SUBJECT: Mystic Lake Golf Course Wetland Replacement Plan

INTRODUCTION:
This memo is intended to request approval of the Wetland Replacement Plan for the Mystic Lake
Golf Course. The project is located to the East of County Road 17 along the North side of
County Road 82 in the City of Prior Lake and the City of Shakopee. Attached for Council
consideration is Resolution No. 5972, a resolution approving the Wetland Replacement Plan for
the Mystic Lake Golf Course.
BACKGROUND:
The Shakopee Mdewakanton Sioux Community is redeveloping and redesigning the existing
Lone Pine Golf Course. The total area of land to be disturbed as a result of this improvement is
approximately 157.0 acres. Approximately 9.8 acres of this total area is located within the City
of Shakopee, while the remainder is within the City of Prior Lake. The project includes impacts
to a total of 3.43 acres of wetland subject to the Wetland Conservation Act (WCA), a majority of
which is located within the City of Prior Lake.
As per the WCA, the Local Governing Unit (LGU) is the one in which most of the wetland loss
will occur. The WCA also states wetland replacement plans involving more than one LGU shall
require approval of all LGU's involved to constitute final approval of the replacement plan.
The Shakopee Mdewakanton Sioux Community has submitted a complete Wetland Replacement
Plan application. City of Prior Lake staff, acting as the controlling LGU, their engineering
consultant, a representative from the Soil and Water Conservation District (SWCD) and a
representative from the Board of Soil and Water Resources (BWSR) comprised the Technical
Evaluation Panel (TEP). The TEP, established by the WCA, provides professional, technical
review of wetland issues to the LGD. The TEP reviewed the application and determined the
requirements of the WCA have been met by this plan. Therefore, the TEP recommended
approval.
City of Shakopee staff concurs with the TEP and propose approval of the replacement plan by the
City of Shakopee in their roll as a LGU for the WCA of 1991.
ALTERNATIVES:
1. Adopt Resolution No. 5972.
2. Deny Resolution No. 5972.

RECOMMENDATION:
Staff recommends Alternative No.1.
ACTION REQUESTED:
Offer Resolution No. 5972, a Resolution Approving a Wetland Replacement Plan for the Mystic

A Resolution Approving A WetIand Replacement Plan
For Mystic Lake Golf Course
WHEREAS, the City has received a Wetland Replacement Plan from the
Shakoppee Mdewakanton Sioux Community for the proposed Mystic Lake Golf Course;
and
WHEREAS, the applicant has demonstrated that the proposed Wetland
Replacement Plan complies with Minn, Rules Parts 8420.0540 and 8420,0550; and
WHEREAS, all interested parties on file in the office of the City Engineer or
identified in Minn. Rule 8420.0230 have been mailed notice of the proposed Wetland
Replacement Plan; and
WHEREAS, the Technical Evaluation Panel reviewed the proposed Replacement
Plan and considered the public values, location, size and type of wetland being altered
and recommended approval of the Wetland Replacement Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF SHAKOPEE, MINNESOTA:
1. Based on the replacement standards in Minn. Rules Parts 8420.0630, and
on the recommendation of the Technical Evaluation Panel, the Wetland
Replacement plan is hereby approved.
2. Approval of the Wetland Replacement Plan shall become effective upon
its adoption.
3. A copy of this decision shall be mailed to all interested parties and to the
applicant.
Adopted in session of the City Council of the City of Shako pee,
Minnesota, held this day of , 2003.
