SUBJECT: A.C.c. 2nd Addition Wetland Replacement Plan

INTRODUCTION:
Associated Capital Corporation has submitted a complete Wetland Replacement Plan
application. Staff along with a Technical Evaluation Panel (TEP) has reviewed the application
and determined the requirements of the Wetland Conservation Act (WCA) have been met by this
plan. The replacement plan must be acted upon by the City Council in their roll as the Local
Governing Unit (LGU) for the WCA of 1991. Attached for Council consideration is Resolution
No. 5924, a resolution approving the Wetland Replacement Plan for A.C.C. 2nd Addition.
BACKGROUND:
The Wetland Replacement Plan, as proposed by Associated Capital Corporation, would fill
approximately 0.097 acres of wetland. The impacted wetland is proposed to be replaced by
constructing approximately 0.196 acres of new wetland.
The City requested a site visit and review of the plan by the TEP, which consists of a City staff
member, a representative from the Soil and Water Conservation District (SWCD) and a
representative from the Board of Soil and Water Resources (BWSR). The TEP, established by
the WCA, provides professional, technical review of wetland issues to the LGD. The TEP has
reviewed the site and the replacement plan and is recommending approval of the plan contingent
upon a monitoring plan submittal (see attached letter and Wetland Replacement Plan). On July
21, 2003, City staff and the SWCD received a monitoring plan that fulfills the requirements of
the WCA. City staff and the TEP now consider the application complete.
The Wetland Replacement Plan is being proposed to accommodate a local street providing a
second access/exit to/from the A.C.C. 2nd Addition. The alignment of the street was designed so
as to minimize the amount of existing wetland impacted.
ALTERNATIVES:
1. Adopt Resolution No. 5924.
2. Deny Resolution No. 5924.
3. Table for additional information from staff.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer Resolution No. 5924, A Resolution Approving a Wetland Replacement Plan for
Associated Capital Corporation and move its adoption.

A Resolution Approving A Wetland Replacement Plan
For Associated Capital Corporation 2nd Addition
WHEREAS, the City has received a Wetland Replacement Plan from Associated
Capital Corporation (A.C.C.) for the proposed A.C.C. 2nd Addition; and
WHEREAS, the applicant has demonstrated that the proposed Wetland
Replacement Plan complies with Minn. Rules Parts 8420.0540 and 8420.0550; and
WHEREAS, all interested parties on file in the office of the City Engineer or
identified in Minn. Rule 8420.0230 have been mailed notice of the proposed Wetland
Replacement Plan; and
WHEREAS, the Technical Evaluation Panel reviewed the proposed Replacement
Plan and considered the public values, location, size and type of wetland being altered
and recommended approval of the Wetland Replacement Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA:
1. Based on the replacement standards in Minn. Rules Parts 8420.0630, and
on the recollunendation of the Technical Evaluation Panel, the Wetland
Replacement plan is hereby approved.
2. Approval of the Wetland Replacement Plan shall become effective upon
its adoption.
3. A copy of this decision shall be mailed to all interested parties and to the
applicant.

A review of the wetland replacement plan application for the A.c.e. Second Addition site was completed by
the Scott Soil and Water Conservation District (SWCD). The project is located in the SW 1/4 of Section l8,
Tl15N, R22W, City of Shako pee, Scott County, Minnesota. The following comments and/or suggestions are
submitted for your consideration:
. Enclosed is a checklist completed by the Scott SWCD indicating that the only component missing from
the application is the wetland monitoring plan. Monitoring is an integral part of wetland replacement. It
identifies the success and failure of wetland restoration and creations. In order for this application to be
considered complete, a monitoring plan is needed. Monitoring of replacement wetland must occur for a
minimum of five years unless a longer or shorter monitoring period is specified by the Teclmical
Evaluation Panel in accordance with Minnesota Rules, part 8420.06l0. Annual monitoring reports must
be submitted to the LGU and the reports must include, at a minimum, the information listed in Minnesota
Rules, part 8420.0620.
. Once a monitoring plan is submitted for this project, the LGU could consider this application complete
and make decision. The LGU should notice their decision to the appropriate agencies. A Grading Permit
should not be issued to the applicant until proper approvals have been received from the LGU for any
proposed wetland drain, excavate or fill activities.
. The Scott SWCD supports the approval of the Wetland Replacement Plan upon receipt of the monitoring
plan.

Note 1: For replacement wetlands located on pipeline casements, you need to receive endorsement of your project from both the easement holder and the Minnesota
Department of Public Safety's Office of Pipeline Safety. Before start of construction, tile owner of any utilities must be notified. The landowner or contractor is
responsible for giving this notice by calling "Gopher State One-Call" at 652-454-0002 (Twin Cities Metro Area) or 1-800-252-1166 (all other locations).
Note 2: For extensive or complex projects supplementary infonnation may be requested at a later dated from one or more of the responding agencies.
Such infomlation may include (but not be limited to) the following: topographic map, water table map, soil borings, depth soundings, aerial photographs,
environmental assessment and/or engineering reports.

5. PROJECT PURPOSE, DESCRIPTION AND DIMENSIONS:
The proposed residential subdivision is proposed to help fulfill the demand for more housing
in the Shakopee area. As part of the development, it is necessary to fill a narrow flow-
through portion of a Type 7 wetland to provide for street construction.
There is no standing or open water within the fill area of the wetland. Prior to any filling
activity, necessary sediment and erosion control items such as silt fence shall be in place.
The proposed fill activity will occur as soon as authorization from the LGU is provided.
6. PROJECT ALTERNATIVES:
The project alternatives looked at were to "Do Nothing", an alternative route, and the
current plan of filling. The alternatives will be looked at in more detail below:
"Do Nothing"
The do nothing alternative was not considered a viable option due to the development
potential of the land and the resulting minimal wetland impacts.
Alternative Route
The existing development in the area, existing wetlands, and site topography made an
altemative route impossible. City requirements dictated that another entrance to the
development be provided and the only possible connection involved traversing the wetland
shown in the proposed plan.
Proposed Plan
The proposed plan was considered the best alternative due to the small amount of wetland
impacted and the capability of doing on-site mitigation. The proposed plan actually
provides an oppOliunity to improve the existing wetland over current conditions where the
impact occurs.

SOILS INFORMATION FOR CREATED REPLACEMENT WETLANDS
Shallow excavations will be perfo1TI1ed to accommodate the hydrology for the created wetlands.
Soils pits perfo1TI1ed near these areas during the wetland delineation indicate an A Horizon, 0-16
inches deep with a matrix color of I OYR 2/1. The B horizon, 16-24" in depth had a matrix color of
10YR 3/2 and mottles 10YR 5/6 and 5YR 5/2.
Soil borings indicate the presence of the parent material being 10YR 3/2. This information
indicates the parent materials in this area are capable of developing hydric conditions. In addition,
the thick A horizon will be restored after the excavations if field conditions wal1'ant.

The applicant agrees to monitor wetland mitigation areas as per the Minnesota Wetland
Conservation Act and Minnesota Rule 8420.0600. The monitoring will extend for a
period of five years, unless adjusted based on an evaluation and recommendation from
the TEP. An annual monitoring report shall be submitted to the City of Shakopee (LGU)
and Scott County SWCD by December 31 of each year.
The monitoring plans shall include:
