INTRODUCTION:
Staff recently received letters from property owners in the Greenfield subdivision, who have expressed
concerns about the berms located on their properties along Valley View Road and Independence Drive
in this development. The purpose of the letters was to inquire about alternatives that may be available
and implemented in place of the berms.
BACKGROUND:
The preliminary plat for Greenfield was approved by the City Council on December 4, 200 I. A
condition of approval was that there be a continuous four (4) foot berm along Independence Drive and
Valley View Road. The City Code in place then required berming at a minimum height of four (4)
feet with over-story deciduous and coniferous landscaping be provided for residential properties with
abut collector and/or arterial roadways. Shortly after approval of the plat the applicant, Tollefson
Development, Inc., submitted a letter requesting that the Council consider an amendment that would
allow for the construction of a berm along Independence Drive and Valley View Road consistent with
submitted grading plans. These plans showed berms that were intermittent; in some places, up to 4
feet in height, in others, non-existent due to drainage and/or utility easements. That amendment
request was approved by the City Council on January 15,2002.
Subsequently, the City Council approved a text amendment to Section 11.60, Subd. 7 (screening), that
modified the screening requirement language to read as follows: opaque screening at a minimum
height of four (4) feet. The screening can be accomplished through berming with overstory deciduous
and coniferous landscaping plantings, fencing, or topography differences when commercial or
industrial development abuts existing residential development or residentially zoned properties, unless
otherwise approved by the City Council (Ordinance No. 631, June 27, 2002).
The applicant did plant deciduous and coniferous trees along both streets; however, a large number of
those trees have died. Staff recently sent the developer a letter requesting that those trees that have
died or are generally unhealthy be replaced. The developer has communicated to staff that the
replacement of trees will occur this fall.
ALTERNATIVES:
1. Direct staff to bring forward revised resolutions of preliminary and/or final plat approval
eliminating the berming requirement, but clarifying that any future required noise mitigation or
buffering will be at the expense of the property owners.
2. Provide staff with other direction.

Staff requests that the Council discuss this issue, and provide direction to staff.

My wife Sandy and I just moved to the City of Shakopee on July 25th, 2003 into the Greenfield
Development. The front of our house faces East on Omega Drive and the back faces West and
Independence A venue, just south of Thrush Street. The reason for this letter to acquire information
on how we could remove the berm located on our property, along Independence Avenue.
It started just over a week ago when our builder (Carabec Homes) was asking about how we would
like our final grade to our property. We asked them if the berm would be able to be removed, they
answered to check with the developer, (Tollefson Development). I talked to a Brenda at Tollefson
Development and asked about the removal of the berm and she explained it was not up to the
developer. She went on to say that the City Council had approved the berms to line the East side of
Independence Avenue and we would need to check with the City.
I called one of the City of Shakopee' s offices and spoke with a Judy Kox. I eJ.']llained the situation to
her and she gave me the number to Mark Noble, Greenfield's project manager. In my conversation
with him, he told me that there have been a number of new homeowners asking about the removal of
the berm. His main explanation to the reason for the berm was Independence Avenue is considered a
"collectors street," which generally has high traffic volumes and may be noisier. However, the
homes on the west side ofIndependence Avenue, south of Thrnsh Street do not have the berms in
their yards. May I also point out, most, if not all of the homes on 17th Avenue, east of County Road
17 do not have berms and that it is busier and a four-lane highway.
These berms take up half ofthe back yard and for the price ofland in the area; a usable flat lot would
be ideal. We are looking to complete our final grade soon, so we can get a sprinkler system installed
and sod our lot before the middle of September. If you could steer us in the right direction so this
request can be resolved in a timely matter, it would be very appreciated. You may contact me at my

The undersigned homeowners on Block 8, Greenfield development of Shakopee, wish to bring the issue of
berming along Valley View Road to the attention of the Shakopee City Council.
As required by the approved plat for the Greenfield development, the undersigned residents all have four-
foot high berms between their homes and the south side of Valley View Road. The placement of these berms
have been a fmstration for the homeowners. The berms are located at or near the middle of the homeowners'
backyards and they have a significant impact on the homeowner use and enjoyment of the space.
Assistant City Engineer Scott Smith and City Planner Mark Noble, indicated the berms were established to
provide a visual/noise barrier between the homes and Valley View Road. As homeowners, we appreciate the
council's consideration of future potential traffic issues along Valley View Road. We understand that the
council has attempted to address this potential problem before it actually becomes a problem. However, the
homeowners feel that, in their current form and location, the berms are not achieving their intended purpose.
During a phone conversation with Community Development Director Michael Leek on July 18, the
homeowners were informed that the city council will need to amend the plat before alternatives to the
existing berms are initiated.
The homeowners wish to open a discussion with the council regarding possible alternatives to the existing
berms. The homeowners hope to find a reasonable alternative that will meet both the council's intention of
establishing a visual/noise barrier and give the homeowners full use and enjoyment of their backyards.
We invite the members of the Shakopee City Council to visit block 8 of the Greenfield development at a time
that is convenient for them, either as a group or individually. We feel that if council members take a few
moments to visit the block and look at the existing berms, members will immediately understand the problem
the berms are creating for us. Feel free to contact either Nick Maxwell or Jenny Huber to establish a time to
visit the block and talk with any ofthe undersigned homeowners.
We wish to thank Scott Smith, Mark Noble, and Michael Leek for the many questions they have helped
answer, as well as the information they have given us to help resolve this matter. We look forward to
hearing from members of the council to work toward a reasonable solution.
