SUBJECT: Request of Classic Protective Coatings, Inc.

INTRODUCTION:
By letter dated August 11, 2003, Classic Protective Coatings, Inc., the contractor for the
ground water tank restoration on 10th A venue for Shakopee Public Utilities Commission
has requested that City Code Sec. 10.60, Noise Elimination and Noise Prevention, Subd.
3, Hourly Restrictions on Certain Operations, D, be suspended for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 A.M. to 9:00 P.M. on weekends and
holidays.
Classic Protective Coatings, Inc. is requesting a suspension on the hours as follows:
Monday thrn Friday 7:00 A.M. to 7:00 P.M.
Saturday and Sunday 8:00 A.M. to 7:00 P.M.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
1. Approval is contingent upon minimizing noise exposure near residential areas.
2. If residential complaints are received by the City, the suspension can be revoked at the
discretion of the City Engineer.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News. Staff
would point out that this ground water tank is located on 10th Avenue near the Women's
Prison and St. Mark's Cemetery. The Contractor has agreed to adjust the schedule if
complaints are received due to the earlier start time. A list of references was requested
and received from the Contractor in working in other Cities. The earlier start time is
being requested in order to complete the work this year.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.
2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

Re: Work schedule for Shakopee, :MN water tank. project.
Classic Protective Coatings, Inc. will be working on the Shakopee, MN ground storage water
tank. We anticipate the work to be performed from August 15th to October 31 2003.
We would like to request the following workweek schedule for the Shakopee, MN ground
storage tank.
. 7 A.M. - 7 P.M. Monday through Friday
. 8 A.M. - 7 P.M. Saturday through Sunday
We have a history of working in densely populated areas without getting any complaints from
the surrounding neighbors. If there were any complaints we would adjust our schedule to
accommodate. We would like to give the following reference to help you in making your
decision
