Authorize Payment for Easement for Project No. 2002-4 /S.{j.J_ CITY OF SHAKOPEE Memorandum TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Vierling Drive, from C.R. 15 to Orchard Park West, Project No. 2002-4 Easement Acquisition DATE: July 1, 2003 INTRODUCTION: This memorandum is for the City Council to authorize payment for easements needed for the construction of Vierling Drive, from c.R. 15 to Orchard Park West, Project No. 2002- 4. BACKGROUND: On October 15,2002, City Council adopted Resolution No. 5796, a resolution ordering the improvement and the preparation of plans and specifications for improvements on Vierling Drive, from C.R. 15 to Orchard Park West. Associated with this project is easement acquisition in order to construct the improvements. Attached to this memorandum is a letter from Paula Callies on the easement acquisition negotiations with the property owner south of Lions Park for the temporary and permanent easements needed for this project. The City had an appraisal prepared for the easement acquisition by Patchin Messner & Dodd for the permanent and temporary easements and their conclusion for the takings was $55,125.00. In negotiation with the land owner, the City has reached an agreement for the easements associated with this project in the amount of $62,000.00. The easement documents are being prepared by Kennedy and Graven and will be sent to the property owner for execution. Upon execution of the easements, the City would pay the amount of $62,000.00 for these easements, if Council authorizes the payment. Attached to this memo is a legal description and a sketch of the easement area for Council review. ALTERNATIVES: 1. Approve a motion for the City to authorize payment for temporary and permanent easements associated with the Vierling Drive Project to the property owner, Pill No. 27-912050-0. 2. Deny the easement acquisition. 3. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1, as does the City Attorney working on the land acquisition for the City.
