SUBJECT: Set Public Hearing for Vacation of Easement and Right-of-Way
MEETING DATE: September 16,2003
INTRODUCTION
Tollefson Development has submitted an application for vacation of easement and right-of-
way located within the proposed Thomas A. Philipp Addition (east of the intersection of
17th Avenue and Independence Drive). Please see Exhibit A. The attached Resolution
No.5952 sets a public hearing date to consider the vacation ofthis easement and right-of-
way.
DISCUSSION
The attached resolution sets a public hearing for October 7, 2003. On that date, comments
from staff members and utilities, as well as a recommendation from the Planning
Commission, will be presented to the City Council for consideration. The Planning
Commission will consider the request at its September 18, 2003 meeting.
ACTION REQUESTED
Offer Resolution No. 5952, a resolution setting the public hearing date to consider the
vacation of easement and right-of-way, located within the proposed Thomas A. Philipp
Addition, east of the intersection of 17th Avenue and Independence Drive.

RESOLUTION NO. 5952
A RESOLUTION SETTING THE PUBLIC HEARING DATE TO CONSIDER THE
VACATION OF EASEMENT AND RIGHT-OF-WAY, LOCATED WITHIN THE
PROPOSED THOMAS A. PHILIPP ADDITION, EAST OF THE INTERSECTION
OF 17TH A VENUE AND INDEPENDENCE DRIVE
WHEREAS, it has been made to appear to the Shakopee City Council that
easement and right-of-way located within the proposed Thomas A. Philipp Addition,
located east of the intersection of 17th A venue and Independence Drive, serves no public use
or interest; and
WHEREAS, a public hearing must be held before an action to vacate can be taken
and two weeks published and posted notice thereof must be given.
WHEREAS, two weeks published notice will be given in the SHAKOPEE
V ALLEY NEWS and posted notice will be given by posting such notice on the bulletin
board on the main floor ofthe Scott County Courthouse, the bulletin board at the U.S. Post
Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the
Shakopee City Hall.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKO PEE, MINNESOTA, that a hearing be held in the Council
Chambers on the 7th day of October, 2003, at 7:00 P.M. or thereafter, on the matter of
vacating easement and right-of-way located within the proposed Thomas A. Philipp
Addition, located east of the intersection of 17th A venue and Independence Drive,
Adopted in session of the City Council of the City of Shakopee,
Minnesota, held the _ day of ,2003.
