DISCUSSION
Tollefson Development has made application for preliminary plat approval for the proposed
Thomas A. Philipp Addition. The proposed plat is located east of the intersection of 17th
Avenue and Independence Drive. This plat proposes the construction of75 dwelling units
lots on approximately 20 acres.
The Planned Unit Development (PUD) for this project was approved by the City Council on
August 19,2003. A public hearing on this request was held by the Planning Commission on
August 21,2003. A copy ofthat report is attached for the Council's information. At its
meeting, the Planning Commission recommended approval, by a 5 to 1 vote, of the
Preliminary Plat to the City Council subject to the conditions outlined.
ALTERNATIVES
1. Approve Resolution No. 5937, a resolution approving the preliminary plat of Thomas
A. Philipp Addition, subject to the conditions contained therein;
2. Approve Resolution No. 5937 with revised conditions.
3. Deny the requested preliminary plat, and direct staff to prepare a resolution consistent
with that action.
4. Table a decision in order to allow time for the applicant and/or staffto provide
additional information.
ACTION REQUESTED
Offer a motion consistent with Alternative 1, and move its adoption.

RESOLUTION NO. 5937
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING
THE PRELIMINARY PLAT OF THOMAS A. PHILIPP ADDITION
WHEREAS, Tollefson Development, applicant, and Kathleen Philipp, property
owner, have made application for preliminary plat approval of Thomas A. Philipp Addition;
and
WHEREAS, the subject properties are legally described as:
The West Half of the Northeast Quarter of the Northeast Quarter of Section 17, Township
115, Range 22, Scott County, Minnesota; and
WHEREAS, the Shakopee Planning Commission conducted a public hearing on the
preliminary plat on August 21, 2003; and
WHEREAS, all required public notices regarding the public hearing were posted
and sent; and
WHEREAS, the Shakopee Planning Commission has recommended approval
subject to the conditions listed below; and
WHEREAS, the City Council reviewed the preliminary plat request at its meeting
of September 2,2003.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA, as follows:
1. The following procedural actions must be completed prior to the recording of
the Final Plat:
A. Approval of title by the City Attorney.
B. Execution of a Developers Agreement with provisions for Plan A and
Plan B improvements, as well as payment of engineering review fees,
and any other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.

4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of
the Design Criteria and Standard Specifications of the City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, security for the
public improvements, engineering review fees, and other fees
as required by the City's adopted Fee Schedule for the entire
plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve
the Final Construction Plans and Specifications. The developer
shall continue to work with staff to address the issues identified
in the Engineering Department memo dated July 22,2003,
prior to the approval of plans.
7. Security shall be provided in an amount to be determined by
the City to ensure the development of the open
space/recreational areas.
8. Park dedication requirements shall be met through a cash
dedication payable at time of recording of the final plat. If the
plat is recorded after the effective date of the 2004 City of
Shakopee Fee Schedule, the developer shall be required to pay
park dedication fees in an amount consistent with the then
current adopted fee schedule.
9. The homeowners association documents shall include a
provision allowing shared use of the open space areas in this
plat with the residents of the Southern Meadows development.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. Shall comply with the conditions of approval set forth in the Planned
Unit Development (PUD) approval.
E. The developer shall place pedestrian crossing signs and a painted
crosswalk at the corner of Independence Drive and 17th Avenue.
F. The survey data (length and bearings) shall be shown for each lot.
G. STC 30 rated windows and climate controls shall be utilized in the
dwellings located along 17th Avenue to mitigate noise. Landscaping
shall not interfere with the sight line for 17th Avenue.
H. The Homeowners Association documents shall include a provision for
the perpetual maintenance and ownership of the outlot and common
areas.
II. Following approval and recording of the final plat, the following
conditions shall apply;
A. Building construction, sewer, water service, fire protection and
access will be reviewed for code compliance at the time of
building permit application(s).

B. The developer and Homeowners Association shall be responsible
for any noise mitigation necessary resulting from 17th Avenue.

DISCUSSION
Tollefson Development has submitted an application for preliminary plat approval of
Thomas A. Phillip Addition. The plat proposes the construction of75 dwelling units.
The applicant has also requested approval of a Planned Unit Development (PUD) for this
site. The Planning Commission has reviewed the PUD request and has recommended
approval ofthe PUD to the City Council. The preliminary plat, as submitted, conforms to
the PUD request. The City Council will be reviewing the PUD request at its August 19,
2003 meeting. Staff will apprise the Commission of the action taken on August 19
relative to the PUD at its meeting on August 21. The preliminary plat submitted is
contingent upon the approval of the PUD.
The project area is approximately 20 acres in size and proposes the construction of75
dwelling units. Staff has received the following comments from other
departments/agencies.
The Building Official has commented that temporary street signs shall be posted.
The Engineering Department, Director of Natural Resources, and Shakopee Public
Utilities Commission (SPUC) have provided comments which are attached to this report.

ACTION REQUESTED
Offer a motion to recommend approval of the Preliminary Plat of Thomas A. Phillip
Addition to the City Council continue the public hearing to August 21, and move its
adoption.

Municipal water service is available subject to our standard terms and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to: entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
Street Lighting installation is available subject to our standard terms and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
must pay the associated fees.
Applicant should contact Shakopee Public Utilities directly for specific requirements
relating to their project.
Note: SPUC recently increased the rates for the UG Electric Charge, Trunk Water
Charge, and Water Connection Charge. The new rates will apply to this
proposed project.
The preliminary watermain plans show three existing water services in 18th
Avenue for the four proposed units. We have verified that to be the case.
The services are to Lots 1, 2, & 4, Block 5. Service to Lot 3, Block 5 will have
to be installed by tapping the watermain in 18th Avenue. This should be done
prior to the wear course being installed. The existing 8" watermain in the
east section of 18th Avenue will have to be disconnected at the main if 18th
Avenue is to be vacated as shown.

The application indicates a Preliminary Plat is proposed for Thomas A. Phillip Addition.
After reviewing the referenced application, I have the following recommendations for the
applicant, and for the planning department:
Recommendation
1. Recommend approval ofthe Preliminary Plat, subject to the following conditions:
A. Site Grading:
Prior to any site grading the following actions must be completed:
AI) Submit the City of Shako pee Wetland Application and receive approval of
a wetland mitigation plan or wetland exemption.
A2) Payment of grading fees will be required. Grading fees will be developed
as required by the most current City of Shakopee Fee Schedule.
A3) Grading plan issues and storm water issues (see Storm Sewer/Ponding
below) need review and approved by the city engineer.
A4) NPDES permit is needed for this site.
A5) Permits from all agencies needed for the construction of this project are
the responsibility of the applicant.
A6) Earthwork balance calculations need to be shown on the grading plan. The
calculations should show the amount of import and export of the different
fill materials needed to balance the site. Also indicated on the grading
plan should be the source of the fill materials.
A7) Project benchmark information is needed on the grading plan. Benchmark
information needs a registered land surveyor's verification. Project
benchmarks need to be tied to the City of Shakopee's approved benchmark

system. A surveyors bench loop notes need to be submitted showing how
the project benchmarks have been established.
B. Construction Plans:
Prior to any street and utility construction the following actions must be completed:
B1) No street and utility construction will begin until final construction plans
have been approved and signed by the City of Shakopee's City Engineer.
The title sheet shall have a signature block for the City of Shakopee' s City
Engineer to sign.
B2) Construction plans for street and utility work will contain plan and profile
sheets for each street as well as cross section sheets. Plan and profile
sheets will be 22" X 34" and not have a scale smaller than 1 "=1 00'
horizontal and 1"= I 0' vertical. Cross-section sheets will have a scale no
smaller than 1"=10' both in horizontal and vertical. Text size will not be
smaller than 0.10". The construction plans shall contain an overall street
and utility layout.
B3) Applicant will work with City of Shakopee staff and the City's
engineering consultant on final road design and alignments.
D. Water/Sanitary Sewer
Dl) The Shakopee Public Utility Commission must approve the water system
necessary to serve the proposed development.
D2) Any Trunk Watermain Charges shall be paid as required by the Shakopee
Public Utility Commission.
D3) Sanitary Sewer Trunk Charges will apply to this plat. Sanitary Trunk
Charges will be developed as required by the most current City of
Shakopee Fee Schedule.
E. Storm Sewer/Ponding:
E1) The applicant's engineer will work with City staff and the City's
engineering consultant on the storm sewer plan for this area of the City
and to ensure that adequate easements are incorporated into the final plat.
Final plat cannot be recorded until the easements are acceptable to the city
engmeer.
E2) The storm water plan will include a drainage map showing the piping and
ponding system needed to control runoff rates under a fully developed site.
Also included with the drainage map is to be storm drainage calculations
for this site.
E3) Storm Water Trunk Charges will apply to this plat. Trunk Storm Water
Storage and Treatment Charges (Ponding Fees) will apply to
approximately half the site. The other half will provide ponding and will

INTRODUCTION/ BACKGROUND
At its July 28, 2003 meeting, the Parks and Recreation Advisory Board made the following
recommendation for the Philipp Addition by Tollefson.
For the Preliminary Plat shown as Attachment B, the PRAB should recommend the following
conditions:
l. To accept cash in lieu of parkland.
2. To accept the private recreation areas as presented.
3. The placement of pedestrian crossing signs and a painted crosswalk at the corner
Independence Drive and 17th Avenue.
4. The Applicant is encourage to explore opportunities to share use of its recreation spaces
with the adjacent development by Ploweshares and perhaps develop an cooperative
agreement between the two homeowners associations to make their facilities available to
residents within their developments.
