INTRODUCTION
Shakopee Public Utilities, along with ISD No. 720, has submitted an application for a rezoning
from Agricultural Preservation (AG) Zone to Urban Residential (R-1B) Zone. The subject site is
located east of Sunpath Elementary School.
Shakopee Public Utilities (SPUC) wishes to construct a well and pumphouse on the property. .
It is the intent of SPUC to own a 28,000 square foot parcel of land for this purpose. A minor
subdivision has been approved to create a 28,600 square foot parcel. Shakopee Public Utilities is
now requesting the approval of a rezoning to rezone the 28,600 square foot parcel to Urban
Residential (R-IB) zone.
The Comprehensive Plan designates this property for single family development. As is
illustrated in Exhibit A, the majority of the land surrounding Sunpath Elementary is zoned Urban
Residential (R-IB) Zone.
Please find attached a copy of the October 9,2003, report to the Planning Commission for further
details and attachments.
ALTERNATIVES
1. Offer and pass a motion adopting Ordinance No. 685 approving the request to rezone the
subject property from Agricultural Preservation (AG) to Urban Residential (R-1B) Zone.
2. Do not approve the request to rezone the subject property from Agricultural Preservation
(AG) to Urban Residential (R-IB) Zone.
3. Table the matter and request additional information.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission reviewed the request at its October 9, 2003 meeting, and unanimously
recommended approval of the request to rezone the subject property from Agricu1tural Preservation
(AG) Zone to Urban Residential (R-IB) Zone.

AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC. 11.03 BY
REZONING LAND GENERALLY LOCATED SOUTH OF SEVENTEENTH AVENUE,
EAST OF SARAZIN STREET AND WEST OF INDEPENDENCE DRIVE FROM
AGRICULTURAL PRESERVATION (AG) ZONE TO URBAN RESIDENTIAL (R-IB)
ZONE
WHEREAS, Shakopee Public Utilities Commission (SPUC), applicant, and Independent
School District 720 (rSD 720), property owner, have requested the rezoning of land from
Agricultural Preservation (AG) Zone to Urban Residential (R-IB) Zone; and
WHEREAS, the subject property is legally described as:
The East 220.00 feet of the south 130.00 feet of the North 180.00 feet of the South Half of the
Northeast Quarter of the Northwest Quarter of Section 17, Township 115 North, Range 22 West
of the 5th Principal Meridian; and
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on October 9, 2003, at which time all persons present were given an
opportunity to be heard; and
WHEREAS, the Planning Commission, on October 9, 2003, recommended approval of
the rezoning request; and
WHEREAS, the City Council heard the matter at its meeting of October 21, 2003, and
found that the proposed rezoning is consistent with the Comprehensive Plan for the area of the
City within which it is located.
THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS:
Section 1; That the following findings of fact are hereby adopted relative to the
requested rezoning;
Finding #1 The original zoning ordinance is not in error.
Finding #2 Significant changes in community goals and policies have not taken place.
Finding #3 Significant changes in development patterns have not occurred. Zoning this parcel
to Urban Residential (R-IB) zone is consistent with the desired development in this
area of the City.
Finding #4 The requested zoning will be consistent with the approved Comprehensive Plan
land use map.
Section 2 - That the zoning map adopted in City Code Sec. 11.03 is hereby amended by
rezoning the property referenced herein, from Agricultural Preservation (AG) Zone to Urban
Residential (R-1B) Zone.
Section 2 - Effective Date. This ordinance becomes effective from and after its passage
and publication.

INTRODUCTION
Shakopee Public Utilities, along with ISD No. 720, has submitted an application for a rezoning
from Agricultural Preservation CAG) Zone to Urban Residential (R-IB) Zone. The subject site is
located east of Sunpath Elementary School. Please see Exhibit A. The site is approximately 18
acres in size and houses Sunpath Elementary School.
Shakopee Public Utilities (SPUC) wishes to construct a well and pumphouse on the property.
Please see Exhibit B for the applicant's narrative. It is the intent of SPUC to own a 28,000
square foot parcel of land for this purpose. On September 16, the City Council did approve the
request of Shakopee Public Utilities to waive the minimum lot size in the AG zone. This waiver
approval allowed the approval of the minor subdivision to create a 28,000 square foot parcel.
Shakopee Public Utilities is now requesting the approval of a rezoning to rezone the 28,000
square foot parcel to Urban Residential (R-IB) zone. Exhibit C illustrates the location of the
proposed rezoning.
The Comprehensive Plan designates this property for single family development. As is
illustrated in Exhibit A, the majority of the land surrounding Sunpath Elementary is zoned Urban
Residential (R-IB) Zone.
CONSIDERATIONS
The City's Comprehensive Plan sets basic policies to guide the development of the City. The
purpose of designating different areas for residential, commercial, and industrial land uses is to
promote the location of compatible land uses, as well as to prevent incompatible land uses from
being located in close proximity to one another. The Zoning Ordinance is one of the legal means by
which the City implements the Comprehensive Plan. Under Minnesota statute, zoning is to
conform with a city's comprehensive plan.
The proposed rezoning is consistent with the adopted land use plan which guides it "single
family residential", Refer to Section 11.22 (Agricultural Preservation Zone) and Section 11.28
(Urban Residential Zone) for a listing of the uses, both permitted and conditional, which are
allowed in these zones. Copies of the land use plans and the Zoning Ordinance are available for
viewing at City Hall and will be made available at the October 9, 2003 meeting.
Other staff were provided the opportunity to provide comments regarding this application. No
adverse comments concerning the rezoning request were received by planning staff.
FINDINGS
The criteria required for the granting of a Zoning Ordinance Amendment are listed below with
proposed findings for the Commission's consideration.
Criteria #1 That the original Zoning Ordinance is in error;
Finding #1 The original zoning ordinance is not in error.
Criteria #2 That significant changes in community goals and policies have taken place;
Finding #2 Significant changes in community goals and policies have not taken place.
Criteria #3 That significant changes in City-wide or neighborhood development patterns
have occurred; or
Finding #3 Significant changes in development patterns have not occurred. Zoning this parcel
to Urban Residential (R-1B) zone is consistent with the desired development in this
area of the City.
Criteria #4 That the comprehensive plan requires a different provision.
Finding #4 The requested zoning will be consistent with the approved Comprehensive Plan
land use map.
ALTERNATIVES
1. Recommend to the City Council the approval of the request to rezone the subject property
from Agricultural Preservation (AG) to Urban Residential (R-IB) Zone.
2. Do not recommend to the City Council the approval of the request to rezone the subject
property from Agricultural Preservation (AG) to Urban Residential (R-IB) Zone.
3. Continue the public hearing and request additional information from the applicant or staff.
4. Close the public hearing, but table the matter and request additional information.
STAFF RECOMMENDATION
Staff recommends Alternative No. I; recommend to the City Council the approval of the request to

The Shakopee Public Utilities Commission (SPUC) is requesting approvals for the construction
of well #15 and a pumphouse on the Sunpath Elementary School site. The proposed well and
pumphouse are part of the overall 17th Ave wel1fie1d master plan that is needed to ensure

planning and construction of the new soccer fields. It is hoped that with this approval SPUC can
proceed with the diggi~g ofthe well and necessary pipes at the same time that the city is

than ifthe water pipes were done at a later date. (See the attached concept plan.)
The plan is to construct well # 15 and install the necessary pipes this fall with the construction of
the soccer fields. The pumphouse is scheduled for construction next Spring. The other well and
pumphouse applications will be submitted at the times they are ready to be constructed.
The project requires the following approvals:
Rezoning: from AO to RIB
Conditional Use Permit: for a utility structure in a RIB zone
Minor Subdivision: administrative subdivision
REZONING
SPUC wishes to subdivide and own a 28,000 square foot (130 X 220) lot for well #15 and the
pumphouse. The lot is also needed for the possible addition of a treatment facility. The Sunpath
Elementary School is zoned AG, which requires a minimum lot size of 40 acres. SPUC is
requesting to rezone the site to RIB, which would allow a smaller lot and reduces the building
setbacks fi'om what is allowed in the AO zone. The proposed lot and building will meet the RIB
district standards. The RIB zone is similar to the sUlTounding properties and the smaller lot will
minimize the impact to the school district property.
To avoid rezoning the entire school propeliy to RIB for the subdivision of the pumphouse site,
SPUC requested that the City Council waiver the AG minimum lot size for their site. With the
approval aHhe waiver, the smaller site can be subdivided :fi:om the school property and rezoned
to RIB (see the attached letter). A minor subdivision application was submitted to the city.

CONDITIONAL USE PERMIT
A conditional use permit is requested for the construction of a utility structure in a RIB district.
The proposed pumphouse is 1500 square feet and 15 feet in height. The standard building is
constructed with a brick exterior and an asphalt-shingled pitched roof. Modifications to the
building design may be incorporated where it is needed to match an architectural theme within a
specific area. (See the attached plan.)
The building will meet the standards for the conditional use pennit except for the maximum
building size. The zoning code requires a maximum size of 400 square feet. This building needs
to be 1500 square feet to house the required pumping equipment and accessories. As a necessary
part in providing water service to the city it is hoped that the building size standard can be
waived for this site. The architectural design of the building will blend with the sUlTounding area
and other structures. It is expected that the building will compliment the school and soccer fields,
similar to the proposed 4,000 square foot park building. Due to the architecture and design of the
building plus the openness of the playfields, landscaping is not being proposed for the site.
However, SPUC will provide landscaping if the city finds it neceSS81Y.
Depending on the water quality and the system needs, a water treatment facility may need to be
added to the pumphouse. The treatment facility addition would be approximately 80 X 60 (4,800
square feet) making the total building size 6,300 square feet. The type of water treatment
required will detennine the actual size of the facility. The height of the treatment facility may
need to be as high as 20 feet depending on the type of treatm."ent, if any, is needed. The treatment
addition would be constmcted with the same material as the pump house.
Future pumphousesmay also be needed as part of the 17th Avenue wellfield master plan. These
buildings will likely be smaller buildings, but still exceed the 400 square foot maximum size.
Separate conditional use pelmit applications will be submitted at the time that the pumphouses
are needed.
