Statutes, Chapter 428A. MEETING DATE: August 6, 2003 Introduction The City Council is asked to: . Adopt a resolution calling a public hearing on a proposed ordinance establishing the Downtown Shakopee Special Service District pursuant to Minn. Statutes, Chapter 428A, and . Adopt a resolution calling a public hearing on a proposed resolution imposing a service charge in the Downtown Shakopee Special Service District pursuant to Minn. Statutes, Chapter 428A. At its June 10, 2003 meeting the ED Advisory Committee unanimously passed a recommendation advising the City Council to undertake the necessary initial steps in establishing a downtown special service district, including accepting petitions and calling for public hearings. See Exhibit A, excerpt from ED Advisory Committee meeting minutes of June 10, 2003. The volunteers of the Vision Shakopee Downtown Partnership (VSDP) and City economic development staff have been working persistently at revitalizing the downtown area. Some of the accomplishments of this collaboration include streetscape / landscape improvements, rehabilitation of numerous buildings, 8-6-03PetitionMo.doc installation of parking direction signs, filling vacant parcels with new buildings and businesses, attracting new businesses, helping existing businesses expand, joint promotions and advertising to attract shoppers, and enhancement plans for Huber Park. This has resulted in a vibrant downtown that has low vacancy, maintained healthy property values, is in demand among new and expanding businesses, has garnered further investment, and is considered by other communities as a good representation for downtown revitalization. To improve and solidify this effort of enhancing downtown's economy, VSDP is proposing the creation of a Special Service District for downtown Shakopee which is based upon the "benefit assessment district" concept, in which property owners within a demarcated district, through petition support, agree to assess themselves to generate revenues that benefit the district, providing services and improvements that the City does not currently provide, and for services that enhance or add to the level of service currently provided by the City. Petitions are being presented to you by VSDP to initiate the process of establishing the district and related service charge. Cities in Minnesota are authorized to adopt an ordinance establishing a "special service district" under Minnesota Statutes, Sections 428A.01 through 428A.1 01 (the "Special Service Act"). The process involves 1.) Adoption of an ordinance to establish the special service district; and 2.) Adoption of a resolution setting the service charges in the amount necessary to produce revenue required to fund the special services. The first step in the process is for the City Council to pass a resolution calling for a public hearing on an Ordinance establishing a Special Service District, and pass a resolution calling for a public hearing on the Resolution imposing a service charge for the District. Subsequent steps in the process can be found in Exhibit B, Special Service District Schedule. Background Special Service District Description Special Service Districts (SSDs), also known in many other states as "Business Improvement Districts", are a type of assessment district commonly located within the core commercial district or a historic downtown of a city, in which property owners choose, through a petition process, to be assessed a fee, which is collected on their behalf by the City, for use in promoting and improving the commercial district. Tasks commonly performed by SSDs are streetscape improvements, trash removal, maintenance, place marketing, business retention and recruitment, promotion of activities and events, consumer marketing, and security. The types of activities generally varies from large city to smaller city service districts, with larger districts focused on improving and maintaining the public environment, making major outlays for activities such as labor-intensive sidewalk cleaning and supplementary security as well as for major streetscape capital improvements. Districts in smaller cities tend to focus on promotions, special events, joint advertising, seasonal lighting, small-scale streetscape I storefront design, and business retention, expansion, and attraction. Before implementation of a Special Service District, a "municipal services agreement" between the SSD organization (VSDP) and the City would be reached on the level of city services provided. Once a baseline of services provided by the City has been established (typically services that the City has normally provided in the recent past), the amount and frequency of services performed by the City continues after formation of the SSD. Why A Special Service District for Downtown Shakopee? . To establish private-sector control and accountability. An advisory board (VSDP) consisting of downtown property and business owners manages the district. Annual district work plans and budgets are developed by the board, ensuring that the district will be accountable to those who pay the assessment. Programs such as maintenance, streetscape improvements, marketing, special events among others are subject to private-sector performance standards and controls. Enclosed is Exhibit C, 2004 Downtown Shako pee Special Service District Budget, and Vision Shako pee Downtown Partnership Work Plan, 2004 - 2008 . In partnership with the Shakopee Economic Development Authority and EDA staff, retain and assist in the expansion of existing businesses, assist with new business development, and attract new business and real estate development. Many downtowns continue to experience high vacancy rates and decrease in investment. A more attractive downtown will accelerate efforts to bring new businesses and investment back into the district, and increase the commercial property tax base. . To create a unified voice for the downtown. A Special Service District will provide the foundation for developing a viable and unified voice for the downtown. For most downtown areas, interests are fragmented among a many groups and individuals. One unified management entity, with reliable resources, increases a downtown district's ability to work effectively with the local government and other civic and social organizations in the community. Establishing the Special Service District Before the City Council adopts an ordinance that establishes the special service district, owners of at least 25 percent of the land area of property that would be subject to the service charge in the proposed district and owners of at least 25 percent of the net tax capacity of property that would be subject to service charges in the proposed district must file a petition requesting a public hearing on the proposed action with the City Clerk. Ifthat petition is filed, the City will publish a notice ofthe hearing and mail a copy to the owner of each property in the proposed district. The ordinance will describe the area within the City to be included in the district and the special services to be furnished in the district. The ordinance may be adopted at any time within six months after the public hearing on the ordinance. Before the ordinance is adopted, owners of property in the proposed district have the right to file written objections regarding inclusion of their parcel in the district or imposition of a service charge, with a right of appeal to district court if the City Council determines against the property owner. Also, the ordinance will not go into effect if owners of at least 35 percent ofthe land area subject to the service charge based on net tax capacity or owners of at least 35 percent of the net tax capacity in the district subject to the service charge based on net tax capacity file a written objection with the City Clerk within 45 days after the ordinance is adopted. Imposing the Service Charge Before the City Council adopts a resolution imposing a special charge for the special services based on net tax capacity, owners of at least 25 percent of the land area subject to the proposed service charge and owners of at least 25 percent of the net tax capacity subject to a proposed service charge must file a petition requesting a public hearing on the proposed action with the City Clerk. If a petition is filed, the City will publish a notice of the hearing and mail a detailed notice to all individual or business organizations subject to the service charges. Charges for service must be as nearly as possible proportionate to the cost of furnishing the service, and will be fixed on the basis of the service directly rendered, or by reference to a reasonable classification of the type of premises to which the service is furnished, or any other equitable basis. The proposed service charge is 8% of net tax capacity with a minimum of $150 in the core downtown area; see Exhibit D, Special Service District map. The resolution imposing the service charges may be adopted at any time within six months after the public hearing on the service charges. The resolution will not go into effect if owners of at least 35 percent ofthe land area subject to the service charge based on net tax capacity or owners of at least 35 percent ofthe net tax capacity subject to the service charge based on net tax capacity file a written objection with the City Clerk within 45 days after adoption of the resolution. Petitions The VSDP volunteers collecting the petition signatures have exceeded the statutory threshold of owners of at least 25 percent of the land area subject to the proposed service charge and owners of at least 25 percent of the net tax capacity needed to sign the petition to request the public hearing. The volunteers have collected signatures representing owners of 61 % of the net tax capacity, and 47% of the land area subject to the proposed service charge. The petitions are attached as Exhibit E. STATUTES, CHAPTER 428A. WHEREAS, the City Council of the City of Shakopee ("City Council") is authorized to adopt an ordinance establishing a "special service district" under Minnesota Statutes, Sections 428A.01 to 428A.101 (the "Special Services Act" or "the Act"); and WHEREAS, only property that is classified under Minn. The purpose of the District is to finance various special services (as described below) through service charges imposed against commercial and industrial property in the District that is benefited by the services. Details regarding the hearing, the special services and the service charges are described below: 1. Persons to be heard: All interested persons will be given an opportunity to be heard at the hearing regarding a proposed service charge. 2. Proposed Special Services. The special services include various activities to promote and improve downtown Shakopee, including: promoting the District to shoppers, investors and tourists; providing assistance to businesses in marketing, design and business maintenance; and providing capital improvements in the District such as signs, graphic materials, and streetscape improvements. The City anticipates that the special services will be provided under an agreement with Vision Shakopee, a nonprofit corporation organized to carry out downtown improvement activities. 3. Estimated cost of improvements. A portion of the special services to be provided in 2004 may include streetscape improvements, such as benches and planters, banners and flags, landscaping, holiday lights, entry signs, and awnings. The total estimated costs for these improvements in 2004 is approximately $11,000. The City does not anticipate significant long-term maintenance costs for such improvements upon completion. These improvements would be financed through a combination of service charges imposed against the District along with other revenues of Vision Shakopee. Special services in future years may include additional or similar improvements in the District, to be determined at the time the service charge for each calendar year is determined. The total estimated cost of special services to be financed with the special service charge in 2004 (including the above streetscape improvements) is approximately $16,050. EMT-219091vl SH155-102 4. Proposed Service Charge Rate. The proposed service charge for the proposed district for 2004 is 8% of net tax capacity, with a minimum charge of $150 per tax parcel. The service charge will be imposed for a maximum of 6 years (2004 through 2009). Each year after the initial service charge for 2004, the rate will be determined based on the estimated budget of special services, including both capital improvements and other services. The rate imposed in any calendar year will not exceed the rates described above for 2004. The City Council may determine in any year to discontinue the special service charge and terminate the District. 5. Petition Requirements of Section 428A.08 Met: Owners of at least 25 percent of the land area of property that would be subject to service charges in the District, owners of 25 percent or more of the net tax capacity of property that would be subject to service charges in the District, and at least 25 percent of the individuals and businesses subject to the portion of the service charge not based on tax capacity have filed "Petitions to hold a Public Hearing for a Resolution Imposing a Service Charge Within a Special Service District for the Downtown Area." Downtown Special Service District Snook explained that the Vision Shakopee Downtown Partnership is interested in pursuing the establishment of a special service district (SSD) as was attempted last year. An SSD is based on a property tax. Owners agree to pay an assessment to generate revenues for the revitalization effort. A certain percentage of the property owners must support a petition to the city to implement the tax district. To establish the district, the city has to adopt a local ordinance, which defines the boundaries, the properties affected, the assessment structure, timetable of implementation, use of funds, and description of the special service district, in this case, the core downtown area as represented mostly by the B-3 zoning district. Property owners pay their assessments annually, usually with their regular property taxes The revenue is turned over to the organization administering the district, in this case, Vision Shakopee Downtown partnership. Jansen emphasized that an SSD would be a good tool for long term revitalization of downtown. Langdon offered a motion to recommend that the City Council undertake the necessary steps (accept petitions and calling for public hearings) in establishing a downtown special service district. Within a special service district, the City may furnish special services to individual commercial and industrial properties, which are fInanced by service charges imposed on the owners of the properties. The process involves two steps: adoption of an ordinance to establish the special service district; and adoption of a resolution setting the service charges in the amount necessary to produce revenue required to pay for the special services. Establishing the Special Service District Before the City Council adopts an ordinance that establishes the special service district, owners of at least 25 percent of the land area of property that would be subject to the service charge in the proposed district and owners of at least 25 percent of the net tax capacity of property that would be subject to service charges in the proposed district must file a petition requesting a public hearing on the proposed action with the City Clerk. If that petition is filed, the City will publish a notice of the hearing and mail a copy to the owner of each property in the proposed district. The ordinance will describe the area within the City to be included in the district and the special services to be furnished in the district. The ordinance may be adopted at any time within six months after the public hearing on the ordinance. Before the ordinance is adopted, owners of property in the proposed district have the right to file written objections regarding inclusion of their parcel in the district or imposition of a service charge, with a right of appeal to district court if the City Council determines against the property owner. Also, the ordinance will not go into effect if owners of at least 35 percent of the land area subject to the service charge based on net tax capacity or owners of at least 35 percent of the net tax capacity in the district subject to the service charge based on net tax capacity file a written objection with the City Clerk within 45 days after the ordinance is adopted. Imposing the Service Charge Before the City Council adopts a resolution imposing a special charge for the special services based on net tax capacity, owners of at least 25 percent of the land area subject to the proposed service charge and owners of at least 25 percent of the net tax capacity subject to a proposed service charge must file a petition requesting a public hearing on the proposed action with the City Clerk. If a petition is filed, the City will publish a notice of the hearing and mail a detailed notice to all individual or business organizations subject to the service charges. Charges for service must be as nearly as possible proportionate to the cost of furnishing the service, and will be fIxed on the basis of the service directly rendered, or by reference to a reasonable classification of the type of premises to which the service is furnished, or any other equitable basis. The resolution imposing the service charges may be adopted at any time within six months after the public hearing on the service charges. The resolution will not go into effect if owners of at least 35 percent of the land area subject to the service charge based on net tax capacity or owners of at least 35 percent of the net tax capacity subject to the service charge based on net tax capacity file a written objection with the City Clerk within 45 days after adoption of the resolution.
