SUBJECT: Revision to Section 4.50 of the Shakopee City Code, amending the
city code requirements for fire warning systems.
MEETING DATE: May 20,2003
INTRODUCTION:
The 2003 State Fire Code has additional requirements for the placement and operation
of smoke detectors in residential occupancies. These additional requirements are not
included in the current Section 4.50 making the local ordinance less restrictive than the
State Fire Code.
The revisions to Section 4.50 make this ordinance equal to the State Fire Code
requirements and clarifies where and how smoke detectors are installed in residential
occupancies within the City of Shakopee.
ALTERNATIVES:
1. Offer and pass Ordinance No. 666, AN ORDINANCE AMENDING SECTION
4.50 OF THE CITY CODE REQUIRING FIRE WARNING SYSTEMS, as
presented.
2. Offer and pass Ordinance No. 666, AN ORDINANCE AMENDING SECTION
4.50 OF THE CITY CODE REQUIRING FIRE WARNING SYSTEMS, with
revisions.
3. Do not authorize Ordinance No. 666.

ORDINANCE NO. 666, FOURTH SERIES
AN ORDINANCE AMENDING SECTION 4.50 OF THE CITY CODE REQUIRING
FIRE WARNING SYSTEMS.
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Section 4.50 of the +he City Code Subdivision Section 1.50 is amended to read:
SEe. 4.50. FIRE WARNING SYSTEMS IN RESIDENTIAL OCCUPANCIES.
Subd. 1. Fire Warnin2 Systems Required. Every hotel, ef motel and dwelling unit, every sleeping
room and every dVlelling unit, including single dwellings, mobile homes and every rooming house shall
be provided with ilE: approved smoke detector~ as hereinafter set out.
Subd. 2. Tvpe of Wamin!! Device. W aming device~ required by this Section shall be one that is
activated by smoke and shall conform to UBC Standard 43 6 the requirements of the Minnesota State
Building Code and the Minnesota State Fire Code and any subsequent revisions.
Subd. 3. Where Installed Installation ReQuirements.
A. All units shall be installed at a point centrally located in the corridor or an area giving
access to rooms used for sleeping purposes and v/here the sleeping rooms are located on an
upper level the required detector or v:arning device shall be placed at the center of the
ceiling directly above the stainvay. Detectors shall be installed in sleeping areas and
rooms.
B. All detectors shall be located installed on the ceiling and shall be mounted not less than six
(6) inches from a wall. Under peculiar circumstances When detectors cannot be installed on
the ceiling they may be located installed on a wall and shall be mounted but must be at least
twelve (12) inches ffem down from the ceiling.
C. Those installed in single family dVlellings and mobile homes may be activated by
self contained battery. Those located in hotels, motels or multiple dwelling units shall be
permanently '",ired to insure that the installation '.vill not interfere with the operating
characteristics of the detector, and in any e'lent the signals of any alarm prescribed for by this
Section shall be sufficiently audible in all sleeping rooms to '.vaken sleeping occupants.
Detectors shall be installed in every room in the path of the means of egress from the
sleeping area to the door leading from the guestroom or suite.
D. Detectors shall be installed in each story within the guestroom, dwelling unit or suite,
including basements. For guestrooms, dwelling units or suites with split-levels and without
an intervening door between the adi acent levels, a smoke alarm installed on the upper level
shall suffice for the adiacent lower level provided that the lower level is less than one full
story below the upper level
Subd. 4. Faree and Effect Power Source and Interconnection. This Section and all installations
required thereby shall be in full force and effect from and after the 1st day of January, 1979. Power
source and interconnection shall be in accordance with the Minnesota State Building Code and the
Minnesota State Fire Code and any subsequent revisions.
Subd. 5. Inspection and Failure to Comply. All premises required to be provided with fire warning
systems as required by this code equipped '.vith alann by this Section or 'Naming device shall be open to
inspection by duly designated officers ofthe City at any and all reasonable times,
Subd.6. Failure to Comply. It is unlawful for any person to fail to comply with the provisions of this
Section and fail to keep the warning devices above described fully operational at all times. Each day of
failure to comply with this Section constitutes a separate offense. The provisions of this Subdivision are
not intended to be an exclusive remedy. The City may, at its option, proceed in a civil action to restrain
the continued occupancy of any hotel, motel, dwelling unit. rooming house or other structure in which
sleeping rooms are occupied by tenants, until the provisions of this Section are fully complied with.
Section 2. Effective Date. This ordinance becomes effective from and after its passage and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota,
held this day of ,2003.
