C. {- CITY OF SHAKO PEE Memorandum CONSENT TO: Mayor & City Council Mark McNeill, City Administrator FROM: Bruce Loney, Public Works Director SUBJECT: Declaring a Cost to be Assessed and Establish a Public Hearing for Assessments on 17th A venue, from C.R. 79 to Colonial Street, Project No. 2002-1 DATE: August 19, 2003 INTRODUCTION: Attached is Resolution No. 5935, a resolution declaring a cost to be assessed, orderin* the preparation of proposed assessments and setting a public hearing date for the 17 A venue Improvements, from c.R. 79 to Colonial Street, Project No. 2002-1. BACKGROUND: On August 20, 2002, Resolution No. 5768 was adopted accepting bids and awarding the contract for 17th A venue, from C.R. 79 to Colonial Street. Previously, on July 2, 2002, City Council adopted Resolution No. 5753, a resolution approving the plans and specifications and ordering the advertisement for bids for this project. This project was ordered based on receiving petitions from the developers of Providence Pointe and Westchester Estates. With petitions received for 100% of the assessments associated with this project, a public hearing was not necessary and the City Council could approve a project and order plans and specifications. Staff is recommending a public hearing to be held due to City cost participation of this street collector. The improvements have essentially been completed with the final project costs projections for construction at $698,121.81. The total costs associated with administration and engineering for the project is $222,010.95, therefore, the total costs for the project is $891,269.79. The attached resolution shows how these costs are being paid and the total costs to be assessed. This project financing sources include the City of Shakopee's participation in the oversizing of 17th Avenue as a collector street and assessments to benefiting properties. The funding summary for this project is as follows: Preliminary Report Project Completion City Costs $120,000.00 $222,010.95 Assessments $701,250.00 $669,258.84 Total Costs $821,250.00 $891,269.79 ALTERNATIVES: 1. Adopt Resolution No. 5935. 2. Deny Resolution No. 5935. 3. Adopt Resolution No. 5935, with Council modifications. 4. Table for additional information. RECOMMENDATION: Staff recommends Alternative No.1, to adopt Resolution No. 5935, declaring the costs to be assessed and ordering the preparation of proposed assessments for 17th Avenue improvements, from C.R. 79 to Colonial Street, Project No. 2002-1. A public hearing is proposed to be held on September 16, 2003. ACTION REQUESTED: Offer Resolution No. 5935, A Resolution Declaring the Costs to be Assessed and Order the Preparation of Proposed Assessments for 17th Avenue Improvements, from County Road 79 to Colonial Street, Project No. 2002-1 and move its adoption. eLoney Public Works BUpmp MEM5935 RESOLUTION NO. 5935 A Resolution Declaring The Costs To Be Assessed And Ordering the Preparation Of Proposed Assessments For 17th A venue, From County Road 79 To Colonial Street Project No. 2002-1 WHEREAS, a contract has been let for the construction of 17th A venue, from County Road 79 to Colonial Street including street construction, turn lanes, storm sewer, sanitary sewer, watermain, street lighting, sidewalk, bituminous trail and any appurtenant work as described in the feasibility report, and the contract price for such improvements was $688,375.24, and the final contract price for such improvement is $698,121.81, and the expenses incurred or to be incurred in the making of such improvement amounts to $669,258.84, so that the total cost of the improvements will be $891,269.79. Of this cost the City of Shako pee will pay $222,010.95 as its share of the cost. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: 1. The cost of such improvement to be specially assessed is hereby declared to be $669,258.84. 2. The City Clerk, with the assistance of the City Engineer, shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot, piece, or parcel of land within the district affected, without regard to cash valuation, as provided by law, and keep a copy of such proposed assessment in her office for public inspection. 3. That the City Clerk shall, upon the completion of such proposed assessment, notify the City Council thereof. BE IT FURTHER RESOLVED: 1. That a hearing shall be held on the 16th day of September, 2003, in the Council Chambers of City Hall at 7 :00 P.M. or thereafter, to pass upon such proposed assessments and at such time and place all persons owning property affected by such improvements and proposed assessments will be given an opportunity to be heard with reference to such assessment. 2. That the City Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper of the City of Shakopee at least two weeks prior to the hearing and she shall state in the notice the total cost of the improvements. She also shall cause mailed notice of such hearing to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearing.
