SUBJECT: Consideration of Allowing a 2nd Driveway off of
Shumway Street for Residents at 600 Hennes Avenue

INTRODUCTION:
Please find attached a letter from Mrs. Jean Marschall of 600 Hennes Avenue in
Shakopee in regard to a 2nd driveway curb cut on Shumway Street.
BACKGROUND:
The Marschall's at 600 Hennes Avenue currently have a lot at the comer of Shumway
Street and Hennes A venue. On this lot exists one driveway curb cut on Shumway Street
for their single family residential home and attached garage.
The Marschall's would like to construct an unattached garage for their home and are
requesting a driveway curb cut further to the south on Shumway Street to accommodate
this proposed garage. Staff did review this permit for the unattached garage and has
recommended that this driveway to access this garage be off of the existing driveway on
the private property. The reason being for this is per Resolution No. 2891, Paragraph 4D,
corner lots are allowed two curb cuts or driveways, with only one opening on each street
unless either street is a collector or arterial. In this case, one curb cut would be permitted
on Shumway Street and one on Hennes A venue. The configuration of the house is such
that a curb cut on Hennes A venue is not possible to provide access to the proposed
unattached garage.
Attached to this memorandum is a letter from the Marschall's requesting that this item be
on the agenda appealing the City Engineer's decision, which is permissible per
Resolution No. 2891. Also, attached is Resolution No. 2891and a site plan showing the
Marschall's home and the proposed unattached garage on their lot at the corner of Hennes
A venue and Shumway Street.
The request from the Marschall's it to receive permission for a curb cut for their proposed
unattached garage on Shumway Street, versus providing a driveway extension off of the
existing driveway that they currently have for their home. City staffs interpretation of
the policy has been not allow the second curb cut, as the policy guidelines suggest only
one curb cut on each street for a corner lot unless one of the streets is a collector or
arterial street.
ALTERNATIVES:
1. Uphold the City Engineer's decision to deny a second curb cut on Shumway
Street for the property located at 600 Hennes Avenue.
2. Approve a motion over turning staff s decision and allow two curb cuts on
Shumway Street at 600 Hennes Avenue.
3. Table for additional information.
RECOMMENDATION:
Staff recommends Alternative No.1, to be in conformance with Resolution No. 2891.
However, this is an appeal by the residents to the City Council and a Council policy
decision to determine whether or not to grant the residents request or uphold City staff s
determination.
ACTION REQUESTED:
Approve a motion to either approve the curb cut at one location or two locations on
Shumway Street for the residents at 600 Hennes Avenue.

We request to be placed on the agenda of the August 19, City Council meeting for
consideration of an appeal of the City Engineer's decision to deny a curb cut at our
residence, 600 Hennes Ave.
We understand that the guideline, stating that corner lots may have two curb cuts,
but shall not be on the same street, intends to address safety and public service issues.
Prior to the guideline's establishment, we addressed those same issues in 1987 when we
planned the layout of our home and existing curb cut on a corner lot with the intention of
eventually building an unattached garage. We chose the Shumway curb cut on the side of
the house, rather than the front, because of the three duplexes at 601, 60 1 ~, 611, 621,
631 and 641 Hennes Ave., and the lack of off street parking for those dwellings. Over
the years we have had to deal with missing mail delivery because of parked cars, snow
removal difficulties and as recent as last week,' a car was cited for parking a non
operating vehicle on Hennes. We have had to replace sprinkler heads and have difficulty
mowing because of cars parked in front of our house and on our lawn. The frequency of
these difficulties changes with the families that live in the neighborhood. At one time,
there were 18 vehicles belonging to the three duplexes. We suggest our comer lot
situation is unique in that there are three multi dwelling homes on single lots across the
street from us.
In the 126 feet of Hennes Ave. from the corner of Hennes and Shumway and
including the driveway of the property adjacent to ours, there are five households that
access Hennes Ave. If we had a curb cut on Hennes there would be six households
backing onto 126 feet of Hennes, but we would comply with the letter of the guidelines.
By comparison, Shumway has 300 feet from Hennes to Menke with three curb
cuts for three families, including ours. The second curb cut we propose would not add
any additional traffic onto Shumway. There will still only be three families accessing
Shumway. Our attached garage will continue to be the primary source of traffic to and
from our home.
The curb cut we are proposing would not be unique to our area. Our neighbors at
560 Hennes have two curb cuts onto Hennes. Their unattached garage was built in 1992
after the guidelines were written, and did not require this appeal process for approval.
The only stipulation made was that the curb cut be single lane.
The City Engineer offered the option of branching off our original driveway. This
option has several drawbacks. It would run parallel with the house and street for 55 feet.
During the winter we would be blowing snow away from the house and towards the
street while the snowplows would be pushing it back creating a wall of snow. Backing
through about 80 feet of driveway with two 90 degree changes in direction is not a safe
option when you have five children. Frankly, it would also look hideous and may require
the removal of two oak trees.

In conclusion, we feel that we have always addressed the spirit of the guideline,
safety and public services, while planning our home and its uses. We would have chosen
to situate our home differently had the guidelines existed in 1987. We trust that you will
consider our efforts at addressing safety and public services. We hope that you will
recognize that our proposal would be the most aesthetic, and that the city has approved
two curb cuts on the same street in our neighborhood already. Most of all we ask that
you recognize our situation as unique, in that our two curb cuts on Shumway would be
preferable for safety and public services than if we had originally or sought now for a
curb cut on Hennes.
