INTRODUCTION:
Ryland Homes has submitted an application for a final plat for Riverside Fields First Addition,
located west ofCSAH 18 and south of future CSAH 21.
CONSIDERATIONS:
The applicant is proposing to develop the first phase of Riverside Fields, which would consist of
65 lots, 64 of which would be developed for single-family residences. The 65th lot (Lot 1, Block
3) is proposed to be a community center with pool, and will be a private recreational amenity for
the development. The plat also consists of three outlots, one that will include an eight foot wide
recreational trail (Outlot C), and two that would be developed at a later date, generally consistent
with the approved preliminary plat. Additionally, as part of the preliminary plat approval, the
applicant received approval to have15 foot structure separations for 75 lots south of Crossings
Boulevard, with no side yard setback being less than five feet.
The Building Official commented that temporary street signs are required prior to construction.
The Shakopee Fire Inspector commented that a second remote access in accordance with
International Fire Code Appendix D shall be provided when the total unit count ofthis addition
and any future additions or plats accessing Crossings Boulevard west of County Road 18 exceeds
100 units.
The City Clerk commented that the signature block on the plat should be changed to read City
Clerk rather than City Administrator.
Shakopee Public Utilities Commission commented, noting that new rates for UG Electric, Trunk
Water, and Water Connection will apply for this project. Additionally, water, underground
electric and street lighting installation is available subject to their standard terms and conditions.
The applicant must pay the associated fees, and contact them regarding installation/construction
policies.
The Facilities and Recreation Director has provided a memorandum (attached), which discusses
in detail the issues pertaining to park land dedication and other proposed development
improvements. The Council should review this memorandum so that they are aware of the future
public improvements in this development and surrounding area.
Planning staff received a copy of a noise study for this development. The report notes that peak
hour noise levels will be between 66-70 dB(A) during am and pm peak times. The City Code
(Section 10.60) and Minnesota Rules Chapter 7030 stipulate that the maximum noise levels shall
not exceed 50 dB(A) in the evening hours, and 60 dB(A) during day hours (not to be exceeded
10% of the time) or 55 dB(A) in the evening hours, and 65 dB(A) during day hours (not to be
exceeded 50% of the time). A condition has been included in the draft resolution that addresses
. noise prevention. Additionally, staff recommends that Crossings Boulevard right-of-way, from
the east boundary to the west boundary of Riverside Fields, be dedicated prior to recording the
First Addition final plat. Lastly, staff recommends that the segment of the commercial street
adjacent to the private recreational amenity (Lot 1, block 3) be shown and dedicated as right-of-
way, or that the developer provide documentation stating that access to this site will be from a
future right-of-way or easement east of that lot, and that they will not request direct access from
Crossings Boulevard to Lot 1, Block 3.
ALTERNATIVES:
1. Approve Resolution No. 5962, a resolution approving the final plat of Riverside Fields First
Addition, subject to the conditions as proposed.

RESOLUTION NO. 5962
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF RIVERSIDE FIELDS FIRST ADDITION
WHEREAS, Ryland Homes, applicant, and Shakopee Crossings Limited Partnership,
property owner, have made application for Final Plat approval of RIVERSIDE FIELDS FIRST
ADDITION; and
WHEREAS, the subject property is legally described as follows:
The Northwest Quarter of Section 13, Township liS, Range 22, Scott County, Minnesota.
Except all that part platted as SOUTHBRIDGE CROSSINGS FIRST ADDITION,
SOUTHBRIDGE CROSSINGS SECOND ADDITION and RIVERSIDE GROVE FIRST
ADDITION, according to the recorded plats thereof, Scott County, Minnesota and also except
County Road Number 18 and County Road Number 21.
WHEREAS, the Shakopee Planning Commission reviewed and recommended approval of
the Preliminary Plat on August 7,2003; and
WHEREAS, all required public notices regarding the public hearing were duly sent and
posted and all persons appearing at the hearing have been given an opportunity to be heard; and
WHEREAS, the City Council of the City of Shakopee reviewed and approved the
Preliminary Plat of Riverside Fields on August 19,2003; and
WHEREAS, the City Council of the City of Shako pee reviewed the Final Plat of Riverside
Fields First Addition on October 21,2003; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows;
That the Final Plat of RIVERSIDE FIELDS FIRST ADDITION is approved subject to the
following conditions:
I. The following procedural actions must be completed prior to the recording of
the final plat:
A. Approval oftitle by the City Attorney.
B. Revise the signature block to read City Clerk rather than City Administrator.
C. Execution of a Developers Agreement which shall include provisions for
payment of engineering review fees, and any other fees as required by the
City's most current fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems in accordance
with the requirements of the Design Criteria and Standard
Specifications of the City of Shakopee.
5. Installation of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of Shakopee.
6. The developer shall be responsible for payment of engineering review
fees, and other fees as required by the City's adopted Fee Schedule.
7. Park dedication requirements for the residential area shall be met
through a combination of park land to be dedicated with the final plat,
a 20' wide recreational trail, and improvements to the park area.
8. Approximately 2.955 acres of wetland along the southern property line
shall be dedicated to the City on the final plat.
9. Outlot C for the recreational trail shall be deeded to the City
simultaneously with the recording of the final plat.
10. The developer shall contribute $50,000 toward the park improvements
when the City develops the park. The contribution shall be applied
towards a children's play structure.
11. The developer shall install an eight-foot wide asphalt trail to the east
property line in the area identified in Outlot C on the final plat,
sidewalk along both sides of Crossings Boulevard, a sidewalk along
Penstemon Lane, and a trail from Penstemon Lane to the levee trail, as
shown on the utility and street construction plan ofthe final plat.
12. The park dedication requirements have been determined based on the
fact that the preliminary plat for the property depicts all residential
portions of the property being developed with single-family detached
homes, not attached townhouse dwellings. If future phases of the
property are proposed to be developed with townhomes or other types
of attached dwellings, the city reserves the right to: (a) deny such
proposals; (b) require additional park land dedication; or (c) require
additional park dedication fees to be paid.
13. The homeowner's association shall develop a management plan for the
sustainability of the wetlands and native plantings proposed in the
preliminary plat.
14. The applicant shall include 6 inches of topsoil, meeting MNDOT
specifications, on the entire site.
15. That all sprinklers owned and operated by the Homeowner's
Association have rain sensors as required by State Law.
16. The applicant shall construct houses using construction materials and
methods for indoor noise mitigation.
17. The applicant shall incorporate a berm and/or a 6 foot fence with a
variety of trees along CR 21 and CSAH 18, or wherever appropriate, to
mitigate noise from the highways.
18. That a 16" trunk watermain along CSAH 18 and a 12" trunk
watermain in proposed Crossings Boulevard will be required within
this development.
19. No landscaping, ponding, berming, or signage shall be permitted
within the County right-of-way.
20. Any change in drainage entering the County right-of-way shall require
detailed stormwater calculations to be submitted to the County
engineer for review and approval.
21. A street light shall be installed at the intersection of CSAH 18 and
Crossings Boulevard.
22. A County access permit shall be required for Crossings Boulevard at
CSAH 18. A right and left turn lane on CSAH 18 shall be required.
No other accesses or direct access shall be granted to the development.
23. Any work within the County right-of-way shall require a permit.
24. Crossings Boulevard right-of-way, from the east boundary to the west
boundary of Riverside Fields, be dedicated.
25. That segment ofthe commercial street adjacent to the private
recreational amenity (Lot 1, block 3) shall be shown and dedicated as
right-of-way, or that the developer provide documentation stating that
access to this site will be from a future right-of-way or easement east
of that lot, and that they will not request direct access from Crossings
Boulevard to Lot 1, Block 3.
26. The following variation is granted from zoning code provisions:
a. 15' structure separations are approved for 75 lots south of
Crossings Boulevard, with no side yard setback being less than 5'.
D. Final Construction Plans and Specifications must conform to City
requirements and are subject to approval by City Engineer. Such plans as they
relate to water or electricity are subject to the approval of the SPUC Utilities
Manager.
E. No site grading will be allowed on Outlot A and Outlot B until preliminary
plan and profile sheets for street and utility work and a grading permit are
approved by the City Engineer.
F. The applicant shall implement the use of Best Management Practices for
erosion control and stormwater management during construction.
G. The applicant should transplant healthy young trees on site whenever possible.
H. The developer shall install rain sensors for the irrigation system.
II. Following approval and recording of the final plat the following conditions shall
apply:
A. This development shall comply with City Code Section 10.60, concerning noise
elimination and noise prevention. Houses on lots immediately adjoining CSAH
18 shall be equipped with STC 30-rated windows. As an alternative, or in
addition to, the developer shall construct a sound mitigation fence along CSAH 18
and the future CSAH 21.
B. Responsibility for other noise mitigation measures that may be required in the
future shall rest with the developer or its assigns.
C. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
D. All existing easements are retained.
E. Final grading, utility connections and access to city streets will need approval by
the Engineering Department.
F. All outstanding fees will apply.
G. Temporary street signs are required prior to construction.
H. A second remote access in accordance with International Fire Code Appendix D
shall be provided when the total unit count of this addition and any future
additions or plats accessing Crossings Boulevard west of County Road 18 exceeds
100 units.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the Final Plat of
RNERSIDE FIELDS FIRST ADDITION does not constitute a representation or guarantee by
the City of Shakopee as to the amount, sufficiency or level of water service that will be available
to lots within the plat as they are developed.

Subject: Riverside Fields First Addition Final Plat Review
I am writing to provide comments related to the final plat review for Riverside Fields First
Addition.
Recommended Conditions (Consistent with Parks and Recreation Advisory Board
Recommendations and Preliminary Plat Approval):
(These conditions have been modified slightly from the preliminary plat to reflect ongoing
refinement of the park area, phasing of the development, and discussions with the
developer.)
1. Park dedication requirements for the residential area shall be met through a
combination of park land to be dedicated with the final plat, a 20' wide recreational
trail, and improvements to the park area.
2. Approximately 2.955 acres of wetland along the southern property line shall be .
dedicated to the City on the final plat.
3. Outlot C for the recreational trail shall be deeded to the City simultaneously with the
recording of the final plat.
4. The developer shall contribute $50,000 toward the park improvements when the City
develops the park. The contribution shall be applied towards a children's play
structure.
5. The developer shall install an eight-foot wide asphalt trail in the area identified in
Outlot C on the final plat, and other sidewalks/trails as shown on the plans.
6. The park dedication requirements have been determined based on the fact that the
preliminary plat for the property depicts all residential portions of the property being
developed with single-family detached homes, not attached townhouse dwellings. If
future phases of the property are proposed to be developed with townhomes or other
types of attached dwellings, the city reserves the right to: (a) deny such proposals;
(b) require additional park land dedication; or (c) require additional park dedication
fees to be paid.
Additional Comments for Consideration:
Park Land
Based on the number of units identified in the preliminary plat, the developer's park land
dedication requirement is 8.24 acres. In order to facilitate the single-family concept on
the entire site, staff and the Parks and Recreation Advisory Board agreed to accept less
acreage than could be required, provided that the developer agreed to make
improvements to the park area.
After further refinement of the park area, trail, and wetland during the final platting
process, the total area being provided to the City for park use is:
Park Land: 4.876 acres
Trail (Outlot C): 0.653 acres
Wetland: 2.955 acres*
*(Wetland is being provided as part of the park area, but per city ordinance, doesn't
count toward the park land requirements.)
During ongoing discussion with the developer (and after review by the Parks and
Recreation Advisory Board), Mr. Enger of Ryland informed staff that Ryland will no
longer be developing the area north of Crossings Boulevard (Outlot B). According to
both Mr. Enger and Mr. Soltau (the owner of Outlots A and B), negotiations for selling
this land continue.
The agreement regarding the amount of park land for the entire Riverside Fields
development was based on the entire development being single family. As I understand
from both Mr. Enger and Mr. Soltau, that although there is no discussion of changing the
type of housing proposed for Outlot B, neither Mr. Enger or Mr. Soltau can guarantee
that future developers of Outlot B will proceed with the single family concept that Ryland
proposed.
In my opinion, this is a significant issue. If Outlot Bdevelops as something with higher
density, the City should require more park land for the entire development. In order to
maximize the efficiency and effectiveness of the park area, the additional park land
should be added to the park area being dedicated, instead of another park on the site.
However, if Outlot B is sold to another developer as a separate parcel, the City may be
limited in requiring the additional park in Outlot A. When asked of the developers, Mr.
Soltau has said that he is unable to voluntarily provide additional park land in Outlot A
due to contracts with Ryland, and Ryland is not willing to provide a condition for
additional park land on Outlot A should Outlot B develop as higher density.
If Outlot B is sold to another developer and the developer proposes a change in the type
of housing that involves higher density, City Council will need to decide whether or not
to:
. Accept the higher density and receive cash in lieu of additional park land;
. Acceptthe higher density and require additional park land to be dedicated in Outlot
B; or,
. Deny the requested change.
Financial Commitment for Improvements
The City's ordinance allows the City to take a combination of land and cash (see
Attachment A). Due to land costs, the land value itself of the 5.528 acres exceeds the
total cash contribution that could be required for the development, although the
developer is willing to provide $50,000 for a children's play structure in the park area:
Total Cash Requirement Possible (206 Units X $2660/unit) = $547,960
Value of the Land Being Provided as Park (5.529 acres) = $818,292
Park Development Timelines
Staff met with the developer to discuss development timelines. I believe that it would be
beneficial to do a master plan for the larger park area, which would include potential
future park land to the west, before making improvements in the park identified for
Riverside Fields. In addition, City Council would need to allocate funds through the
capital improvement program to complete development of the Riverside Fields park.

the City Council finds it is in the public interest to do so. Recent examples of park
and recreation facilities provided by developers:
. Brittany Village 5th Addition - Private facilities, no credit given (cash dedication).
. Riverside Grove - Private facilities, no credit given (cash dedication).
. Whispering Oaks - Public facilities, no credit given (land dedication).
2. Credit can be given for a combination of cash and land. Fair market value of the land
is subtracted from the required cash contribution. Fair market value is determined by
the following order of preference:
a. Price the subject land sold for within the past year.
b. Average fair market value of undeveloped City residential property by zoning
classification, served by major City utilities. ($66,500/acre used to determine fair
market value for 2003 park dedication fee.)
c. An appraisal performed for or on behalf of the City within the past year.
d. An appraisal performed for or on behalf of the subdivider within the past year.
Fair market value determination shall exclude any value added to such land within
the past year for improvements serving the land.
Notes:
. Wetland, ponding areas, or drainageways accepted by the City shall not be
considered as part of the park land or cash contribution to the City.

INTRODUCTION:
City Engineering Department provided Planning staff their comments regarding the Final Plat of
Riverside Fields First Addition after the report was sent to the City Council. Subsequently, staff
has revised the draft resolution to include those conditions, and ask that the Council consider the
resolution as revised in their action on this final plat application.
ACTION REQUESTED:
Please review the memorandum from the City Engineering Department and offer a motion to
approve Resolution No. 5962, a resolution approving the Final Plat of Riverside Fields First
Addition, subject to the conditions as revised.

RESOLUTION NO. 5962
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF RIVERSIDE FIELDS FIRST ADDITION
WHEREAS, Ryland Homes, applicant, and Shakopee Crossings Limited Partnership,
property owner, have made application for Final Plat approval of RIVERSIDE FIELDS FIRST
ADDITION; and
WHEREAS, the subject property is legally described as follows:
The Northwest Quarter of Section 13, Township 115, Range 22, Scott County, Minnesota.
Except all that part platted as SOUTHBRIDGE CROSSINGS FIRST ADDITION,
SOUTHBRIDGE CROSSINGS SECOND ADDITION and RIVERSIDE GROVE FIRST
ADDITION, according to the recorded plats thereof, Scott County, Minnesota and also except
County Road Number 18 and County Road Number 21.
WHEREAS, the Shakopee Planning Commission reviewed and recommended approval of
the Preliminary Plat on August 7, 2003; and
WHEREAS, all required public notices regarding the public hearing were duly sent and
posted and all persons appearing at the hearing have been given an opportunity to be heard; and
WHEREAS, the City Council ofthe City of Shakopee reviewed and approved the
Preliminary Plat of Riverside Fields on August 19,2003; and
WHEREAS, the City Council of the City of Shakopee reviewed the Final Plat of Riverside
Fields First Addition on October 21,2003; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
That the Final Plat of RIVERSIDE FIELDS FIRST ADDITION is approved subject to the
following conditions;
I. The following procedural actions must be completed prior to the recording of
the final plat:
A. Approval of title by the City Attorney.
B. Revise the signature block to read City Clerk rather than City Administrator.
C. Execution of a Developers Agreement which shall include provisions for
security for public improvements, payment of engineering review fees, and
any other fees as required by the City's most current fee schedule.
1. Street lighting to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.

2. Electrical system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems in accordance
with the requirements of the Design Criteria and Standard
Specifications of the City of Shako pee. Payment of Trunk Sanitary
Sewer Charges and Trunk Storm Water Charges as required by the
most current City of Shako pee Fee Schedule.
5. Installation of streets in accordance with the requirements ofthe
Design Criteria and Standard Specifications of the City of Shako pee.
6. The developer shall be responsible for payment of engineering review
fees, and other fees as required by the City's adopted Fee Schedule.
7. Park dedication requirements for the residential area shall be met
through a combination of park lanq to be dedicated with the final plat,
a 20' wide recreational trail, and improvements to the park area.
8. Approximately 2.955 acres of wetland along the southern property line
shall be dedicated to the City on the final plat.
9. Outlot C for the recreational trail shall be deeded to the City
simultaneously with the recording of the final plat.
10. The developer shall contribute $50,000 toward the park improvements
when the City develops the park. The contribution shall be applied
towards a children's play structure.
11. The developer shall install an eight-foot wide asphalt trail to the east
property line in the area identified in Outlot C on the final plat,
sidewalk along both sides of Crossings Boulevard, a sidewalk along
Penstemon Lane, and a trail from Penstemon Lane to the levee trail, as
shown on the utility and street construction plan ofthe final plat.
12. The park dedication requirements have been determined based on the
fact that the preliminary plat for the property depicts all residential
portions of the property being developed with single-family detached
homes, not attached townhouse dwellings. If future phases of the
property are proposed to be developed with townhomes or other types
of attached dwellings, the city reserves the right to: (a) deny such
proposals; (b) require additional park land dedication; or (c) require
additional park dedication fees to be paid.
13. The homeowner's association shall develop a management plan for the
sustainability of the wetlands and native plantings proposed in the
preliminary plat.
14. The applicant shall include 6 inches oftopsoil, meeting MNDOT
specifications, on the entire site.
15. That all sprinklers owned and operated by the Homeowner's
Association have rain sensors as required by State Law.
16. The applicant shall construct houses using construction materials and
methods for indoor noise mitigation.

17. The applicant shall incorporate a berm and/or a 6 foot fence with a
variety of trees along CR 21 and CSAH 18, or wherever appropriate, to
mitigate noise from the highways.
18. That a 16" trunk watermain along CSAH 18 and a 12" trunk
watermain in proposed Crossings Boulevard will be required within
this development.
19. No landscaping, ponding, berming, or signage shall be permitted
within the County right-of-way.
20. Any change in drainage entering the County right-of-way shall require
detailed stormwater calculations to be submitted to the County
engineer for review and approval.
21. A street light shall be installed at the intersection of CSAH 18 and
Crossings Boulevard.
22. A County access permit shall be required for Crossings Boulevard at
CSAH 18. A right and left turn lane on CSAH 18 shall be required.
No other accesses or direct access shall be granted to the development.
23. Any work within the County right-of-way shall require a permit.
24. Crossings Boulevard right-of-way, from the east boundary to the west
boundary of Riverside Fields, be dedicated.
25. Provide electronic AutoCAD files ofthe Final Plat to the Engineering
Department.
26. No temporary access shall be allowed to Lot 1, Block 3. A curb return
shall be constructed along the East property line and access shall be
gained off this future street. The width ofthe curb return shall be
approved by the City Engineer.
27. Easements shall be shown on the Final Plat as approved by the City

28. The applicant shall record a deed restriction on the following lots
simultaneous to the recording of the Plat:

29. The following variation is granted from zoning code provisions;
a. 15' structure separations are approved for 75 lots south of
Crossings Boulevard, with no side yard setback being less than 5' ..
D. Final Construction Plans and Specifications must conform to City
requirements and are subject to approval by City Engineer. Such plans as they
relate to water or electricity are subject to the approval of the SPUC Utilities
Manager.
E. No site grading will be allowed on Outlot A and Outlot B until preliminary
plan and profile sheets for street and utility work and a grading permit are
approved by the City Engineer.
F. The applicant shall implement the use of Best Management Practices for
erosion control and stormwater management during construction.
G. The applicant should transplant healthy young trees on site whenever possible.
H. The developer shall install rain sensors for the irrigation system.

II. Following approval and recording of the final plat the following conditions shall
apply:
A. This development shall comply with City Code Section 10.60, concerning noise
elimination and noise prevention. Houses on lots immediately adjoining CSAH
18 shall be equipped with STC 30-rated windows. As an alternative, or in
addition to, the developer shall construct a sound mitigation fence along CSAH 18
and the future CSAH 21.
B. Responsibility for other noise mitigation measures that may be required in the
future shall rest with the developer or its assigns.
C. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
D. All existing easements are retained.
E. Pinal grading, utility connections and access to city streets will need approval by
the Engineering Department.
F. All outstanding fees will apply.
G. Temporary street signs are required prior to construction.
H. A second remote access in accordance with International Fire Code Appendix D
shall be provided when the total unit count ofthis addition and any future
additions or plats accessing Crossings Boulevard west of County Road 18 exceeds
100 units.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the Final Plat of
RIVERSIDE FIELDS FIRST ADDITION does not constitute a representation or guarantee by
the City of Shakopee as to the amount, sufficiency or level of water service that will be available
to lots within the plat as they are developed.

Recommendation
I recommend approval of the Final Plat subject to the following conditions being
completed prior to recording of the plat:
