CONSIDERATIONS
Plowshares Development LLC has made application for final plat approval of Southern
Meadows. The proposed development is located east of King Avenue and north of 18th
Avenue (Exhibit A). The development, as proposed, would consist of 122 townhome units.
(Exhibit B).
The final plat is in substantial conformance with the approved preliminary plat for the site.
Street names have been provided as required by the preliminary plat approval. However, staff
is continuing to work with the applicant to identify names consistent with city policy. Staff
has included a condition that street names satisfactory to city staffbe provided prior to
recording of the final plat.
Shakopee Public Utilities (SPUC) has provided comments as attached to this report.
The Building Official has commented that temporary street signs will be required.
The Engineering Department has provided comments, please see Exhibit C. Staff has
incorporated these recommended changes into the draft resolution for Council's
consideration.
ALTERNATIVES
1. Approve Resolution No. 5960, approving the Final Plat of Southern Meadows, subject
to the conditions presented.
2. Approve Resolution No.5960, subject to revised conditions.
3. Do not approve the final plat and direct staff to prepare a resolution consistent with the
direction of the Council.
4. Table the matter and request additional information from staff and/or the applicant.
STAFF RECOMMENDATION
Staff recommends Alternative No.1, approval of Resolution No. 5960, approving the Final
Plat of Southern Meadows.
ACTION REQUESTED
Offer a motion approving Resolution No.5960, a roving the Final Plat of Southern
Meadows, and move its approval. - ,

RESOLUTION NO. 5960
A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA APPROVING THE
FINAL PLAT OF SOUTHERN MEADOWS
WHEREAS, , Plowshares Development, LLC, applicant and property owner, has made
application for final plat approval of Southern Meadows; and
WHEREAS, the subject property is legally described as:
The East One Half of the Northeast Quarter of the Northeast Quarter of Section 17, Township
115, Range 22, Scott County, Minnesota; and
WHEREAS, the Planning Commission recommended approval of the proposed
preliminary plat with conditions; and
WHEREAS, on October 21, 2003 the City Council reviewed the proposed final plat,
and found it to be generally consistent with the approved preliminary plat.
NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Shakopee, Minnesota that final plat of Southern Meadows hereby approved subject to the
following conditions;
1. The following procedural actions must be completed prior to the recording of the
Final Plat:
A. Approval of title by the City Attorney.
B. This plat shall not be recorded until the final plat of Thomas A. Philipp
Addition has been recorded.
C. Street names shall be revised to conform to city policy.
D. Simultaneous to the recording ofthe plat, a deed restriction shall be
recorded on the following lots: Lots 3, 4, 20, 21, and 46, Block 2; Lots 7,
8, 11, and 12, Block 3; Lots 3, 4, 27, 28, 35, 36, 39, and 40, Block 4; Lots 8
and 9, Block 4.
E. Execution of a Developers Agreement with provisions for Plan A and Plan
B improvements, as well as payment of engineering review fees, and any
other fees as required by the City's adopted fee schedule.
1. Street lighting to be installed in accordance with the requirements
of the Shakopee Public Utilities Commission.
2. Electrical system to be installed in accordance with the
requirements of the Shakopee Public Utilities Commission.
3. Water system to be installed in accordance with the requirements of
the Shakopee Public Utilities Commission.
4. Installation of sanitary sewer and storm sewer systems, and
construction of streets in accordance with the requirements ofthe
Design Criteria and Standard Specifications of the City of
Shakopee.
5. The developer shall be responsible for payment of Trunk Storm
Water Charges, Trunk Sanitary Sewer Charges, security for the
public improvements, engineering review fees, and other fees as
required by the City's adopted Fee Schedule for the entire plat.
6. No public improvements shall be constructed until the City
Engineer and the Shakopee Public Utility Commission approve the
Final Construction Plans and Specifications. The developer shall
continue to work with staff to address the issues identified in
sections B through D ofthe Engineering Department memo dated
July 31, 2003, prior to the approval of plans.
7. Park dedication requirements shall be met through a cash dedication
in the amount of $268,400.00 payable at time of recording ofthe
final plat. Ifthe plat is recorded after the effective date ofthe 2004
City of Shakopee Fee Schedule, the developer shall be required to
pay park dedication fees in an amount consistent with the then
current adopted fee schedule.
8. Final approval of grading, utility and construction plans shall not
occur until 17th A venue has been approved for construction to the
property line ofthis project.
9. The homeowners association documents shall include a provision
allowing shared use of the open space areas in this plat with the
residents ofthe Thomas A. Philipp Addition.
10. Security will be provided under the Developers Agreement for
completion of improvements to the open space areas.
11. The City shall be provided a copy of the new easement allowing the
relocation of the gas transmission line.
12. The City shall be provided with electronic AutoCAD files ofthe
Final Plat to be recorded.
F. Easements shall be shown on the Final Plat as approved by the City
Engineer.
G. The developer shall provide sidewalks and trails for the designated routes
on the plat.
H. The survey data (length and bearings) shall be shown for each lot.
1. Shall provide 10 feet of total easement between all building clusters.
J. The street width shown on the plat shall be 37 feet back to back for each
street.
K. Landscaping, as shown on the landscape plan, along with STC 30 rated
windows and climate controls shall be utilized in the dwellings located
along 17th A venue to mitigate noise. Landscaping shall not interfere with
the sight line for 17th Avenue.
L. The Homeowners Association documents shall include a provision for the
perpetual maintenance and ownership of the outlot and common areas.
II. Following approval and recording of the final plat, the following conditions shall
apply;
A. Building construction, sewer, water service, fire protection and access will be
reviewed for code compliance at the time ofbuildiIig permit application(s).
THEREFORE, BE IT FURTHER RESOLVED, that approval of the final plat of
Southern Meadows does not constitute a representation or guarantee by the City of Shakopee
as to the amount, sufficiency or level of water service that will be available to lots within the
plat as they are developed.
Adopted in regular session of the City Council of the City of Shakopee, Minnesota,

After reviewing the above referenced application, I have the following comments for the
applicant and for the planning department:
Recommendation
I recommend approval of the Final Plat subject to the following conditions being addressed:
A. Prior to recording the Final Plat, the following actions must be completed:
1. Execution of the Developer's Agreement, which shall include provisions for
security for public improvements within the Final Plat and the engineering
review fees.
2. Payment of Trunk Stoml Water Charges, Trunk Sanitary Sewer Charges and
other fees as required by the City's adopted Fee Schedule.
3. Provide City staff with electronic AutoCAD files of the Final Plat to be
recorded.
B. Simultaneous to the recording of the plat, a deed restriction shall be recorded on the
following lots:
1. Lots 3, 4, 20, 21 & 46 of Block 2.
2. Lots 7,8, 11 & 12 of Block 3.
3. Lots 3, 4, 27, 28, 35, 36, 39 & 40 of Block 4.
4. Lots 8 & 9 of Block 4.
C. Prior to construction of the public improvements, the City Engineer and the Shakopee
Public Utilities Commission shall approve the Final Construction Plans and

Final Plat of Southern Meadows

COMMENTS:
Municipal water service is available subject to our standard terms and conditions. These
include, but are not limited to: installing a lateral water main distribution system in
accordance with utility policy, paying the associated inspections costs, paying the Trunk
Water Charge, and paying the Water Connection Charge.
Underground electric service is available subject to our standard terms and conditions.
These include, but are not limited to; entering into an Underground Distribution
Agreement, granting any necessary easements, and paying the associated fees.
Street Lighting installation is available subject to our standard terms and conditions.
These are contained in the current City of Shakopee Street Lighting Policy. Applicant
must pay the associated fees.
Applicant should contact Shakopee Public Utilities directly for specific requirements
relating to their project.
Note: SPUC recently increased the rates for the UG Electric Charge, Trunk Water
Charge, and Water Connection Charge. The new rates will apply to this
proposed project.
This plat will be served by the normal elevation service district (NES) in the
north and the first high elevation service district (I-HES) in the south for
municipal water service due to elevation. 17th Avenue street lighting will
need a temp power source until 17th Avenue extends to c.R. 83.
