SUBJECT: New Legislation Relating to 2:00 a.m. Closing for On
Sale Alcohol Licensees

INTRODUCTION:
Staff is asking for direction on whether or not Shakopee will
allow the sale of liquor and 3.2 beer until 2:00 a.m. as recently
authorized by the state legislature.
BACKGROUND:
Recent legislation has been adopted that will allow the sale of
liquor and 3.2 beer, on sale, until 2:00 a.m. beginning July 1,
2003, upon receipt of a permit from the Commissioner of Public
Safety. Current city ordinance allows the sale of alcohol on any
day or during any hour, when Minnesota statues permit sales. The
city ordinance does not need to be changed if City Council desires
to go with the 2:00 a.m. new legislation. The new 2:00 a.m.
closing will be automatic in Shakopee.
At the June 3, 2003, city council meeting, staff was asked to
check with neighboring cities to determine how they plan on
addressing the new law.
Chaska - city code sets hours according to state law for liquor
and specifically sets 1:00 a.m. for 3.2 beer sales. Chaska plans
on asking licenses what they want, they have not heard from any
yet, and taking the matter to the city council. They are inclined
to stay at the 1:00 a.m. closing, but it will depend upon what
other cities do as well.
Prior Lake - city code is silent on hours of sale, except Sunday
is set for 1:00 a.m. No one has brought up the matter, yet. The
Police Chief will be advising the City Administrator and Mayor
informally.
Savage - city code sets hours at 1:00 a.m. They may be having a
public hearing and get feed back from the licensees as well as the
public before making a decision.

Chanhassen - city code sets hours according to state law. They
plan on bringing the change in the hours to a work session for
discussion.
Burnsville - city code sets hours at 1:00 a.m. They are having a
meeting in July to get information from the businesses.
Bloomington - city code sets hours at 1:00 a.m. The city attorney
is working on an ordinance change going to 2:00 a.m.
Eden Prairie - city code sets hours according to state law. No
decision has been made yet on the 2:00 a.m. closing.
ALTERNATIVES:
l. Do nothing, hours of sale will automatically go to 2:00 a.m.
on July 1st
2 . Change hours to require sales to cease at 1:00 a.m.
3. Hold public hearing on whether or not to extend hours
4. Wait to see what other communities do. Waiting to see what
other communities do will not stop the 2:00 a.m. closing from
becoming effective July 1st due to the way the Shakopee
ordinance is written. However, Council could adopt an
ordinance to change the hours to the 1:00 a.m. closing at the
July 1st Council meeting and wai t and see what other cities
do. If it is later determined to go with the 2:00 a.m.
closing, Council could then adopt another ordinance allowing
for the 2:00 a.m. closing.
ACTION REQUESTED:
Discuss and direct staff as desired.
