C :t~ CITY OF SHAKOPEE CONSENT Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Peter Vickerman, Planner I-GIS SUBJECT: Final Plat of Southbridge Crossings East 1st MEETING DATE: June 3, 2003 CASELOG NO.: 03-054 REVIEW PERIOD: INTRODUCTION: The City Council approved the preliminary plat of Southbridge Crossings on August 7, 2002, and Planned Unit Development #21 for a retail center on February 18, 2003. Shakopee Crossings Limited Partnership has now made application for final plat approval of what will be the first commercial phase ofthat project. The first phase consists ofthe southern portion ofthe site, with the balance proposed to be platted as an outlot for future platting. The planned use of this site is a Home Depot store. SITE INFORMATION: Applicant: Shakopee Crossings Limited Partnership Property Ow:p.er: Shakopee Crossings Limited Partnership Location: South ofSTH 169; West of Stagecoach Road; North and East of CSAH 18 Current Zoning: Highway Business (B-1) with Planned Unit Development #21 Adjacent Zoning: North: Highway Business (B-1) South: Planned Residential District (pRD) East: Community Commercial (CC) West: Planned Residential District (pRD) Exhibits: A: Final Plat Drawings B: PUD #21 Resolution 1 CONSIDERATIONS: Because this is a phased project, prior to recording ofthe final plat of this phase, the platting documents should be revised so that the name is Southbridge Crossings East 1 st Addition. This recommendation is included in the draft conditiOIls of approval. Comments Received: Specific comment was received from the Shakopee Public Utilities Commission (SPUC) staff, and the Minnesota Department of Transportation (MnDOT). SPUC was concerned with the location of an interior drainage and utility easement and also requested a drainage and utility easement along the length ofthe lot line between Lot 1 Block 1 and Outlot A. These concerns have been incorporated into the recommended conditions MnDOT has requested that a detailed drainage map that shows where existing ponds drain be submitted to them. Staff has passed this letter on to the necessary parties to ensure this is done. MnDOT has also requested that additional MnDOT ROW be identified on the plat before it is recorded. This has also been passed on to the necessary parties. Park Dedication: Condition V. B. 8 of Southbridge Crossings East preliminary plat calls for "Park dedication requirements shall be met through cash dedication. Park dedication fees shall be paid at the time of building permit issuance in an amount consistent with the adopted fee schedule in place at that time." At this time the park dedication requirement for Lot I, Block 1 would be $4280 per acre multiplied by 12.11 acres for a total of$51,830.80 to be paid at time of issuing the building permit. ALTERNATIVES: 1. Approve Resolution No. 5896, a resolution of the City of Shako pee approving the final plat of SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION subject to conditions as presented. 2. Adopt Resolution No. 5896, a resolution of the City of Shakopee approving the final plat of SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION with revised conditions. 3. Do not approve the proposed final plat, and direct staff to prepare a resolution consistent with the Council's decision. 4. Table the matter, and request additional information from staff and/or the applicant. RECOMMENDATION: Staff recommends Alternative No.1. 2 ACTION REQUESTED: Offer a motion to approve Resolution No. 5896, a resolution of the City of Shako pee approving the final plat of SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION subject to the recommended conditions (Alternative No.1). (applicant and property owner) have made application for approval of a final plat under City Code Sec. 12.09; and WHEREAS, the subject parcel of land is presently zoned Highway Business (B-1) with a Planned Unit Development Overlay and is within the City's Metropolitan Urban Service Area (MUSA); and WHEREAS, the legal description for the subject parcel ofland for which the request is being made is: Outlot A, Riverside Grove 1'1 Addition WHEREAS, notice was provided and on July 25,2002, the Planning Commission conducted a public hearing regarding the application for preliminary plat approval of SOUTH BRIDGE CROSSINGS EAST, at which it heard from the Community Development Director or his designee and invited members of the public to comment; and WHEREAS, the Planning Commission recommended approval of the proposed preliminary plat with conditions; and WHEREAS, on August 7th, 2002 the City Council reviewed the proposed preliminary plat and adopted Resolution No. 5896 approving the preliminary plat of SOUTHBRIDGE CROSSINGS EAST; and WHERAS, Shakopee Crossings LTD has made application for approval of the final plat of the first phase ofthe project known as Shakopee Crossings East; and WHEREAS, on June 3, 2003 the City Council reviewed the proposed final plat, and found it to be generally consistent with the approved preliminary plat. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Shakopee, Minnesota that preliminary plat of SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION is hereby approved subject to the following conditions; I. No ponding shall be allowed within the Scott County right-of-way. II. No benning, signage or landscaping shall be located within the Scott County right-of-way. III. Stonn water calculations will need to be submitted before any construction is allowed. 4 IV. Prior to construction, surveyor's bench loop notes shall be submitted showing the benchmarks for this site have been established using the City of Shakopee's approved benchmark system. V. A ten-foot (10') easement along the boundary of Outlot A and Lot 1 Block 1 shall be shown. VI. The Developer shall work with the Shakopee Public Utilities Commission to ensure the correct location of the internal drainage and utility easement is shown. VII. The following procedural actions must be completed prior to the recording of the Final Plat: A. Because this is a phased project, the plat documents shall be revised to re-name the plat SOUTHBRIDGE CROSSINGS EAST FIRST ADDITION. B. Approval of title by the City Attorney. C. Execution ofthe Developers Agreement, which shall include provisions for security for public improvements within the Final Plat and the engineering review fees, as well as payment of any other fees as required by the City's adopted fee schedule. Also to be incorporated in the developers agreement is the commitment by the developer to have a permanent street design for the street Southbridge Crossings by May 1, 2003, and that the permanent street improvements shall be constructed for the street Southbridge Crossings by July 1, 2003. 1. Street lighting to be installed in accordance with the requirements ofthe Shakopee Public Utilities Commission. 2. Electrical system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 3. Water system to be installed in accordance with the requirements of the Shakopee Public Utilities Commission. 4. Installation of sanitary sewer and storm sewer systems, and construction of streets in accordance with the requirements of the Design Criteria and Standard Specifications of the City of Shakopee. 5. The developer shall be responsible for payment of Trunk Storm Water Charges and Trunk Sanitary Sewer Charges as required by the City's most recently adopted Fee Schedule. 6. No public improvements shall be constructed until the City Engineer and the Shakopee Public Utility Commission approve the Final Construction Plans and Specifications. D. A ten-foot (10') easement along the boundary of Outlot A and Lot 1 Block 1 shall be shown. E. The Developer shall work with the Shakopee Public Utilities Commission to ensure the correct location of the internal drainage and utility easement is shown. 5 VII. Following approval and recording of the final plat, the following conditions shall apply; A. Building construction, sewer, water service, fire protection and access will be reviewed for code compliance at the time of building permit application(s). B. Any work within Scott County right-of-way will require a utility permit from the County. C. Temporary street signs shall be provided at the developer's cost throughout the project area. D. Park dedication requirements shall be met through a cash dedication in the amount of$51,830.80 payable at time of issuance of building permit, if issued in 2003, or at the rate applicable at the time if issued after 2003. Sheet 3 of 3 sheets RESOLUTION NO. 5858 A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING SOUTHBRIDGE EAST RETAIL CENTER PLANNED UNIT DEVELOPMENT #21 WHEREAS, Shakopee Crossings Limited Partnership is the Applicant and Owner of said property; and WHEREAS, the property upon which the request is being made is legally described as follows: Outlot A, Riverside Grove rt Addition, Scott County, Minnesota; and WHEREAS, the Planning Commission of the City of Shakopee reviewed the request for the Plarmed Unit Development on February 6,2002, and recommended its approval; and WHEREAS, all notices of the public hearing for the Planned Unit Development were duly sent and posted and all persons appearing at the hearing have been given an opportunity to be heard thereon; and WHEREAS, the City Council reviewed the request at its meetings of February 18, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, as follows: That the Southbridge East Retail Center Planned Unit Development (PUD) No. 21 is approved subject to the following conditions: 1. Development ofthe site shall generally comply with the site plan dated March 3, 2003, and received by the City on March 4,2003, attached as Exhibit B. Development of the area identified as Outlot A is not required to comply with the schematic site plan illustrated on Exhibit B, however, development ofthat area is required to comply with the requirements of the PUD and City Code. Additional review process shall be necessary for Conditional Use Permits or request of approval for variations from the PUD or City Code requirements. 2. An open sales lot in the form of a garden center shall be allowed on Lot 1 subll:ct to the conditions outlined asa part of the PUD approval and as generally depicted on Exhibit B. 3. No outdoor seasonal sales area shall be allowed except the garden center. 4. Open sales lots or any use having exterior storage of goods for sale shall be screened from any adjacent residential zone. 5. Open sales lots or any use having exterior storage of goods for sale shall be kept neat and orderly. 6. Open sales lots or any use having exterior storage of goods for sale shall not have any uses in any required front, side or rear yard setback or in any required parking area. 7. Shall not have a public address system from any part of the facility that is audible from any residential property. 8. Approval ofthe temporary and ri,ght inJri,ght out access depicted on the site plan for the PUD is contingent upon the applicant receiving approval and access pennits from Scott County in the 2 tyh:b,r g, locations depicted on Exhibit B. Multiple structures per lot shall be allowed within the PUD subject to the conditions outlined in Section 11.87, Subd. 2.K. 9. Architectural design and building materials shall be as depicted on Drawings A1.0. 10. The orange stripe depicted on the front elevation for the Home Depot store shall be allowed, but shall be limited to twelve inches (12") in width. There shall not be an orange stripe on either the sides or rear of the building. 11. All items available for sale shall be limited to the principal Home Depot structure, the outdoor garden center as proposed to be expanded to 28,000 square feet more or less, and the area designated "sidewalk sales display" area indicated 011 Exhibit B). 12. Rental vehicles (including any motorized vehicle or trailers) shall be parked only within the striped parking stalls of the Home Depot parking lot. 13. No display of items shall be allowed on the sidewalk except as indicated on the plans submitted with the original application, nor shall display of items be allowed on the exterior walls of the building. 14. Landscaping requirements shall be verified at the time of building permit review. The applicant shall be required to submit to the City a landscaping bond in an amount equal to 115% ofthe value of the landscaping to ensure compliance with this section during the first year after planting. 15. At the time of building permit review(s), shall submit a lighting plan for the project area to verify that on site lighting is not spilling over to adjacent properties and is in compliance with the lighting requirements ofthe City Code. 16. All mechanical components, including, but not limited to, rooftop components, on site shall be screened. Said screening can be accomplished through painting, paneling or other material as deemed acceptable by the Zoning Administrator. 17. Trash compactors shall be fully screened from view. Other trash receptacles, including but not limited to dumpsters, shall be stored in fully enclosed areas, including the top. 18. Building materials used on the sides and rear ofthe building(s) shall be of the same or similar materials and colors as the front of the building(s). 19. Freestanding signage shall be limited to two (2) pylon signs not to exceed twenty (20) feet in height and two (2) monument signs not to exceed ten (10 feet in height. All pylon and monument signs shall be limited to the sign area permitted under the City's sign regulations. The design and materials for the pylon and monument signs shall be substantially similar to those depicted in the 2/14/2003 drawings submitted to the Council - 20. There shall only be signage on the front ofthe Home Depot store, totaling no more than four hundred (400) square feet. 21. Shall provide an internal pedestrian access system either along the center drive or along the southern perimeter of the development. There shall be no signage on the rear or sides of the building. 22. Shall provide access points in locations approved by the City Engineer to ensure proper ingress/egress to the site. 23. Shall allow lots without public street frontage, if property cross easements are provided to ensure accessibility. 24. Uses listed as conditional uses in the underlying zoning district may be allowed within the retail center PUD upon approval by the City Council. Such uses shall be held to standards outlined in Section 11.87 unless otherwise modified by the City Council. A separate CUP review process shall not be required when these uses are incorporated into the retail center PUD review. 3 B'2, 25. Staff shall verify that the retail center is in compliance with its requirement prior to the issuance of any Certificate of Occupancy within the retail center. 26. Fencing materials other than chain link shall be utilized for the fencing areas ofthe Home Depot garden center and seasonal sales area. 27. Loading facilities shall comply with the requirements of Section 11.63. 28. The ownership, operation and maintenance ofthe private driveways within the PUD shall be the responsibility of the developer and/or its assigns and shall not be accepted by the City. 29. Irrigation system shall be provided for the landscape islands and perimeter landscaping. 30. The trees along the east boundary of the Home Depot site shall be sized as follows at the time of installation: coniferous trees a minimum of6 feet and deciduous trees arninimum of2.5 inches and shall be placed on an 8 foot berm. 31. Delivery of lumber and similar materials to the northernmost loading area of the Home Depot store, as well as garbage removal shall be restricted to between the hours of 6am and 10 pm. 32. The applicant shall provide the City with funds in escrow for a future traffic signal at the intersection ofCSAH 18 and Crossings Boulevard. The amount of this escrow shall be in an amount determined by the Public Works Director. Adopted in session of the City Council of the City of Shakopee, Minnesota, held the 18th day of March 2003.
