Valley View Road Improvements, from the
East Plat Line of Pheasant Run 6th to the
East Plat Line of Greenfield, Project No. 2003-4

INTRODUCTION:
Attached are letters accepting the City's offer for permanent and temporary easements
associated with the Valley View Road Improvement, Project No. 2003-4, from the owner
of the Gene Hauer Farm parcel and the owner of the John O'Loughlin parcel adjacent to
Valley View Road.
BACKGROUND:
Attached are letters of offers from WSB & Associates, Inc. to the property owners
adjacent to the Valley View Road improvement project. These offers were made after
discussions with the appraisers hired in association with this project, and based on recent
court decisions that the City did receive on previous easement acquisitions on the
previous Valley View Road Project. These offers have been accepted in writing by both
of the property owners affected and staff recommends Council authorization of payment
to these property owners in the amounts listed in the offer letters. Also attached for
Council reference and consideration of this agenda item is a sketch of the easement area
sent to the property owners with the offer from staff.
ALTERNATIVES:
1. Approve a motion to authorize payment of $6,908.04 to the owners of Parcel No.
27-920005-0 and authorize payment of $10,446.04 to the owners of Parcel No.
27-920009-0.
2. Deny the easement acquisition.
3. Table this item for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Approve a motion to authorize payment of $6,908.04 to the owners of Parcel No. 27-
920005-0 and authorize payment of $10,446.04 to the owners of Parcel No. 27-920009-0.

Dear Mr. Hauer:
Attached please find a copy of the figure identifying the permanent and temporary easement
requirements for the above-referenced project. The City is proposing to acquire a lO-foot
drainage and utility easement along the length of your property to accommodate the needs of
the private utility companies. This is necessary since the project includes a 5-foot concrete
sidewalk located along the property line. In addition, permanent easement is required for the
future extension offudependence Drive to complete the intersection at that location. We have
also identified temporary easement needs to accommodate construction of watermain and
street construction, as is shown on the attached figure.
Prom conversations with the Public Works Director, Bruce Loney, it is my understanding that
a recent agreement with your family for property acquisition amounted to 69<:: per square foot
for permanent easement, and 7.5<:: per square foot for temporary easement. Based on a recent
conversation with you, the permanent easement was increased to 77 <:: per square foot to
account for recent property value increases. The City is willing to process payment in those
amounts to you for acquisition of the necessary easements for construction of this project. A
breakdown of the estimate of payment is identified as follows:
Permanent Easement: 8,817 square feet x 77 <:: / square foot = $ 6,789.09
Temporary Easement: 1,586 square feet x 7.5<::/square foot = $ 118.95
Total = $ 6,908.04
Please give me a call at (763) 287-7190 if you have any questions or comments regarding this
letter. If this is acceptable, we will process the necessary easement documentation and provide
you with the payment. Please note that both affected property owners are being paid the same
amount per square foot for right-of-way acquisition. Thank you for your cooperation.

foot for permanent easement, and 7.59 per square foot for temporary easement. Based on a
recent conversation with Terry Hauer, the permanent easement was increased to 779 per
square foot to account for recent property value increases. The City is willing to process
payment in those amounts to you for acquisition of the necessary easements for construction of
this project. A breakdown of the estimate of payment is identified as follows:
Permanent Easement: 13,487 square feet x 77 9/ square foot = $10,384.99
Temporary Easement: 814 square feet x 7.59/square foot = $ 61.05
Total = $10,446.04
