CONSIDERATIONS
Shakopee Crossings has made application for final plat approval of Southbridge Crossings
Third Addition. The proposed development is located west of County Road 18 and north of
Southbridge Parkway (Exhibit A). The development, as proposed, would consist of 12 lots
for commercial development (Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat and the
development patterns proposed with the Planned Unit Development (PUD) for the site.
The City Attorney has commented that the dedication language shall be revised to accurately
reflect development proposed by the plat.
The Finance Department has commented that the special assessments are to be paid with the
final plat.
Shakopee Public Utilities (SPUC) has commented that it has recently increased the rates for
the UG Electric Charge, Trunk Water Charge and Water Connection Charge. The new rates
will apply to this subdivision.
SPUC also commented that there should be a minimum 10 foot wide utilities easement around
the perimeter of each and every lot. This should be a standard requirement for all commercial
lots. There needs to be an additiona11 0 foot wide easement across Lot 5, Block 1 for
watermain as approved. Individual lots water services must be approved by the Water
Superintendent prior to construction.
ALTERNATIVES
1. Approve Resolution No. 5894, approving the Final Plat of Southbridge Crossings
Third Addition subject to the conditions presented.
2. Approve Resolution No.5894, subject to revised conditions.
3. Do not approve the final plat and direct staffto prepare a reso1ution.consistent with the
direction ofthe Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approval of Resolution No. 5894, approving the Final

RESOLUTION NO. 5894
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF SOUTHBRIDGE CROSSINGS THIRD ADDITION
WHEREAS, , Shakopee Crossings Limited Partnership., applicant and property owner,
has made application for final plat approval of Southbridge Crossings Third Addition; and
WHEREAS, the subject property is legally described as:
Lot 1, Block 3, Southbridge Crossings Second Addition, according to the recorded plat thereof,
Scott County, Minnesota and Lot 1, Block 1, Southbridge Crossings Second Addition, according
to the recorded plat thereof Scott County, Minnesota; and
WHEREAS, the Planning Commission recommended approval of the proposed
preliminary plat with conditions; and
WHEREAS, on June 3, 2003 the City Council reviewed the proposed final plat, and
found it to be generally consistent with the approved preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Shakopee, Minnesota that final plat of Southbridge Crossings Third Addition is hereby
approved subject to the following conditions;
I. The following procedural actions must be completed prior to the recording of
the final plat:
A. The dedication language on the plat shall be revised to accurately reflect
the development proposed.
B. Drawings shall be revised to show a right-in access only from CSAH 18 as
recommended by the Scott County Highway Department.
C. Minnesota Department of Transportation (MnDOT) right-of-way must be
clearly labeled on the plat, as well as any in-place monuments.
D. The location of site driveways should be determined, as well as the queue
lengths that would be anticipated with the development.
E. The plat shall be revised to provide a minimum 10 foot wide drainage and
utilities easement around the perimeter of each and every lot.
F. The plat shall be revised to provide an additional 10 foot wide easement
across Lot 5, Block 1 for watermain as approved.
G. Approval of title by the City Attorney.
H. Execution of a Developers Agreement with provisions for Plan A and Plan
B improvements, as well as payment of engineering review fees, and any
other fees as required by the City's adopted fee schedule.
I. As part of the Plan A improvements, "No Parking" signs shall be installed
along "A" Street and "C" Street, per the sign type and spacing
requirements determined by the City Engineer.
1. Street lighting to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges for the residential portion of the plat, Trunk Sanitary
Sewer Charges, security for the public improvements, engineering
review fees, and other fees as required by the City's adopted Fee
Schedule for the entire plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve the
Final Construction Plans and Specifications.
7. Individual lots water services must be approved by the Water
Superintendent prior to construction.
8. Special assessments shall be paid at the time of platting.
II. Following approval of the final plat, the following conditions shall apply;
A. Prior to development work commencing the developer shall submit drainage
calculations including existing and proposed conditions, and summarizing the
change in drainage to CSAH 18 and future CSAH 21.
B. Subsequent revisions ofthe preliminary plat or final plat of a portion of the
project area will require evaluation of the adequacy, and possible revision of,
the Traffic Impact Report filed with the preliminary plat application.
C. Cross easements providing access between the lots shall be granted and
maintained in perpetuity by the property owner.
IV. Following approval and recording of the final plat, the following conditions shall
apply;
1. Building construction, sewer, water service, fire protection and access
will be reviewed for code compliance at the time of building permit
application(s).
2. No berming, ponding, signage, or landscaping shall be located in the
Scott County right-of-way.
3. Any work within the Scott County right-of-way will require a utility
permit from the County.
4. Best Management Practices shall be used during the construction of
this project to insure against water and wind erosion.
5. Utilities shall be constructed with seepage collars to prevent improper
draining of groundwater from the area.
6. Park Dedication fees shall apply to this plat consistent with the fees
outlined in the City's adopted fee schedule in place at the time of
building permit issuance.
7. Receipt of approval ofthe right-in access from CSAH 18 from Scott
County; in the event that such approval is not given, the applicant
understands that the entire plat may need to be revised and reviewed to
address any traffic issues that result from denial of the access, and that
the traffic impact report would be revised.
8. A MnDOT drainage permit will be required for this development if
applicable.
9. Outlet structures should be equipped with skimmers to prevent
floatables from entering the City's storm sewer system.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the final plat of
SHAKOPEE CROSSINGS THIRD ADDITION does not constitute a representation or
guarantee by the City of Shakopee as to the amount, sufficiency or level of water service that
will be available to lots within the plat as they are developed.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota,
