, and adjacent developers as necessary, to prepare the construction documents.
. Soils Report - Soils information will be used from the Feasibility Report.
. Construction Plan/Bidding Documents - The construction plans/bidding documents phase includes the
bulk of our effort on the project. The activities associated with this phase and included in the project fee
are as follows:
Description of the Project
As outlined in the feasibility report (prepared by WSB on April 15, 2003) this project includes the following
activities:
Roadway
Valley View Road is proposed to be constructed to a 9-ton design, 44-foot wide undivided urban roadway
with parking allowed on both sides. It is proposed to construct a 5-foot wide concrete walk on the south
side and an 8-foot wide bituminous trail on the north side of Valley View Road.
Street Lights 1 Electric Pole Relocation
There are eleven power poles that need to be moved approximately 20 feet north and street lights will be
added to meet the City's Street Lighting Policy. This work will be done by SPUC.
Sanitary Sewer
Sanitary sewer is proposed to be installed across Valley View Road at the intersection of Independence
Drive to provide service to the abutting properties to the south.
Watermain
A 12-inch watermain stub will be extended south at the intersection of Independence Drive and the 8-inch
watermain between Lots 20 and 21 of the Greenfield Addition will be extended to the south to provide
service to these parcels.
Storm Sewer
Storm sewer will be required to provide stormwater drainage for the area within the Valley View Road
right-of-way. The existing IS-inch RCP storm sewer stubs in the Greenfield Addition will be extended

south to catch basins located along the proposed curb line on Valley View Road.
Easement Acquisition
A lO-foot temporary drainage and utility easement will be required along the south right-of-way. A
permanent utility easement will be required for the proposed utility stubs.
. Final Design - This phase will include the development of bidding documents as necessary to
facilitate construction, as well as receive the necessary agency approvals. Preparation of these
documents includes, but is not limited to, the following tasks.
- Existing utilities and removal plans
- Typical sections and pavement details
- General details and construction notes
- Erosion controVlandscaping
- Construction staging and traffic control
- Roadway plans
- Storm sewer plans
- Sanitary sewer plans
- Watermain plans
- Street cross sections
- Specification
- WSB will utilize the standard City of Shakopee specification and details. Project-
specific items will be addressed in a special provision section, as well as a
supplementary general condition section.
. Permits - All necessary permits will be acquired as a part ofthe construction plan preparation. The cost
of the permits would be paid by the City of Shakopee.
. Project Bidding - Upon approval of the bidding documents by the City, WSB will distribute the
necessary number of plan sets to the City for distribution. WSB will bill the City for the expenses of the
plan printing. If requested, WSB will sell the plan sets to prospective bidders and will not refund that
deposit to the unsuccessful bidders. In this case, the City would not be billed for the plan printing.
. Construction Staking - This will be addressed at the time the project is awarded.
. Construction Management/Observation - This will be addressed at the time the project is awarded.
. Record Drawings - These will be completed on a cost-reimbursable basis upon completion of the
project.

Dear Mr. Ische:
Thank you for the opportunity to provide the WSB and the City of Shakopee with an
estimate for appraisal and acquisition services on the 4th Avenue and Valley View Road
projects. Evergreen Land Services (ELS) is sufficiently staffed to begin assistance on
this project upon approval by you.
It is my understanding that the project will consist of appraisal and partial acquisition of
land on 12 properties, for 4th Avenue and two parcels for Valley View Road. Our
proposal will be based on this assumption.
Scope of Work to be Performed:
Evergreen Land Services will perform the following tasks necessary for the appraisal
and acquisition of the 12 parcels:
. Update Owners and Encumbrance Reports as needed
. Create individual parcel files for each acquisition
. Perform Minimum Damage Assessments (MDAs) on properties with an
estimated acquisition cost of under $ 10,000
. Perform individual appraisals on properties with severance damage or with an
estimated acquisition cost of over $ 10,000. The type of appraisal will be
determined by the complexity of the acquisition. Le. narrative summary
appraisal or restricted appraisal or uncomplicated appraisal.
. Provide you with two copies of each appraisal report
. Prepare appropriate conveyance documents
. Prepare individual offer letters
. Make offers and negotiate with each of the property owners
. Provide you with updates on the acquisition process
. Provide you with a list of unsigned owners and properties should it be
necessary for the city to complete the acquisitions through the condemnation
process.
Our activities will comply with Minnesota Statute arid Uniform Act regulations and will
include all steps required in the process and additional steps as may be helpful.
Estimated Cost:
Evergreen Land Services is prepared to perform the above mentioned acquisition
items for a cost of and not to exceed $50,000 for 4th Avenue and a cost of and not to
exceed $5,000 for Valley View Road (see breakdown below). This estimate includes all
expenses such as mileage, copies, parking, recording fees. etc. Since ELS invoices
only for time spent on the project based on the attached 2003 Rate Schedule, projects
completed in less time than anticipated result in savings to the client. ELS invoices
twice monthly on services rendered.
Should condemnation be necessary, ELS can assist your legal counsel, as he or she
deems necessary for an additional fee. Please note that this estimate does not
include testimony in commissioner's hearings or court by the ELS appraiser.
Condemnation testimony and preparation is at the rate of $100 per hour.

Evergreen Land Services Company (ELS) is a Minnesota company
that has provided land and right of way acquisition, relocation assistance, and appraisal services
since 1972. Currently, we have eight full-time and four-part time employees, who have up to 40
years of individual experience in the acquisition, relocation, and appraisal fields. ELS is a
licensed Real Estate Brokerage firm and all of our agents have a Minnesota Real Estate Agents
License under Evergreen Land Services Brokerage license. Collectively, the company has
employees experienced in the areas of route selection and development, field and title research
and analysis, document and file preparation, and negotiation and relocation assistance in
compliance with local, state and federal procedural requirements.
ELS' staff is recognized for the wide variety of projects on which they have worked under the
guidelines of the Federal Uniform Relocation Assistance and Real Property Acquisition Act of
1970, as amended. We have also worked on projects under specific funding sources: HUD
Section 811, CDBG, U.S. Army Corps of Engineers. Federal Aviation Administration, Federal
Highway Administration, and Minnesota State Aid. ELS has provided acquisition, appraisal and
relocation services to more than 85 public and private entities, including Minnesota Department
of Transportation (Mn/DOT).
ELS is an approved consultant by Mn/DOT for acquisition, appraisal and relocation services.
ELS' staff consists of qualified professionals with diverse experience in land acquisition,
appraisal and relocation services, insuring the quality and cost effective implementation of each
project. Realizing that the abilities of individual professionals are paramount to our success,
ELS assembles a team that assures the client that the proper blend of experience and expertise
is provided for each project.
ELS' excellent reputation and record of accomplishments is an extension of the experience of
our qualified personnel, as well as the close working relationships established with our clients.
Our primary objectives are client satisfaction, dedication to sensible and practical project
implementation, maximizing financial participation, and meeting time and budgetary constraints.
ELS is also very sensitive to clients' respective timing and restrictive guidelines. We maintain
excellent working relationships with all staff members of regulatory and approval agencies in
order to enhance the likelihood of compliance.
ELS' experience includes not only public projects, but also includes acquisition, appraisal and
relocation services for various utilities. Our services have been supplied to Mn/DOT,
Metropolitan Council, numerous cities and counties. electric utilities, gas utilities. telephone
companies, railroads and airports.
ACQUISITION SERVICES
The acquisition process typically begins with an initial meeting with client's staff to discuss project
coordination and procedures. After receiving the appraisal of fair market value for each parcel, ELS staff
will develop an acquisition file and prepare the Just Compensation Offer to be signed by the client. ELS
then meets with each individual owner to present the offer and review the appraisal, conduct negotiations
with each property owner, and be available for questions from each owner regarding the acquisition file.
All owners receive an information booklet explaining their rights and the acquisition process.
If the owner agrees on the acquisition price, both parties execute a purchase agreement and a closing is
set up with the closing agent and the title company. If the acquisition involves easements, ELS initiates
the signing of the documents and recording at the county recorder's office. If the owner does not agree
with the offer, and after an appropriate amount of time in negotiations, the client's attorney may initiate
eminent domain proceedings with requested assistance from ELS.
ACQUISITION SERVICES INCLUDE THE FOllOWING:
:> Meet with client's staff to discuss project coordination, timing and procedures.
:> Attend any other meetings with staff as required.
:> Read appraisal and review appraisals for each parcel and discuss with appraiser and reviewer as
necessary.
:> Prepare just compensation offer letter for the client's signature on all parcels.
:> Prepare landowners information booklet for each parcel.
:> Deliver offer letter and booklet to owners and begin negotiations.
:> In negotiations, gather information and work towards resolving disagreements and disputes to get
a purchase agreement or easement signed.
:> All written and oral communication will be documented in each file.
:> Prepare purchase agreements for all files.
:> Prepare easement documents for all files.
:> Prepare a weekly report on status of negotiations.
:> Work with relocation team concerning vacancy dates and other activities.
:> Coordinate closings and recording of instruments with the title company.
:> Record easement documents.
:> Work with the client's attorney or title company on issues concerning marketable title.
=> If condemnation is necessary, provide services as directed by client's attorney.
ABILITY TO MEET SCHEDULES:
ELS has a reputation for completing projects on schedule, within budget and without loss of Federal or
State Aid Funds. ELS's ability to meet schedules is well recognized by many clients who have selected
ELS to assist with their projects.
ELS has been through the auditing process several times with Mn/DOT and the Federal Highway
Administration. An audit is necessary to receive certain funding. We have received compliments in these
audits on our files, record keeping, success in our accomplishments, and the meeting of budgets and
schedules.
ELS has found that some land acquisition and relocation projects are controversial. However, we feel an
experienced and qualified staff can do a great deal to overcome the misconceptions about the program
and the acquisition and relocation process.
RELOCATION ASSISTANCE
The project approach assists all the impacted residents and businesses, eligible for assistance
under the Federal guidelines, in relocating to adequate replacement accommodations as quickly as
possible. In addition, ELS can assure each project is performed in accordance with the Uniform
Relocation Assistance and Real Property Acquisition Act of 1970, as amended, to maximize Federal
participation. All impacted residential homeowners, tenants, and businesses will be treated in a just
manner and receive adequate compensation under the applicable guidelines.
ELS operates a cost effective and efficient program and addresses all the special needs of the
individual residential homeowner, tenant and business. We make a concerted effort to find workable
solutions to all problems related to the relocation program. We anticipate the usual range of
difficulties, together with new challenges, with each project, and have the capabilities to address all
of these issues.
RELOCATION SERVICES INCLUDE THE FOLLOWING:
:> Initial meeting with the client's staff to discuss project coordination and procedures.
:> Meeting(s) with the public and occupant(s) to discuss and provide written general information
on relocation benefits, documentation required, and the process applicable to each of their
situations.
:> Determine needs and preferences for the move and replacement location for the owner and
occupants. Explain relocation benefits, the process involved with relocation, and
documentation requirements.
:> Offer advisory services regarding the move, explanations of relocation benefits and
procedures, and other assistance as necessary.
:> Prepare the required general information, eligibility, and 90-day vacate notices for client's
review and signature.
:> Assist the displaced occupants to identify and document eligible reimbursable relocation
costs and confirm that the submitted costs are reasonable and necessary per the regulations.
:> Conduct research for comparable properties, inspect comparable properties, and provide
referrals to available replacement properties, as requested.
:> Prepare claims for relocation payment and make recommendations to the client regarding the
eligibility of relocation benefits requested by the displaced occupants.
:> Throughout the project, address questions and concerns of the displaced occupants, and
advise the occupants of their rights and obligations in the relocation process.
:> Throughout the project, review the project/relocation status and review any questions and
concerns.
:> Document and close out file once all relocation benefits are issued.
This list of tasks is not all-inclusive. Our activities comply with Minnesota Statutes and the Uniform
Act regulations and include all steps required in the process together with additional steps as may
be helpful. All written and oral communication is documented in each file and a bi-weekly status
report is updated and presented to the client.
ApPRAISAL SERVICES
Evergreen Land Services Company (ELS) now offers appraisal services to our clients. ELS has
on staff a Certified General Real Property Appraiser who has experience with the appraisal of
partial acquisitions. ELS can provide the following appraisal formats:
1. Narrative Appraisals - can be used for any type of acquisition but is typically
used for more complex acquisitions.
2. Short Form Appraisals - used for acquisitions of residential
properties, vacant land, or for partial acquisitions involving
easily supported damages to the remainder of the property.
3. Minimum Damage Assessments (MDAs) - this format is not technically an
appraisal but is a format promoted by Mn/DOT to be used for uncomplicated
acquisitions up to a value of $10,000, including simple partial acquisitions
where only land or land and minor improvements are involved.
In conjunction with the "Uniform Relocation Assistance and Real Property Acquisition Policies
Act of 1970" (commonly known as the Uniform Act), ELS offers property owners the opportunity
to accompany the appraiser on the inspection of their properties and treats the property owners
with respect.
Appraisals are prepared in conformance with the Uniform Standards of Professional Appraisal
Practice (USPAP) as well as Mn/DOT or other agency regulations.
APPRAISAL REVIEW
ELS can also provide appraisal review services. Reviews can be via form or narrative reports
depending on the client's request and the complexity of the appraisal. Review criteria include
sound appraisal principles and USPAP conformance as well as Mn/DOT or other agency
regulations.
CONSUL TATION
ELS understands the appraisal process and requirements and can provide appraisal expertise
in the form of consultation for appraisal contracting or condemnation.
Appraisal fees are dependent on the client's desired appraisal format and the complexity of the
appraisal problem, but can be via an hourly rate of $70.00 plus costs or a charge per appraisal.

Douglas (Doug) has over 23 years experience in real estate appraisal and over 15 years experience
in right of way acquisition. He was the Property Manager/Acquisition Specialist with the
Washington County Department of Transportation and Physical Development for over 15 years
before joining Evergreen Land Services. Prior to that, Doug was a staff appraiser for the Bureau of
Reclamation in Bismarck, North Dakota, and a staff appraiser for the Bureau of Land Management
in Billings, Montana. He has managed numerous highway acquisition projects including federal aid
projects and in addition to highway work has acquired land for park, jail, and library uses. Doug is
knowledgeable in appraisal, appraisal contracting, appraisal review, title research, negotiations,
condemnation, the Uniform Act, and GIS.
Doug has attained the "SR/WA" professional designation from the International Right of Way
Association (IRWA) and is a past President and Board Member of the Minnesota Chapter of the
IRWA. He teaches several IRWA appraisal courses and has been a presenter at Mn/DOT's Right of
Way Professional's Conference. His education includes a Bachelor of Science in Forest Science
