SUBJECT: Waiver of Subdivision Criteria: 2175 Valley View Road

INTRODUCTION
Willis Smith has submitted an application requesting approval of a waiver of subdivision criteria
for property located at 2175 Valley View Road (Exhibit A). Mr. Smith is the current owner of
the property, which presently has a storage garage (considered an accessory structure) located on
it. Mr. Smith would like to split the property into two (2) lots: one that he intends to sell, and the
other (the lot that would have the garage located on it), he intends to keep. For this to occur, he
is requesting a waiver of subdivision criteria to allow a minor subdivision that would create a lot
with an accessory structure located on it. The City Code stipulates that no accessory structure
shall be constructed on any residential lot prior to the construction of a principal building to
which it is accessory. This presently is a non-conforming situation. The other lot would be sold
for development as a single-family residence.
BACKGROUND
The applicant has provided a letter describing his intent for the property, as well as a copy of the
property survey. If the waiver of subdivision criteria request is granted, the applicant will
continue to work with staff on the minor subdivision process.
ALTERNATIVES
1) Approve the requested waiver of subdivision criteria that would create a lot with an
accessory structure located on it.
2) Do not approve the waiver of subdivision criteria.
3) Table the matter for additional information.
STAFF RECOMMENDATION
Staff recommends approval of the waiver of subdivision criteria request.

Dear Mayor and City Council Members:
I am in the process of splitting my property into two separate lots. I would like
to keep my storage garage on the lot I am retaining for myself.
I use this garage for woodworking and storage. I have always kept the area
around my garage very well maintained; the grass it is always cut and I have
never had any junk around my garage.
