SUBJECT: Preliminary/Final Plat - Valley Park 15th Addition

REVIEW PERIOD:
INTRODUCTION:
Valley Green Business Park has made application for preliminary plat and final plat approval of
Valley Park Fifteenth Addition, which is essentially a re-plat of property originally platted in
Valley Park 1ih Addition.
CONSIDERATIONS:
Other staff was provided the opportunity to provide comments regarding this application. The
following comments were received;
. The City Clerk noted that the signature block for the Planning Commission should be
removed. The City Clerk also referenced the park dedication requirements contained
in the resolution of approval for Valley Park 12th Addition.
SPUC ha s commented that the applicant should contact them directly regarding the specific
utility requirements that may apply to this plat, as well as the new rates that have been
established by the Commission.
ALTERNATIVES:
1. Approve Resolution No. 5921, a resolution approving the preliminary and final plat of
V ALLEY PARK FIFTEENTH ADDITION subject to the conditions as proposed.
2. Approve Resolution No. 5921 with revised conditions.
3. Recommend delaying the approval of the Final Plat until the Preliminary Plat conditions
are met.
4. Deny the request for preliminary and final plat approval of V ALLEY PARK FIFTEENTH
ADDITION, and direct staffto prepare a resolution of denial for action by the Council on
August 19,2003
6. Table a decision in order to allow time for the applicant and/or staffto provide additional
information.
PLANNING COMMISSION RECOMMENDATION:
The Planning Commission reviewed the proposed preliminary plat on July 17, 2003, and
recommended approval unanimously.
ACTION REQUESTED:
Offer a motion approving Resolution No. 5921, a resolution approving the preliminary and
final plat of V ALLEY PARK FIFTEENTH ADDITION subject to the conditions as proposed.

RESOLUTION NO. 5921
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
PRELIMINARY AND FINAL PLAT OF VALLEY PARK FIFTEENTH ADDITION
WHEREAS, Valley Green Business Park, L.L.C., applicants and property owners, have
made application for Preliminary and Final Plat approval of V ALLEY PARK FIFTEENTH
ADDITION; and
WHEREAS, the subject property is legally described as Lot 3, Block 2, VALLEY
PARK TWELFTH ADDITION, lying East ofthe West 968.00 feet thereof, Scott County,
Minnesota:
WHEREAS, the Shakopee Planning Commission reviewed and recommended approval
of the Preliminary Plat on July 17, 2003; and
WHEREAS, all required public notices regarding the public hearing were duly sent and
posted and all persons appearing at the hearing have been given an opportunity to be heard; and
WHEREAS, the City Council of the City of Shakopee did review the Preliminary and
Final Plat of V ALLEY PARK FIFTEENTH ADDITION on August 6, 2003; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
That the Preliminary and Final Plat of V ALLEY PARK FIFTEENTH ADDITION is approved
subject to the following conditions:
1. The following procedural actions must be completed prior to the recording of the final
plat:
a. Approval oftitle by the City Attorney.
b. Removal of the signature block for the Planning Commission
c. Payment of any fees related to the plat as may be required by the most current City
of Shakopee Fee Schedule.
d. The applicant shall provide the Engineering Department electronic (Auto CAD)
files of the Final Plat.
e. Street lighting, if any, to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
f. Electrical system to be installed in accordance with the requirements of the
Shakopee Public Utilities Commission.
g. Water system to be installed in accordance with the requirements of the Shakopee
Public Utilities Commission.
h. Installation of storm sewer systems in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of Shakopee.
1. The developer shall be responsible for payment of engineering review fees, and
other fees as required by the City's adopted Fee Schedule.
J. Park Dedication fees shall be paid at the time of building permit. The fees due will
be in an amount consistent with the adopted fee schedule in place at the time of
building permit issuance.
2. Following approval and recording ofthe final plat, the following conditions shall
apply:
a. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
b. All existing easements are retained.
c. Final grading, utility connections and access to city streets will need approval by
the engineering department
d. All outstanding fees will still apply.
THEREFORE, BE IT FURTHER RESOLVED, that approval ofthe Preliminary
and Final Plat of V ALLEY PARK FIFTEENTH ADDITION does not constitute a
representation or guarantee by the City of Shakopee as to the amount, sufficiency or level of
water service that will be available to lots within the plat as they are developed.

6. Close the public hearing, but table a decision in order to allow time for the applicant and/or

STAFF RECOMMENDATION:
Staff recommends Alternative No.1, recommend approval to the City Council with
conditions.
ACTION REQUESTED:
Offer a motion to recommend to the City Council approval of the preliminary plat of
VALLEY PARK FIFTEENTH ADDITION subject to the conditions outlined in Alternative
No.1.

The application indicates a Preliminary and Final Plat is proposed for Valley Park 15th
Addition. After reviewing the referenced application, I have the following comments for
the applicant, and for the planning department:
Sanitary Sewer/Watermain/Storm Sewer/Ponding/Street
As part ofthe Valley Park lih Addition and 1ih Avenue street and utility constmction
sanitary sewer, storm sewer, watermain, ponding, and street systems have been put in
place to serve this proposed plat.
Recommendation
1. Recommend approval of the Preliminary Plat and Final Plat subject to the
following conditions:
a. All existing easements are retained.
b. Final grading, utility connections and access to city streets will need
approval by the engineering department.
c. All outstanding fees will still apply.
