for Pedestrian Bridge and Rail Crossings

INTRODUCTION:
This agenda item is intended to request City Council approval to proceed with submittal
of projects for Federal Funding in the Transportation Equity Act for the Twenty-First
Century (TEA-21). City staff has identified in the Capital Improvements Program for a
pedestrian bridge over T.R. 169 east of C.R. 83, rail crossing improvements at Spencer
Street and Sommerville Street for possible projects that could be funded by this program.
BACKGROUND:
The TEA-21 bill has been approved by the Federal Government and Metropolitan
Council and MN/DOT are now receiving project submittals for possible funding within
this program. The TEA-21 program has three areas primarily with funds allocated to it
and they are as follows:
. Surface Transportation Program (STP)
. Congestion, Mitigation! Air Quality Program (CMAQ)
. Transportation Enhancement Program (TEP)
Approximately $58 million dollars is anticipated to be available for STP projects for the
years 2007 through 2008. The TEP will have almost $11 million for the same period and
the CMAQ projects will may have as much as $34 million available but, over a period
from 2007 through 2008.
Mn/DOT Metropolitan Division also has a program that is separate from these three
programs that are handled by the Metropolitan Council and these programs are for
bridges, safety and hazard elimination projects. This particular program is where rail
crossing improvement programs and safety improvements can be applied for. As
mentioned previously, the City has two projects that could potentially quality for Federal
Funds under the TEA-21 and they are as follows:

1. Pedestrian bridge crossing over T .H. 169 east of C.R. 83
2. Rail crossing safety improvements at Sommerville and Spencer Street
Under the TEP, projects will be grouped into three categories as well and they are as
follows:
1. Pedestrian and Bicycles
2. Historic
3. Scenic and Environmental
The pedestrian bridge over T.H. 169 east of C.R. 83 could qualify under the TEP as
pedestrian and bicycle improvements. It is proposed by staff to apply this bridge over
T .H. 169 under the TEP category, which Mn/DOT staff recommends for the highest
ranking. In the Capital Improvements Program, staff identified three areas in which there
are no pedestrian walkways and they are at C.R. 15, c.R. 77 and C.R. 83. Staff has
reviewed the priority of each pedestrian/bicycle crossing and feels the priority order is
T.H. 169 to the east ofC.R. 83. The other two pedestrian crossings would not rank high
in a submittal at this time, in staff s opinion.
Under this program, the City could obtain 80% funding from the Federal Government in
order to construct separate pedestrian bridges, bridge approaches and connecting trails
across T.H. 169 to connect to each area ofthe Community on either side ofT.H. 169 with
the pedestrian/bicycle facility. Currently, bridge crossing exists over T.H. 169 and this
bridge would connect the Southbridge area with the Industrial Park.
The second project area is rail crossing safety improvements at Spencer Street and
Sommerville Street. Staff is intending on applying for funds to construct signal warning
lights at these locations, as none exist at these crossings currently. It should be pointed
out that there are signal warning lights at Fuller Street, Holmes Street and Lewis Street
and not at Sommerville and Spencer Street, where there is more traffic crossing the
railroad tracks than at the other three street locations. Funding would be a 50% Federal
and 50% Local.
Submittal deadline of these applicants is August 25, 2003. Also staff will need assistance
from WSB & Associates, Inc. to complete the application. Estimated cost of professional
service is $2,000.00 from the Engineering Professional Service account and funds are
available in the budget.
The action being requested is for Council to direct staff to proceed with submitting
projects for the TEA-21 program for the two projects as mentioned. The submittal
deadline for TEA-21 projects is August 25,2003.
ALTERNATIVES:
1. Approve a motion directing staff to proceed on submitting the T.R. 169 pedestrian
bridge east of C.R. 83, and the rail crossing safety improvements at Sommerville
Street and Spencer Street for TEA-21 funding to the Metropolitan Council and
MnlDOT.
2. Do not submit any projects for possible Federal funding.
3. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1, in order to receive Federal funding for these
projects, which staff believes is needed for the City of Shakopee's infrastructure.
ACTION REQUESTED:
Approve a motion directing staff to proceed on submitting the T .R. 169 pedestrian bridge
east of C.R. 83 and the rail crossing safety improvements at Sommerville Street and
Spencer Street for TEA-21 funding to the Metropolitan Council and MnlDOT.

The Transportation Advisory Board (TAB) to the Metropolitan Council will soon solicit proposals
for 2007 and 2008 projects to use federal transportation funds. Project proposals which directly
impact state highways or state highway rights-of-way will again need to include a letter from
MnDOT indicating, at a minimum, the Department is aware of and understands the project. The
following outlines the process and information we will use to consider requested letters:
1. If you are considering a project proposal that directly impacts a state highway or state highway
right-of-way please get in touch as soon as possible with the appropriate Mn/DOT Metro Area
Manager assigned to that trunk highway corridor, as indicated on the attached map.
The Area Manager will be able to assist in the scoping of your project, an early Mn/DOT
review and the completion of the remainder of this process. This early coordination will help
insure that MnlDOT will be able to write a letter for your project.
2. Requests for support letters only must be received by the Metropolitan Division by
August 6, 2003 at the latest. However, we would appreciate receiving requests much earlier.
MnDOT will consider the following in makin~ its determination of support for a project:
-Project must be consistent with corridor goals or corridor plan recommendations
-Project must not adversely affect trunk highway operations
3. Requests for letters and a financial commitment by MnDOT must be received by July 21,
2003 at the latest. MnDOT will make a determination on its potential financial commitment at
its July 28 Metro Program Committee meeting. Letters will be sent to requesters shortly after
that meeting.

MnDOT will consider the following in deciding on fmancial commitment. Highest priority will be
given to projects that:
. Follow corridor goals laid out in the Transportation System Plan (TSP), i.e. preserve, manage,
improve, expand.
. Are included in the Metro 10- Year Work Plan 2003-2012.
. Address at-risk Interregional Corridors (IRCs), with High Priority IRCs priority over Medium
IRCs.
. Are identified in a study completed sufficiently to identify issues and possible solutions.
. Show partnership potential with local funding availability.
. Have potential for scoring well based on existing TAB criteria.
Ii Demonstrate project readiness.
4. Requests for letters of support should be addressed to:

6. Requests for letters and/or financial commitments must include the following:
a. Project location map
b. Project concept drawing; layout if available.
c. Expected year of construction.
d. A description of the project's impacts on MnDOT right-of-way.
e. A description of the problem and how the proposed project will solve that problem.
f. A description of any related projects or stages.
g. A description of the funding plan, including any expectation of a MnDOT financial
contribution.
h. Identification of a contact person.
Even though the solicitation is not expected until the end of June/early July, if you are considering a
project proposal please contact the appropriate Area Manager as soon as possible. Thank you for

The Metropolitan District of Mn/DOT, on behalf of the seven-county metropolitan area, has been requested to
solicit candidate projects in three project categories for federal funding for the years 2007 and 2008. The three
project categories included in this solicitation are Hazard Elimination Safety, Bridge Improvement Replacement,
and Rail Crossing Safety. The Transportation Advisory Board to the Metropolitan Council is directly soliciting
candidate projects in eight other project categories. You should receive that solicitation at about the same time
you receive this one. Approximately $2.4 million per year is available for the Hazard Elimination Safety
categ01Y, $5 million per year for the Blidge Improvement category, and $1.75 million per year for the Rail
Crossing Safety Program.
The materials available on the following MnlDOT web site, httt>://www.dot.state.mn.us/metro/federalfunding/,
describe the project categories and the qualifying and priority criteria which will be used to prioritize the
candidate projects submitted. Please read the materials from the web site carefully and supply the required
information as completely as possible so that your project can be fully understood by the groups evaluating and
ranking the projects. If you do not have web access, please request a copy of the material from Brian V ollum, at
(651) 582-1408, or Sherry Narusiewicz at (651) 582-1400.
General questions regarding this process should also be directed to Brian V ollum. Questions regarding specific
project categories should be directed to the individual(s) as identified in the solicitation. Address submittals to

MN 55113. Submittals must be received or U.S. postmarked by 5:00 PM, August 25,2003.
