City of Shakopee Memorandum TO: Mayor and City Council Mark McNeill, City Administrator FROM: Tracy Schaefer, Assistant to the City Administrator SUBJECT: Teresa Walsh-Alfaro- Request for Exemption to Garbage Service MEETING DATE: October 21,2003 Introduction Teresa Walsh-Alfaro, in her attached memo, is requesting for an exemption to Ordinance No. 594, which mandates garbage and recycling service. Background Ms. W alsh- Alfaro is seeking an exemption for her residence at 1715 East 10th Avenue, because she does not have a need to future refuse service. Ms. Walsh-Alfaro is a BFI employee, another garbage hauler, and can bring her refuse to work. In the past, several residents, namely other garbage hauler employees, have asked for similar exemptions and those requests have been denied by City Council. To staffs knowledge, there are roughly 80 -100 garbage industry employees that would again request the same exemption. I explained to Ms. Walsh-Alfaro, that as city staff, I would not grant his exemption for three reasons: 1) Does not follow City Ordinance No. 594 for citywide garbage and recycling servIces. 2) It is not consistent with City Council's precedents that have not allowed refuse waIvers. 3) It would be difficult and costly for staffto comply with the MN State law that requires cities to provide recycling services to its residents. Since Ms. Walsh-Alfaro needs are less than an average Shakopee family that would normal use a 60 or 90-gallon container, I gave Ms. Walsh-Alfaro the option of the more economical 30-gallon container, but she still wished to address the City Council to ask for a waiver. Staff Recommendation Deny Ms. Walsh-Alfaro's request for an exemption for the garbage service with Dick's Sanitation. This will help to maintain the uniformity and equity of the citywide garbage servIce. 1 Action Required 1) Deny Ms. Walsh-Alfaro's request for an exemption to the City's garbage service. (Ordinance No. 594). 2) Grant Ms. Walsh-Alfaro's exemption to no longer be a part ofthe citywide garbage service contract. 3) Table. 2 . I _'1.' To William Mars, Mayor, and The Members of Shakopee City Council, I was referred to you by Tracy at Shakopee City HalL I would like a waiver for garbage service from Dick's Sanitation for the property that I own at 1716 East 10th Ave, because of the fact that there is no garbage generated there. Since there has not been any garbage generated there since last November, and there will not be any generated in the near future, I respectfully request this waiver to be granted. I do not believe I should have to pay Dick's Sanitation for services that they do not render. I am hoping this matter can be addressed at the next City Council Meeting on October 7, 2003.
