CONSIDERATIONS
Tollefson Development has made application for final plat approval of the Thomas A. Philipp
Addition. The proposed development is located east of the intersection of I ih Avenue and
Independence Drive (Exhibit A). The development, as proposed, would consist of75
dwelling units. (Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat and the
development patterns proposed with the Planned Unit Development (PUI:?) for the site.
Shakopee Public Utilities (SPUC) has commented that it has recently increased the rates for
the UG Electric Charge, Trunk Water Charge and Water Connection Charge. The new rates
will apply to this subdivision. In addition, SPUC commented that service to Lot 3, Block 5
will have to be installed by tapping the watermain in 18th Avenue. This should be done prior
to the wear course being installed. SPUC is also recommending that the watermain the east
section of 18th Avenue be disconnected at the main if 18th Avenue is vacated, as illustrated.
The Engineering Department has provided comments, please see Exhibit C. Staffhas
incorporated these recommended changes into the draft resolution for Council's
consideration.
AL TERNATIVES
1. Approve Resolution No. 5961, approving the Final Plat of Thomas A. Philipp
Addition subject to the conditions presented.
2. Approve Resolution No.5961, subject to revised conditions.
3. Do not approve the final plat and direct staff to prepare a resolution consistent with the
direction of the Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approval of Resolution No. 5961, approving the Final

RESOLUTION NO. 5961
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF THOMAS A. PHILIPP ADDITION
WHEREAS, , Tollefson Development, applicant and property owner, has made
application for fmal plat approval of Thomas A. Philipp Addition; and
WHEREAS, the subject property is legally described as:
The West Halfofthe Northeast Quarter of the Northeast Quarter of Section 17, Township 115,
Range 22, Scott County, Minnesota; and
WHEREAS, the Planning Commission recommended approval ofthe proposed
preliminary plat with conditions; and
WHEREAS, on October 21,2003 the City Council reviewed the proposed final plat,
and found it to be generally consistent with the approved preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Shakopee, Minnesota that final plat of Thomas A. Philipp Addition is hereby approved
subject to the following conditions;
1. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval oftitle by the City Attorney.
B. Execution of a Developers Agreement with provisions for Plan A and Plan
B improvements, as well as payment of engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements
ofthe Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements of the
Design Criteria and Standard Specifications of the City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, security for the
public improvements, engineering review fees, and other fees as
required by the City's adopted Fee Schedule for the entire plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve the
Final Construction Plans and Specifications. The developer shall
continue to work with staff to address the issues identified in the
Engineering Department memo dated July 22, 2003, prior to the
approval of plans.
7. Security shall be provided in an amount to be determined by the
City to ensure the development of the open space/recreational areas.
8. Park dedication requirements shall be met through a cash dedication
payable at time of recording of the final plat. If the plat is recorded
after the effective date of the 2004 City of Shako pee Fee Schedule,
the developer shall be required to pay park dedication fees in an
amount consistent with the then current adopted fee schedule.
9. The homeowners association documents shall include a provision
allowing shared use of the open space areas in this plat with the
residents of the Southern Meadows development.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. The plat shall be revised to include 20 foot wide drainage and utility
easements centered on the proposed storm sewer adjacent to the following
lots: Lots 9 & 10, Block 1; Lot 16, Block 1; Lots 8 & 9, Block 4; Lots 1 &
2, Block 5; Lots 8, 9, 10, &11, Block 5.
E. The plat shall be revised to include 20 foot wide drainage and utility
easements centered on the proposed sanitary sewer adjacent to the
following lots; Lot 20, Block 2; Lot 13, Block 5.
F. Provide a minimum of 10 feet of drainage and utility easement between all
building "clusters" where Items D and E do not apply.
G. Shall comply with the conditions of approval set forth in the Planned Unit
Development (PUD) approval.
H. The developer shall place pedestrian crossing signs and a painted
crosswalk at the comer of Independence Drive and 17th Avenue.
1. The survey data (length and bearings) shall be shown for each lot.
J. STC 30 rated windows and climate controls shall be utilized in the
dwellings located along 17th A venue to mitigate noise. Landscaping shall
not interfere with the sight line for 17th Avenue.
K. The Homeowners Association documents shall include a provision for the
perpetual maintenance and ownership of the outlot and common areas.
L. Shall provide city staffwith electronic AutoCAD files ofthe Final Plat to
be recorded.
M. Simultaneous to the recording of the final plat, a deed restriction shall be
recorded on the following lots: Lots 9 & 10, Block 1; Lot 16, Block 1; Lot
20, Block 2; Lots 8 & 9, Block 4; Lots 1 & 2, Block 5; Lots 8, 9, 10 &11,
Block 5; and Lot 13, Block 5.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. The developer and Homeowners Association shall be responsible for any noise
mitigation necessary resulting from 17th Avenue.
C. No building permit shall be issued for Lot 1, Block 2, until such time as the
transaction transferring property from the Southern Meadows plat has been
transferred to Tollefson Development.
D. Upon transfer ofland from the Southern Meadows development, Tollefson
Development shall include the transferred land into the CIC plat and
declarations to ensure that ownership of the parcel transfers to the
Homeowners Association.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the final plat of
Thomas AS. Philipp Addition does not constitute a representation or guarantee by the City of
Shakopee as to the amount, sufficiency or level of water service that will be available to lots
within the plat as they are developed.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota,

After reviewing the above referenced application, I have the following comments for the
applicant and for the planning department:
Recommendation
I recommend approval of the Final Plat subject to the following conditions being addressed prior
to recording:
A. Prior to recording the Pinal Plat, the following actions must be completed:
1. Execution of the Developer's Agreement, which shall include provisions for
security for public improvements within the Final Plat and the engineering
review fees.
2. Payment of Trunk Storm Water Charges, Trunk Sanitary Sewer Charges and
other fees as required by the City's adopted Fee Schedule.
3. Provide a total of twenty (20) feet of drainage and utility easemerh, centered on
the proposed st01111 sewer, adjacent to the following lots:
. Lots 9 & 10 of Block 1.
. Lot 16 if Block 1.
. Lots 8 & 9 of Block 4.
. Lots 1 & 2 of Block 5.
. Lots 8, 9, 10 & 11 of Block 5.

residents of the Southern Meadows development.
C. Easements shall be shown on the Final Plat as approved by the City
Engineer.
D. The plat shall be revised to include 20 foot wide drainage and utility
easements centered on the proposed storm sewer adjacent to the following
lots; Lots 9 & 10, Block 1; Lot 16, Block 1; Lots 8 & 9, Block 4; Lots 1 &
2, Block 5; Lots 8, 9, 10, &11, Block 5.
E. The plat shall be revised to include 20 foot wide drainage and utility
easements centered on the proposed sanitary sewer adjacent to the
following lots: Lot 20, Block 2; Lot 13, Block 5.
F. Provide a minimum of 10 feet of drainage and utility easement between all
building "clusters" where Items D and E do not apply.
G. Shall comply with the conditions of approval set forth in the Planned Unit
Development (PUD) approval.
H. The developer shall place pedestrian crossing signs and a painted
crosswalk at the corner of Independence Drive and 1 ih Avenue.
1. The survey data (length and bearings) shall be shown for each lot.
J. STC 30 rated windows and climate controls shall be utilized in the
dwellings located along 1 ih A venue to mitigate noise. Landscaping shall
not interfere with the sight line for I ih Avenue.
K. The Homeowners Association documents shall include a provision for the
perpetual maintenance and ownership of the outlot and common areas.
L. Shall provide city staff with electronic AutoCAD files of the Final Plat to
be recorded.
M. Simultaneous to the recording of the final plat, a deed restriction shall be
recorded on the following lots: Lots 9 & 10, Block 1; Lot 16, Block 1; Lot
20, Block 2; Lots 8 & 9, Block 4; Lots 1 & 2, Block 5; Lots 8, 9, 10 &11,
Block 5; and Lot 13, Block 5.
II. Following approval and recording of the final plat, the following conditions shall
apply;

A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time of building permit application(s).
B. The developer and Homeowners Association shall be responsible for any noise
mitigation necessary resulting from 1 ih Avenue.
C. Upon transfer ofland from the Southern Meadows development, Tollefson
Development shall include the transferred land into the CIC plat and
declarations to ensure that ownership of the parcel transfers to the
Homeowners Association.
THEREFORE, BE IT FURTHER RESOLVED, that approval of the final plat of
Thomas AS. Philipp Addition does not constitute a representation or guarantee by the City of
Shakopee as to the amount, sufficiency or level of water service that will be available to lots
within the plat as they are developed.
Adopted in regular session of the City 'council of the City of Shakopee, Minnesota,
