SUBJECT: Revision to Section 10.35 of the Shakopee City Code, Adoption of
the Minnesota State Fire Code

INTRODUCTION:
On March 31,2003 the State of Minnesota adopted the new International Fire Code as
amended. The Minnesota State Fire Code is the base fire code enforced throughout
Minneosota.
This replaces the former Uniform Fire Code that had been used in Minnesota since the
original adoption in October 1975 and is the code presently adopted in Section 10.35 of
the City Code.
By adopting the new State Fire Code the City is able to maintain consistency with the
State and implement several former policies into ordinance form.
ALTERNATIVES:
1. Offer and pass Ordinance No. 665, AN ORDINANCE ADOPTING THE
MINNESOTA STATE FIRE CODE BY AMENDING SECTION 10.35 OF THE
CITY CODE, as presented.
2. Offer and pass Ordinance No. 665, AN ORDINANCE ADOPTING THE
MINNESOTA STATE FIRE CODE BY AMENDING SECTION 10.35 OF THE
CITY CODE, with revisions.
3. Do not authorize Ordinance No. 665.

ORDINANCE NO. 665, FOURTH SERIES
AN ORDINANCE ADOPTING THE MINNESOTA STATE FIRE CODE BY
AMENDING SECTION 10.35 OF THE CITY CODE
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1. Section 10.35 of the ~City Code Subdb-ision 10.35 is amended to read:
SEC. 10.35. ADOPTION OF THE MINNESOTA STATE UNIFORM: FIRE CODE.
The Minnesota State Unif-orm Fire Code (1998 Edition) is hereby adopted with the amendments set
forth in Subdivision 1. One copy of this Code shall be kept on file in the office of the Fire Prevention
Bureau.
Subd. 1. Amendments to Minnesota State Uniform Fire Code.
A. Section 103.~1 of the Minnesota State Uniform Fire Code is hereby changed to
read:
1 03.~1 General. A Fire Prevention Bureau is hereby established within the City
of Shakopee. The Bureau shall consist of such personnel as may be assigned thereto
by the City of Shakopee and/or the Fire Chief. The function of this bureau shall be
the implementation. administration and enforcement of the to administer and
enforce the provisions of this code.
B. Section 105.1.1 of the Minnesota State Fire Code is changed by adding a new
Section 105.1.1.1 to read: Soction 105.3 of the Minnesota Uniform Fire Code is
hereby amended to read:
105.1.1.1 Fees for nermits. Fees for permits required by this code shall be based
on the City of Shakopee Fee Schedule.
105.3 AA,.pplieatioB for Permit. },Lpplications for permits required by this code shall
be made to the Shakopee Fire Pre-yention Bureau and/or Shakopee Fire Department
in such form and detail as prescribed by said authority. Applications for permits
shall be aecompanied by s-uch plans as required by the Fire Prevention Bureau
and/or Fire Department.
C. Section 202. Amendments F of the Minnesota State Fire Code is changed by
modifying the definition of fire chief to read: Section 105.8 of the Minnesota
Uniform Fire Code is hereby deleted and replaoed with the follm.ving:
Fire Chief. The chief officer of the fire department serving the iurisdiction or the
chiefs authorized representatives. For the purposes of enforcing this code. the term
chief also includes the representatives of the Shakopee Fire Prevention Bureau and
the Minnesota State Fire Marshal's Office.
105.8 Permit Required. No person shall engage in any activity, operation, praotice
or function listed belov: witheRt first haT/ing obtai-ned a permit from the Shakopee
Fire Prcmmtion Bureau and/or Shakopee Fire Department.

4. Installation and remoTlal of aboveground and underground flammable or
combustible liquid storage tanks.

near the structure. A permit is req1:1ired for canopies in excess of 400
square feet. No permit is required if the struoture is used exelusively for
campmg.
D. Section 903.3.1.5 or the Minnesota State Fire Code is changed by adding the
following uses:
7. Cafeterias with an occupant load of 100 or more in Group A. Group E or
Group R occupancies
8. Multi-purpose rooms with an occupant load of 100 or more in Group A.
Group E or Group R occupancies
Section 105 of the Minnesota Uniform Fire Code is amended by adding a section to

105.9 Permit Fee. Fees for such permits as required by Section 105.8 shall be in an
amount as set forth in the City of Shakopee Fee Schedule.
E. Section 903.4.1 of the Minnesota State Fire Code is hereby changed by modifying
Exception 3 to read:
3. For existing sprinkler systems installed on or after July 1. 1998. monitoring is
required when the number of sprinklers is 20 or more. For existing sprinkler
systems installed prior to July 1. 1998. monitoring is required when the number of
sprinklers is 100 or more.
Seotion 204C of the Minnesota Uniform Fire Code is amended by amending the
follo.,ying definition:
CHIEF is the chief officer of the fire department serving the jurisdiction or the
ohiefs authorized representatives. For the purposes of onf-orcing this code, the term
ohief also includes the members ofilia 8hakopee Fire Pre'rcntion Bureau and the
Minnesota State Fire Marshal's Office.
F. Section 903.4.2 of the Minnesota State Fire Code is changed to read:
903.4.2 Alarms. AlJProved audible devises shall be connected to every automatic
sprinkler system. Such sprinkler water-flow alarm devices shall be activated bv
water flow equivalent to the flow of a single sprinkler of the smallest orifice size
installed in the system. An approved audible alarm devise shall be provided in the
interior of the building in a normally occupied location. An approved audible and
visual devise shall be provided on the exterior of the building in an approved
location.
903.4.2.1 Multiple Tenant Buildinl!s. Multiple tenant buildings shall be
provided with an approved audible alarm devise in each tenant space. The
devise shall be located in a normally occupied location.
G. Section 905.3.1 of the Minnesota State Fire Code is changed to read:
905.3.1 Buildin2 heil!ht. Class III standpipe systems shall be installed throughout
buildings where the floor level of the highest stOry is located 30 feet or more above
the lowest level of fire department vehicle access. or where the highest story is
located 3 or more stories above the highest level of fire department vehicle access,
or where the floor level of the lowest story is located 20 feet or more below the
highest level or fire department vehicle access.
Exceptions to Section 905.3.1 shall not be amended.
H. Chapter 10 of the Minnesota State Fire Code is changed by adding a new Section
1012 to read:
SECTION 1012 OVERCROWDING AND STANDBY PERSONNEL
1012.1 Overcrowding. Overcrowding and admittance of persons beyond the
approved capacity of a place of assembly are prohibited. The. code officiaL upon
finding overcrowding conditions or obstructions in the aisles, aisle accesswavs or
other means of egress. or upon finding a condition which constitutes a serious
menace to life, is authorized to cause the performance, presentation, spectacle or
entertainment to be stopped until such condition or obstruction is corrected.
1012.2 Standby Personnel. When. in the opinion of the code officiaL it is essential
for public safety in a place of assembly or any other place where people congregate,
due to the number of {>ersons, or the nature of the performance, exhibition, display,
contest or activity, the owner, agent or lessee shall employ one or more qualified
persons, as required and approved, to be on duty at such place. Such individuals
shall be subiect to the code official's orders at all times when so employed and shall
be in uniform and remain on duty during the times such places are open to the
public, or when such activity is being conducted. Before each performance or the
start of such activity, such individuals shall inspect the required safety appliances
provided to see that they are in the proper location and are in good working order,
and shall keep dili~ent watch for fires or other public safety hazards during the time
such place is open to the public or such activity is being conducted and take prompt
measures for extinguishment of fires that may occur. Such individuals shall not be
required or permitted, while on duty, to perform any other duties than those herein
specified.

One COPy of the code shall be kept on file in the office of the Fire Prevention
Bureau.

Section 2. Effective Date. This ordinance becomes effective from and after its passage and publication.
Adopted in session of the City Council of the City of Shakopee, Minnesota,
