INTRODUCTION:
By letter dated August 15, 2003, Natgun Corporation, the contractor for the Water
Storage Tanks No.5 and No.6 at County Road 16 & c.R. 18 for Shakopee Public
Utilities Commission has requested that City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, be suspended
for certain work hours.
BACKGROUND:
The above named section of the City Code restricts the hours of operation from 7:00
A.M. to 10:00 P.M. on weekdays, and from 9:00 AM. to 9:00 P.M. on weekends and
holidays.
Natgun Corporation is requesting a suspension on the hours as follows:
Saturdays 7:00 A.M. to 5:00 P.M.
Also, Natgun Corporation is asking for permission to start prior to 6:00 A.M. on
two occasions in September and two occasions in October.
Staff would recommend that if the suspension of hours is granted, that the approval is
subject to the following conditions:
. Approval is contingent upon minimizing noise exposure near residential areas.
. If residential complaints are received by the City, the suspension can be revoked
at the discretion ofthe City Engineer.
. Saturday start time should be 8:00 AM. consistent with other approvals in the
past years.
If Council approves the suspension, a public notice to meet the City Code requirements
and notice such as a news release would be placed in the Shakopee Valley News. Staff
would point out that these water tanks are located at the intersection of C.R. 18 and C.R.
16 and Shakopee Public Utilities Superintendent has been in contact with nearby
residents. The Contractor has agreed to adjust the schedule if complaints are received due
to the earlier start time. A list of references was requested and received from the
Contractor in working in other Cities. The earlier start time is being requested in order to
complete the work this year.
ALTERNATIVES:
1. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

2. Approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, for some other
period of time as determined appropriate by the City Council, and direct staff to
publish notice of the suspension terms.
3. Do not approve the suspension of City Code Sec. 10.60, Noise Elimination and Noise
Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D.
RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer a motion approving a suspension of City Code Sec. 10.60, Noise Elimination and
Noise Prevention, Subd. 3, Hourly Restrictions on Certain Operations, D, per this memo,
and direct staff to publish notice of the suspension terms with the conditions as
recommended by staff.

Subject: REQUEST FOR EXTENDED WORK HOURS
Natgun Corporation has been awarded the Contract to construct the Water Storage Tanks
number 5 & 6 located along County Road 16 for the Shakopee Public Utilities
Commission. Natgun request the City Council grant permission to work on Saturdays
from 7AM to 5:00 PM during the tank construction. It is anticipated that we would
require a six-day workweek during the months of September, October and November to
construct the tanks and complete partial backfill prior to the end of the construction
season.
In addition, we request permission to start prior to 6 AM on two occasions in September
and two occasions in October to complete the floor slab and roof slab concrete
placements. It is necessary to complete each floor and roof placements in one monolithic
pour. To achieve this and minimize the heat effects 011 the concrete and crew we request
permission on these four days to start the C<JIlcrete placements at 6 AM.
As we get closer to thc date we will notify the appropriate parties of the pending concrete
placernents.
