Michael Leek, Community Development Director SUBJECT: Comprehensive Plan Amendment to Reguide Property from Business Park to Medium Density Residential and Open Space MEETING DATE: August 6, 2003 REVIEW PERIOD: April 24 - August 22, 2003 CASELOG NO.: 03-051 INTRODUCTIONIDISCUSSION: ~ On April 24, 2003 the Ryan Companies filed a request to amend the Comprehensive Plan to reguide 69 acres in Valley Green Business Park from "Business Park" to "Medium Density Residential." The subject site is currently guided Commercial and Business Park, and the resulting guiding would be Commercial, Business Park, Medium Density Residential and Open Space (See Attached June 5th memo to the Planning Commission). The April 24th request was reviewed by the Planning Commission at the public hearing on June 5, 2003, at which time it heard from members ofthe public. After the public hearing was closed, the Planning Commission voted unanimously to recommend to the City Council denial of the request to re- guide 69 acres from "Business Park" to "Medium Density Residential." By letter dated July 29, 2003, Ryan Companies has revised their request to re-guide 42 acres from "Business Park" to "residential PUD," and to depict the proposed open space as such (See color "Proposed Land Use Exhibit," dated 7/24/2003). While the Planning Commission has not reviewed the revised request, it should be noted that in February of2002, Ryan had submitted a comprehensive plan amendment request that would have re-guided 60.9 acres from "Commercial" to "Business Park," and 57.7 acres (including areas that were contemplated to be open space) from "Business Park" to "Medium Density Residential." That request was reviewed by the Planning Commission, which recommended approval contingent on the completion and adoption of the first revision to the AUAR for the project (See attached April 12, 2002 memorandum to the Planning Commission and November 19, 2002 memorandum to the City Council). The applicant withdrew the request before the Council was to act on it on November 19, 2002. The concept PUD plan that was associated with the comprehensive plan amendment request was reviewed by both the Planning Commission and City Council in association with the "Public Values" analysis that had been done by Jeff SchoenbauerlBrauer on behalf of the City of Shakopee. Offer and pass a motion directing staff to prepare a resolution approving the revised request of Ryan Companies to re-guide 42 acres from "Business Park" to "residential PUD" and changing the designation of another 84 acres to "Open Space" for action at its August 19, 2003 meeting. This action would require a simple majority vote. Under the City's Zoning Code, the resolution would require a 2/3' s vote. 2. Offer and pass a motion directing staffto prepare a resolution approving an alternative comprehensive land use change. 3. Offer an pass a motion directing staff to prepare a resolution of denial for adoption by the Council on August 19, 2003 4. Direct staff to have the Planning Commission review the revised request at its next meeting. The Commission next meets on Thursday, August 7,2003. A copy of this report has been provided to the Commission members in the event the Council directs this action. 5. Table the matter for additional information, with direction to bring the item back on the August 19,2003 Council agenda. PLANNING COMMISSION RECOMMENDATION: As noted above the Planning Commission on June 5th voted to recommend denial of the original request to re-guide 69 acres to "Medium Density Residentia1." The Planning Commission has not reviewed the revised request, although they did review a similar request in 2002, and at that time had recommended approval of the ten-proposed changes. ACTION REQUESTED: Offer a motion consistent with the Council's wishes and move its adoption. /~~./~ R. This revised request is based on the feedback we received from the Planning Commission at their June meeting. The Planning Commission made it vetyclear that 69 acres of residential development is too large in the Valley Green Corporate Center. Therefore, our revised plan now calls for a reduction in residential area from 69 acres to 42 acres, which is approximately the same size previously seen by the Oty Council and reviewed by the Planning Commission in April of 2002. We intend to follow the Oty's POO process to develop the specific plans for the Valley Green Corporate Center project. For that reason, a land use designation on the 42 acres that defines it for "residential POO" use would be desirable. This process would allow us to move forward with creating the detailed plans and applications so that we may get input on those detailed plans from the Oty's Environmental AdvisotyCommittee, Parks and Recreation Advisoty Board, Planning Commission, and Oty Council. Because the project area was the subject of an Alternative Urban Area Wide Review (AUAR), and because the proposed changes are significant, a supplement to the Revised Final Alternative Areawide Urban Review (FAUAR) was prepared, during which review of the plan amendment request was suspended. At the October 22, 2002 workshop, the City Council approved the Supplement to the Revised FAUAR. SITE DATA: Applicant: Ryan Companies U.S., Inc. Property Owner: Valley Green Business Park Location: South ofSTH 169; west of Dean Lake; north of the CSAH 16; and east of CSAH 83 Adjacent Zoning: North: Business Park (BP) South: Agricultural Preservation (AG) Rural Residential (RR) East: Low-Density Residential (R-1A)/PUD West: Light Industrial (1-1) MUSA: The site is within the current MUSA boundary. 1 ALTERNA 'fIVEs: 1. STAFF RECOMMENDATION: On April 18, 2002 the Planning Commission held the public hearing on the request, and reconunended (5-2) approval of the requested land use changes contingent on completion of the F AU AR revision process. Finding No.2: Significant changes in community goals and policies have not taken place relative to the subject property. Finding No.3: Significant changes have occurred in the neighborhood development pattern. Significant and ongoing demand for quality residential sites coupled with the greater compatibility of residential over business park uses with the adjacent Dean Lake make the proposed change to medium density residential desirable. Reguiding that portion adjacent to CSAH 83 from commercial to business park will provide for better consolidation and long-tenn health of the City's other established and designated commercial areas. Finding No.4 The current comprehensive plan does not require a different provision. Because the project area was the subject of an Alternative Urban Area Wide Review (AUAR), and because the proposed changes are significant, a revision to the AUAR is being prepared. A final decision on the instant request can not be made by the City Council until the AUAR revision has been accepted by the City Council. SITE DATA: Applicant: Ryan Companies U.S., Inc. The Commission and Council have previously seen and reviewed the concept for the property that underlies the request, and have generally indicated a favorable reaction to the concept. Accompanying this report are comments submitted by the Shakopee Public Utilities Commission (SPUC). ALTERNATIVES: 1. Recommend to the City Council the approval of the requested re-guiding from business park to medium-density residential, and from commercial to business park, on the condition that the request not be reviewed by the City Council until completion of the AUAR revision process. 2. Recommend to the City Council the denial of the requested re-guiding from business park to medium-density residential, and from corrunercial to business park. 3. Continue the public hearing to a date certain. 4. Table the matter, and request additional infonnation. STAFF RECOMMENDATION: Because of the ongoing AUAR process, Staff recommends either Alternative' No. 1,3 or 4. I am unable to attend this evening due to a prior commitment. The planning commission would like the chance to review this application if there are any major changes to it since the commission reviewed it. Many members expressed an interest in seeing the project as it was presented in the concept review plan phase. The original concept plan contained both the input from the neighbors as well as many of the concepts of our PRD zone. Thank you for your time and consideration.
