SUBJECT: Approval of a Registered Land Survey (RLS) - Scott Wirth

INTRODUCTION
Scott Wirth, property owner, and Generation Homes, applicant, have submitted a request for
an RLS for property that is located on 4th Avenue West. This property consists of Lots 2,3,
and 4, Block 9, Koeper's Addition and a portion ofthe previously vacated adjacent alley.
BACKGROUND
The property in question is zoned Medium Density Residential (R-2) Zone. The R-2 Zone
allows single family detached and attached dwellings, and two (2) family dwellings, and
requires lots to have a minimum 70 feet in width, 5445 square feet in area and a minimum 10
foot side yard setback.
The property owner initially submitted an application for a minor subdivision to split the
property into four (4) lots. However, Scott County informed staffthat the property owner
would have to submit an RLS due to a portion ofthe property being Torrens property, and a
portion of the property being vacated alley. He was informed that a proceedings subsequent
is also required to expand the certificate to include the vacated alley. The property owner has
been in contact with the Torrens Examiner regarding the proceedings subsequent.
The proposed lots would be 75 feet wide, with 11,250 square feet in area. The property
owner would provide a two (2) space parking pad for each unit which will provide the
required parking spaces. The property owner's intent is to split the property into two (2) lots
and construct two (2) twin homes. After construction of the twin homes, he would like to
proceed with a minor subdivision that would create four (4) lots, one for each unit. This
minor subdivision would include a request to waive the subdivision criteria for the lot width
minimum requirement, and the side yard setback minimum requirement for that side ofthe
structure that would have a common wall. The request for waiver of criteria would be to the
City Council, and would proceed any action taken on the minor subdivision.
The Building Official provided a comment that separate sewer and water services shall be
provided.
Shakopee Public Utilities has commented that there is no known existing water service to this
site.
City Engineering has provided comments, noting that connections to the sanitary sewer, storm
sewer and water main services are required. Additionally, they have stipulated that the city
retain an easement along the west property line for at least the sanitary sewer, and that an
easement be retained along the north property line for the overhead electric line.
STAFF RECOMMENDATION
Staffrecommends approval of the Registered Land Survey, subject to the following conditions:
1. The structures are to be designed to ensure compliance with all setback requirements.
2. Separate sanitary sewer, storm sewer and water services shall be provided.
3. Submit a revised survey prior to recording that includes the required easements and
sanitary sewer/water service information.
ALTERNATIVES
1. Approve the requested Registered Land Survey, subject to conditions recommended by
staff.
2. Approve the requested Registered Land Survey, subject to revised conditions.
3. Do not approve the Registered Land Survey.
4. Table action on this item and request additional information from the applicant and/or staff.
ACTION REQUESTED
Offer Resolution No. 5904, a Resolution approving the Registered Land Survey, and move its
approval.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA, APPROVING THE
REGISTERED LAND SURVEY SUBMITTED
BY SCOTT WIRTH/GENERATION HOMES
WHEREAS, the property upon which the request is being made is legally described as:
Lots 2, 3 4, Block 9, KOEPER 'S ADDITION, according to the recorded plat thereof, Scott
County, Minnesota, and the South One-Half of the vacated alley lying adjacent to said
Lots 2, 3, and 4;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SHAKOPEE, MINNESOTA, as follows:
That the Registered Land Survey submitted by Scott Wirth and Generation Homes is hereby approved,
subject to the following conditions:
1. The structures are to be designed to ensure compliance with all setback requirements.
2. Separate sanitary sewer, storm sewer and water services shall be provided.
3. Submit a revised survey prior to recording that includes the required easements and
sanitary sewer/water service information.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and
directed to approve and accept said Registered Land Survey.
