I i l.;\.\~~~~;-' :'~_~.._...._~.__'_L~ ?A, CITY OF SHAKO PEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Public Hearing for the 2003 Reconstruction, Project No. 2003-3 DATE: May 6, 2003 INTRODUCTION: As per Resolution No. 5873, a resolution receiving a report and calling for a public hearing on the 2003 Reconstruction Project No. 2003-3, a public hearing is scheduled for May 6, 2003. This agenda item is to conduct the public hearing for this proposed improvement to 4th Avenue, from Naumkeag Street to Shenandoah Drive; Viking Steel Road, from 4th Avenue to c.R. 101; and Cavanaugh Drive, from Viking Steel Road to the Union Pacific Railroad Crossing. BACKGROUND: On November 6, 2002, City Council ordered the preparation of a feasibility report for the 2003 Reconstruction Project. The report was completed and accepted by City Council on April 15, 2003. This proposed project includes the following streets: . 4th Avenue, from Naumkeag Street to Shenandoah Drive . Viking Steel Road, from 4th Avenue to C.R. 101 . Cavanaugh Drive, from Viking Steel Road to the west terminus at the Union Pacific Railroad crossing Since the acceptance of the feasibility report on April 15, 2003, staff has conducted an informational meeting on April 29, 2003 for the property owners being affected by the proposed project, and also has found errors in the proposed assessment rolls that were corrected before the information meeting. Staff has attached an amendment to the feasibility report, with the corrections to the assessment roll to show the proper names, legal descriptions and correction of assessments as found by staff. At the April 29th informational meeting, a total of eleven residents attended the meeting, with most of the attendees from the Canterbury Pointe development, and their concerns with the project were in regard to a possible berm along 4th Avenue to screen their properties, undergrounding of electric lines along 4th A venue or not and the amount of traffic and trucks along 4th Avenue. In regard to these issues received at the informational meeting, the berming on private property is something City Council can review and direct staff to consider during the design phase of the project, if the project is approved. The undergrounding of existing overhead electric lines is a policy question between the City and Shakopee Public Utilities Commission (SPUC). Finally, the traffic and truck traffic on 4th A venue is expected to increase due to the amount of industrial Mea. that ~s si~l1 und~yc1opcd, since this is a State Aid Municipal collector route, the City cannot designate no trucks on this route. It is proposed in the feasibility report to construct this road to a 9-ton State Aid Standard, which is 44 feet wide, in order to handle the traffic upon full development in this area. Other issues associated with this project can be summarized as follows: 1. Costs of the Project to the City 2. Undergrounding of Existing Overhead Power Lines 3. Assessments to Property Owners 4. Timing of the Improvements to Meet the Schedule & Right-of-Way Acquisition I Issue No.1 - Costs of the Project to the City I The main two funds that are being affected by this project is the tax levy for the reconstruction portion of 4th Avenue and the CIF/State Aid Funds for railroad crossing signal, trails and street oversizing. In the 2003 Budget and the in the Capital Improvement Program, the estimate for this project was for $600,000.00 for tax levy and $600,000.00 for CIF to be utilized. It is now estimated in the feasibility report that the tax levy is $682,050.27and the CIF/State Aid Funds to be utilized is $712,171.17. I Issue No.2 - Undergrounding of Existing Overhead Power Lines I Staff proposes to meet with SPUC on May 5, 2003 to discuss the undergrounding of existing overhead power lines and the possibility of higher assessments associated with this project. Staff may have additional information to provide City Council on May 6, 2003. The City's Right-of-Way Management Ordinance does allow the City the option to require undergrounding of the utility line if relocation is more than 300 feet. It is anticipated that the existing overhead power line along 4th Avenue and Viking Steel Road may need to be relocated. A determination from City Council may be necessary during this project to either allow the overhead lines to remain or to be relocated underground. I Issue No.3 - Assessment to Property Owners I Within the project area, particularly with Viking Steel Road improvements, from 4th Avenue to CSAH 101, the amount of the assessments to one parcel may exceed the special benefit to the property in question. City Council may want to consider a benefit appraisal for the property owned by Kelley Fuels to detennine if the assessments are supported. The reason being, for this recommendation by staff, is that any assessments that is not supported by the benefit appraisal could be shifted over to other parcels along Viking Steel Road that could support the assessment and benefit to their properties. Issue No.4 - Timing of the Improvements to meet SPUC's Schedule for the New Building and Right-oC-Way Acquisition Staff is anticipating, due to the amount of right-of-way acquisition and the project size, that the reconstruction of 4th Avenue would not be able to be completed this year and would extend into the construction season of 2004. The more realistic construction is to construct the utilities needed for the project and the pond construction with the possibility of reconstructing some of the project area before the construction season ends in 2003. The remaining portion of the project would be done in 2004, if approved by City Council. In order to obtain the right-of-way for this project, staff is recommending that a right-of- way acquisition firm be utilized and is included in the proposal from WSB & Associates, Inc. for the design in order to obtain the right-of-way in a timely fashion. If this project is approved by City Council, as described in the feasibility report, staff would request the following actions by City Council: . Approve a motion approving the amendment to the feasibility report, as attached to this memorandum. . Approve Resolution No. 5885, a resolution ordering an improvement and preparation of plans and specifications for the 2003 Reconstruction Project No. 2003-3 and move its adoption. . Approve an extension agreement with WSB & Associates, Inc. for the design of the proposed improvements and right-of-way acquisition associated with this improvement project. . Authorize staff to proceed with a benefit appraisal for the Kelley Fuel parcel. AL TERNATIVES: 1. Adopt Resolution No. 5885, a resolution ordering the improvement and the preparation of plans and specifications for the 2003 Reconstruction Project No. 2003-3. 2. Deny Resolution No. 5885. This action will halt the project until such time as the City Council reconsiders the resolution. 3. Table Resolution No. 5885, to allow time for staff to prepare additional infonnation and/or revise the feasibility report as directed by City council. 4. Modify Resolution No. 5885, to reduce the scope of the project area, as determined by City Council. 5. Authorize the appropriate City officials to execute an extension agreement with WSB & Associates, Inc. for survey, preparation of easements, acquisition of easements and design engineering services, as necessary for this project. 6. Authorize staffto proceed with a benefit appraisal for the Kelley Fuel parcel. 7. Approve a motion to approving the amendment to the feasibility report, as attached. RECOMMENDATION: If Council desires to proceed with this project, at this time, then Resolution No. 5885 needs to be adopted, a resolution ordering the improvement and the preparation of plans and specifications. Also, associated with the approval of this project, staff would recommend execution of an extension agreement with WSB & Associates, approval of the amendment to the feasibility report and authorization to prepare a benefit appraisal for the Kelley Fuel parcel. If City Council does not wish to pursue this project, then the appropriate action would be to move the approval of Resolution No. 5885 and vote against the motion. If City Council wants more information on the project and/or to amend the feasibility report, then Alternative No.3 is recommended. ACTION REQUESTED: 1. Offer Resolution No. 5885, A Resolution Ordering an Improvement and Preparation of Plans and Specifications for 2003 Reconstruction, Project No. 2003-3, and move its adoption. 2. Authorize appropriate City officials to execute an extension agreement with WSB & Associates, Inc. for surveying, preparation of easements, right-of-way acquisition and design engineering services, as necessary for this project. 3. Authorize staff to prepare a benefit appraisal for the Kelley Fuel parcel. 4. Approve a motion approving the amendment to the feasibility report, as attached in this memorandum. ~~ ruce Loney Public Works irector BUpmp MEM5885 RESOLUTION NO. 5885 A Resolution Ordering An Improvement And Preparation Of Plans And Specifications For 2003 Reconstruction Project No. 2003-3 WHEREAS, Resolution No. 5873 adopted on April 15, 2003, fixed a date for Council hearing on the proposed improvement of 4th Avenue, from Naumkeag Street to Shenandoah Drive; Viking Steel Road, from 4th Avenue to County Road 101; and Cavanaugh Drive, from Viking Steel Road to Union Pacific Railroad Crossing by installation of sanitary sewer, watermain, storm sewer, storm water pond, concrete curb & gutter, grading, aggregate base, bituminous paving, concrete sidewalk, bituminous trail, railroad crossing and warning signals, street lighting and all appurtenant work; and WHEREAS, ten days published notice of the hearing through two weekly publications of the required notice was given and the hearing was held on the 6th day of May, 2003, at which all persons desiring to be heard were given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. That the improvement is necessary, cost effective and feasible and is ordered as hereinafter described: 2003 Reconstruction Project - 4th Avenue, from Naumkeag Street to Shenandoah .Drive; Viking Steel Road, from 4th Avenue to County Road 101; and Cavanaugh Drive, from Viking Steel Road to Union Pacific Railroad Crossing by installation of sanitary sewer, watermain, storm sewer, storm water pond, concrete curb & gutter, grading, aggregate base, bituminous paving, concrete sidewalk, bituminous trail, railroad crossing and warning signals, street lighting and all appurtenant work. 2. Bruce Loney, Public Works Director, is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvements. 3. The work of this project is hereby designated as part of the 2003-3 Public Improvement Program. 4. The City Council shall let the contract for all or part of the improvements as authorized by Minnesota Statutes 429.041, no later than three years from the date of adoption of this resolution. We are proposing to complete the work as detailed on the attached scope of services, Exhibit A. The attached work plan describes the approach and tasks proposed to be completed by WSB. It should be noted that the work plan includes engineering design for roadway plans, storm sewer plans, sanitary sewer plans and watermain plans. We propose to conduct the work on an hourly basis with an estimated fee of$129,780 and a fee not-to-exceed $148,300. We will review our progress monthly and will not exceed this amount without your prior approval. The services for right-of-way acquisition will be processed under separate cover by Evergreen Land Services Company. WSB's coordination of Evergreen and the land acquisition process is included in our costs identified herein. It is proposed that all work under the contract would be considered complete after the preconstruction conference. The construction management phase would be initiated after the preconstruction conference. We are available to begin work plan as soon as authorized by the City, and we anticipate completing the project according to the following schedule, assuming that we receive the notice to proceed on May 7,2003. This project is proposed to be completed during the 2003 and 2004 construction seasons with an August, 2004 substantial completion date for opening of all streets. Evergreen Land Services (ELS) is sufficiently staffed to begin assistance on this project upon approval by you. It is my understanding that the project will consist of appraisal and partial acquisition of land on 12 properties, for 4th Avenue and two parcels for Valley View Road. Our proposal will be based on this assumption. Scope of Work to be Performed: Evergreen Land Services will perform the following tasks necessary for the appraisal and acq uisition of the 12 parcels: . Update Owners and Encumbrance Reports as needed . . Create individual parcel files for each acquisition . Perform Minimum Damage Assessments (MDAs) on properties with an estimated acquisition cost of under $ 10,000 . Perform individual appraisals on properties with severance damage or with an estimated acquisition cost of over $ 10,000. Provide you with updates on the acquisition process . Provide you with a list of unsigned owners and properties should it be necessary for the city to complete the acquisitions through the condemnation process. Our activities will comply with Minnesota Statute and Uniform Act regulations and will include all steps required in the process and additional steps as may be helpful. Currently, we have eight full-time and four-part time employees, who have up to 40 years of individual experience in the acquisition, relocation, and appraisal fields. ELS is a licensed Real Estate Brokerage firm and all of our agents have a Minnesota Real Estate Agents License under Evergreen Land Services Brokerage license. Collectively, the company has employees experienced in the areas of route selection and development, field and title research and analysis, document and file preparation, and negotiation and relocation assistance in compliance with local, state and federal procedural requirements. ELS' staff is recognized for the wide variety of projects on which they have worked under the guidelines of the Federal Uniform Relocation Assistance and Real Property Acquisition Act of 1970, as amended. We have also worked on projects under specific funding sources: HUD Section 811, CDBG, U.S. Army Corps of Engineers, Federal Aviation Administration, Federal Highway Administration, and Minnesota State Aid. ELS has provided acquisition, appraisal and relocation services to more than 85 public and private entities, including Minnesota Department of Transportation (Mn/DOT). ELS is an approved consultant by Mn/DOT for acquisition, appraisal and relocation services. ELS' staff consists of qualified professionals with diverse experience in land acquisition, appraisal and relocation services, insuring the quality and cost effective implementation of each project. Realizing that the abilities of individual professionals are paramount to our success, ELS assembles a team that assures the client that the proper blend of experience and expertise is provided for each project. ELS' excellent reputation and record of accomplishments is an extension of the experience of our qualified personnel, as well as the close working relationships established with our clients. Our primary objectives are client satisfaction, dedication to sensible and practical project implementation, maximizing financial participation, and meeting time and budgetary constraints. ELS is also very sensitive to clients' respective timing and restrictive guidelines. We maintain excellent working relationships with all staff members of regulatory and approval agencies in order to enhance the likelihood of compliance. ELS' experience includes not only public projects, but also includes acquisition, appraisal and relocation services for various utilities. Our services have been supplied to Mn/DOT, Metropolitan Council, numerous cities and counties, electric utilities, gas utilities, telephone companies, railroads and airports. ACQUISITION SERVICES The acquisition process typically begins with an initial meeting with client's staff to discuss project coordination and procedures. After receiving the appraisal of fair market value for each parcel, ELS staff will develop an acquisition file and prepare the Just Compensation Offer to be signed by the client. ELS then meets with each individual owner to present the offer and review the appraisal, conduct negotiations with each property owner, and be available for questions from each owner regarding the acquisition file. All owners receive an information booklet explaining their rights and the acquisition process. If the owner agrees on the acquisition price, both parties execute a purchase agreement and a closing is set up with the closing agent and the title company. If the acquisition involves easements, ELS initiates the signing of the documents and recording at the county recorder's office. If the owner does not agree with the offer, and after an appropriate amount of time in negotiations, the client's attorney may initiate eminent domain proceedings with requested assistance fromELS. ACQUISITION SERVICES INCLUDE THE FOLLOWING: ~ Meet with client's staff to discuss project coordination, timing and procedures. ~ Attend any other meetings with staff as required. ~ Read appraisal and review appraisals for each parcel and discuss with appraiser and reviewer as necessary. :) Prepare just compensationofferletterfor the client'ssignature on all parcels. :> Prepare landowners information booklet for each parcel. :> Deliver offer letter and booklet to owners and begin negotiations. :> In negotiations, gather information and work towards resolving disagreements and disputes to get a purchase agreement or easement signed. :> All written and oral communication will be documented in each file. :> Prepare purchase agreements for all files. :> Prepare easement documents for all files. :> Prepare a weekly report on status of negotiations. =:> Work with relocation team concerning vacancy dates and other activities. :> Coordinate closings and recording of instruments with the title company. =:> Record easement documents. =:> Work with the client's attorney or title company on issues concerning marketable title. :> If condemnation is necessary, provide services as directed by client's attorney. ABILITY TO MEET SCHEDULES: ELS has a reputation for completing projects on schedule, within budget and without loss of Federal or State Aid Funds. ELS's ability to meet schedules is well recognized by many clients who have selected ELS to assist with their projects. ELS has been through the auditing process several times with Mn/DOT and the Federal Highway Administration. An audit is necessary to receive certain funding. We have received compliments in these audits on our files, record keeping, success in our accomplishments, and the meeting of budgets and schedules. ELS has found that some land acquisition and relocation projects are controversial. However, we feel an experienced and qualified staff can do a great deal to overcome the misconceptions about the program and the acquisition and relocation process. RELOCA TION ASSISTANCE The project approach assists all the impacted residents and businesses, eligible for assistance under the Federal guidelines, in relocating to adequate replacement accommodations as quickly as possible. In addition, ELS can assure each project is performed in accordance with the Uniform Relocation Assistance and Real Property Acquisition Actof 1970, as amended, to maximize Federal participation. All impacted residential homeowners, tenants, and businesses will be treated in a just manner and receive adequate compensation under the applicable guidelines. ELS operates a cost effective and efficient program and addresses all the special needs of the individual residential homeowner, tenant and business. We make a concerted effort to find workable solutions to . all problems related to the relocation program. We anticipate the usual range of difficulties, together with new challenges, with each project, and have the capabHitiesJo address all of these issues. RELOCATION SERVICES INCLUDE THE FOLLOWING: ~ Initial meeting with th~ client's staff to discuss projyct .coordination and pr8(;~dures. ~ Meeting(s) with the public and occupant(s) to discuss and provide written general information on relocation benefits, documentation required, and the process applicable to each of their situations. ~ Determine. needs and preferences for the move and replacement location for the owner and occupants. Explain relocation benefits, the process involved with relocation, and documentation requirements. ~ Offer advisory services regarding the move, explanations of relocation benefits and procedures, and other assistance as necessary. ~ Prepare the required general information, eligibility, and gO-day vacate notices for client's review and signature. ~ Assist the displaced occupants to identify and document eligible reimbursable relocation costs and confirm that the submitted costs are reasonable and necessary per the regulations. ~ Conduct research for comparable properties, inspect comparable properties, and provide referrals to available replacement properties, as requested. ~ Prepare claims for relocation payment and make recommendations to the client regarding the eligibility of relocation benefits requested by the displaced occupants. ~ Throughout the project, address questions and concerns of the displaced occupants, and advise the occupants of their rights and obligations in the relocation process. ~ Throughout the project, review the project/relocation status and review any questions and concerns. ~ Document and close out file once all relocation benefits are issued. Our activities comply with Minnesota Statutes and the Uniform Act regulations and include all steps required in the process together with additional steps as may be helpful. All written and oral communication is documented in each file and a bi-weekly status report is updated and presented to the client. ApPRAISAL SERVICES Evergreen Land Services Company (ELS) now offers appraisal services to our clients. ELS has on staff a Certified General Real Property Appraiser who has experience with the appraisal of partial acquisitions. ELS can provide the following appraisal formats: 1. Narrative Appraisals - can be used for any type of acquisition but is typically used for more complex acquisitions. 2. Short Form Appraisals '- used for acquisitions of residential properties, vacant land, or for partial acquisitions involving easily supported damages to the remainder of the property. 3. Minimum Damage Assessments (MDAs) - this format is not technically an appraisal but is a format promoted by Mn/DOT to be used for uncomplicated acquisitions up to a value of $10,000, including simple partial acquisitions where only land or land and minor improvements are involved. In conjunction with the "UniforrnuRelocation Assistance and Real Property Acquisition policies Act of 1970" (commonly known as the Uniform Act), ELS offers property owners the opportunity to accompany the appraiser on the inspec~ionof their properties and treats the property owners with respect. Appraisals are prepared in conformance with the Uniform Standards of Professional Appraisal Practice (USPAP) as well as Mn/DOT or other agency regulations. APPRAISAL REVIEW ELS can also provide appraisal review services. Reviews can be via form or narrative reports depending on the client's request and the complexity of the appraisal. Review criteria include sound appraisal principles and USPAP conformance as well as Mn/DOT or other agency regulations. CONSUL TATION ELS understands the appraisal process and requirements and can provide appraisal expertise. in the form of consultation for appraisal contracting or condemnation. Appraisal fees are dependent on the client's desired appraisal format and the complexity of the appraisal problem, but can be via an hourly rate of $70.00 plus costs or a charge per appraisal.
