DISCUSSION The Planning Commission has reviewed this request and has recommended approval of the vacation request. Attached for your information is a copy of the Planning Commission report from the September 18, 2003 meeting. Comments have been received from Shakopee Public Utilities and the Engineering Department. These comments have been incorporated into the draft resolution. ALTERNATIVES 1. Approve Resolution No. 5955, a resolution of the City of Shakopee approving the vacation of easement and right-of-way east of 17th Avenue and Independence Drive. 2. Deny the proposed vacation. 3. Continue the public hearing. 4. Close the public hearing and table the request to allow staff or the applicant time to provide additional information. ACTION REQUESTED Offer a motion to approve Resolution No. 5955, and move its adoption. g:\cc\2003\10-07\vac tollefson philippaddn.doc RESOLUTION NO. 5955 A RESOLUTION OF THE CITY OF SHAKOPEE VACATING EASEMENT AND RIGHT-OF-WAY EAST OF THE INTERSECTION OF 17TH A VENUE AND INDEPENDENCE DRIVE WHEREAS, it has been made to appear to the Shakopee City Council that easement and right-of-way located east of the intersection of 17th Avenue and Independence Drive serves no public use or interest; and WHEREAS, the property to be vacated is legally described as: A perpetual, non-exclusive easement for roadway, sanitary sewer, watermain, storm sewer, utility and drainage purposes over, under, across and through the south 40.00 feet of the West Half of the Northeast Quarter of Section 17, Township 115 North, Range 22 West, Scott County, Minnesota, lying easterly of the northerly extensions of the easterly right of way lien of Wynd am Drive as platted in Wyndam Ponds rt Addition, Scott County, Minnesota and westerly of the following described line; Beginning at the intersection of the south line of said West Half of the Northeast Quarter of the Northeast Quarter and the easterly right olway line of the abandoned Chicago, Milwaukee, St. Paul, and Pacific Railroad; thence North 00 degrees 00 minutes 03 seconds East a distance of 40.00 and said line there terminating. For purposes of this description said south line is assumed to bear South 89 degrees 59 minutes 57 seconds East. The sidelines of said easement shall be prolonged or shortened to intersect with the west line of said West Half of the Northeast Quarter of the Northeast Quarter; AND A perpetual, non-exclusive easement for utility and drainage purposes over, under, across, and through the south 10.00 feet of the north 60.00 feet of the east 580.25 feet of the Southwest Quarter of the Northeast Quarter of the Northeast Quarter of Section 17, Township 115 North, Range 22 West, Scott County, Minnesota; AND A perpetual, non-exclusive easement for ingress and egress purposes over the northerly 30.00 feet of the West Half of the Northeast Quarter of Section 17, Township 115, Range 22 West, Scott County, Minnesota; and WHEREAS, a public hearing to consider the action to vacate was held in the Council Chambers of the City Hall in the City of Shakopee at 7 :00 P.M. on the 7th day of October, 2003; and WHEREAS, two weeks published notice was given in the SHAKOPEE VALLEY NEWS and posted notice was given by posting such notice on the bulletin board on the main floor ofthe Scott County Courthouse, the bulletin board at the U.S. Post Office, the bulletin board at the Shakopee Public Library, and the bulletin board in the Shakopee City Hall; and WHEREAS, all persons desiring to be heard on the matter were given an opportunity to be heard at the public hearing in the Council Chambers in the City of Shakopee. NOW, THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA: That it finds and determines that the vacation hereinafter described is in the public interest; That the easement described above serves no further public purpose; That the easement described above is hereby vacated, subject to the following conditions: 1. The applicant shall remove the existing street construction of 18th Avenue East of Wynd am Drive in its entirety, onsite and offsite. Easements and/or rights-of-entry shall be obtained by the applicant prior to work done off site. These removals shall be addressed prior to approval ofthe final street and utility plans for the Thomas A. Phillip Addition. 2. The existing and proposed utilities within Easement C shall be addressed prior to approval of the final street and utility plans for the Thomas A. Philipp Addition. 3. The existing 8 inch watermain will have to be removed by the applicant and a new 8 inch watermain extended in the Thomas A. Philipp Addition from 18th Avenue along the east right-of-way line of Independence Drive. After the adoption of the Resolution, the City Clerk shall file certified copies hereof with the County Auditor and County Recorder of Scott County. Philipp Addition MEETING DATE: September 18, 2003 Site Information Applicant: Tollefson Development Site Location: Proposed Thomas A. Philipp Addition - east of the intersection of 17th A venue and Independence Drive Zoning: Planned Residential District (PRD) Adjacent Zoning: North: Minnesota River South: Central Business (B-3) Zone West: Central Business (B-3) Zone East: Central Business (B-3) Zone INTRODUCTION The City Council has received a request from Tollefson Development to consider the vacation of right-of-way and easement located within the proposed Thomas A. Philipp Addition (east of the intersection of lih Avenue and Independence Drive), please see Exhibit A. The vacation is necessary to construct the roadways and homes proposed as a part of the approved PUD and preliminary plat. DISCUSSION The City Council will hold a public hearing on October 7, 2003, to consider this vacation request. A recommendation from the Planning Commission is needed for the vacation process. Other departments and agencies have been made aware of the request for vacation and have not provided any adverse comments. The Engineering Department has reviewed the request and has provided comments attached as Exhibit C. ALTERNATIVES 1. Recommend to the City Council the approval of the vacation, subject to the conditions outlined by the Engineering Department. 2. Recommend to the City Council the approval of the vacation, subject to revised conditions. 3. Recommend to the City Council denial of the request. 4. Table the decision to allow staff or the applicant time to provide additional information. STAFF RECOMMENDATION Staff recommends Alternative No.1, the City Council approval of the vacation subject to the conditions outlined by the Engineering Department. Philipp) PID NO.: 27-917003-0 CASE NO.: 03097 DATE: September 12, 2003 The application indicates a request to vacate easements and right-of-way on the Thomas A. Philipp property located East of the intersection of Independence Drive and 1 ih Avenue. Three separate easements to be vacated are noted. They are Easement A, Easement Band Easement C. Easement C includes right-of-way set aside for 18th Avenue. Recommendation After reviewing the above, referenced application, I recommend approval subject to the following conditions: 1. The applicant shall remove the existing street construction of 18th A venue East of Wyndam Drive in its entirety, onsite and offsite. Easements and/or rights-of-entry shall be obtained by the applicant prior to work done offsite. These removals shall be addressed prior to approval of the final street and utility plans for the Thomas A. Philipp Addition. 2. The existing and proposed utilities within Easement C shall be addressed prior to approval of the final street and utility plans for the Thomas A. Philipp Addition.
