INTRODUCTION:
MohagenlHansen Architectural Group has submitted an application for a retail center Planned
Unit Development (PUD). The subject site is located on the south side of 1ih A venue, north of
Hwy. 169 and just east of the AmericInn Motel. Please see the attached exhibits for site location
and proposed site design.
CONSIDERATIONS:
The City Code (Section 11.50, Subd. 4) requires that retail centers be reviewed as a Planned Unit
Development (PUD). A retail center is defined as a commercial area containing one (1) or more
retail establishment(s) with a total building area in excess of 50,000 square feet. The PUD
application requests approval of a building that would be approximately 158,400 square feet,
with 130,200 square feet of showroom space and 28,200 square feet of warehouse storage.
Staff has researched whether park dedication fees are required for this proj ect and have consulted
with the City Attorney, who has determined that park dedication fees are not applicable for this
proj ect. City staff reviewed the proposed plans and provided comments/conditions to the
applicant. If this project is approved, those comments/conditions shall be incorporated into the
plans submitted for building permit review. The site plan identifies 342 parking spaces, which
exceeds the City Code requirement of 337 spaces. The applicant has noted that the majority of
the building will be decorative colored pre-cast panels, with the entrances located on the south
side of the building and highlighted with glass curtain wall, architectural metal roofing, ElF'S,
rock-face colored concrete blocks, and back-lit glass block.
ALTERNATIVES:
1. Approve Resolution No. 5968, a resolution approving the PUD request, subject to the
conditions presented.
2. Approve Resolution No. 5968, a resolution approving the PUD request, subject to revised
conditions.
3. Do not approve the request, and direct staff to prepare a resolution denying the request for
Council consideration at their November 18, 2003 meeting.
4. Table the request for additional information.
PLANNING COMMISSION RECOMMENTDATION:
The Planning Commission reviewed this request at their October 23,2003 meeting, and by a 6-0
vote, they recommended that the City Council approve the request with additional conditions
pertaining to landscaping and parking. Those conditions have been incorporated into the
attached resolution. Concerning condition no. 5, staffhas scheduled this item for discussion with
the Environmental Advisory Committee (EAC) at their November 19, 2003 meeting.
Additionally, the Commission suggested that as a guideline, they would like to see additional
screening of the parking lot, and that they would like to see the site made inviting and the
grounds well maintained. The October 23, 2003 Planning Commission staff report is attached
for the Council's information.
ACTION REQUESTED:
Offer and approve a motion to adopt Resolution No. 5968, a resolution approving the PUD
request, subj ect to the conditions presented.

A RESOLUTION OF THE CITY OF SHAKOPEE, MINNESOTA,
APPROVING PLANNED UNIT DEVELOPMENT (PUD) # 23 FOR A RETAIL CENTER
ON PROPERTY GENERALLY LOCATED NORTH OF HIGHWAY 169, EAST OF
COUNTY ROAD 83 AND SOUTH OF 12TH AVENUE
WHEREAS, MohagenlHansen Architectural Group, applicant and furniture Outlets USA,
property owner, have requested a PUD for property located south of 12th Avenue, north ofHwy.
169 and east of County Road 83; and
WHEREAS, the subject property is legally described as:
That part of Tract A, Registered Land Survey No. 175, Scott County, Minnesota, which
lies easterly of the following described line:
Commencing at the Southeast corner of said Tract A; thence South 85 degrees 44 minutes
55 seconds West, an assumed bearing, along the south line ofsaid Tract A, a distance of870.25
feet to the point of beginning of the line to be described; thence North 4 degrees 11 minutes 19
seconds West, a distance of 5 04.99 feet more or less to the north line of said Tract A, and said
line there terminating; and
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on October 23, 2003, at which time all persons present were given an
opportunity to be heard; and
WHEREAS, the Planning Commission recommended approval of the PUD request; and
WHEREAS, the City Council heard the matter at its meeting of November 5, 2003.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SHAKOPEE, MINNESOTA, as follows:
That Planned Unit Development (PUD) No. 23 for a retail center is approved subject to the
following conditions:
1. Development of the site shall generally comply with the site plan received by the
City on September 11, 2003, attached as Exhibit B, except as specifically noted in
the following conditions.
2. The retail center shall comply with the City Code design and performance standards
(including Section 11.60, Subd. 4, building design and materials), Engineering
design standards, and shall comply with Section 11.50 PUD District requirements at
time of building permit submittal.
3. Landscaping shall be added appropriately along the north side of the building.
4. The loading dock areas shall be screened consistent with City Code requirements.
5. The developer and city staff shall work with the Environmental Advisory
Committee (EAC) to determine whether it is necessary to provide the required
number of parking spaces; if not, then the developer shall create additional open
space.
Adopted in session of the City Council of the City of Shakopee,

INTRODUCTION:

Planned Unit Development (PUD). The subject site is located on the south side of lih

exhibits for site location and proposed site design.
CONSIDERATIONS:
The City Code (Section 11.50, Subd. 4) requires that retail centers be reviewed as a
Planned Unit Development (PUD). A retail center is defined as a commercial area
containing one (1) or more retail establishment(s) with a total building area in excess of
50,000 square feet. The PUD application requests approval of a building that would be
approximately 158,400 square feet, with 130,200 square feet of showroom space and
28,200 square feet of warehouse storage.
Staff received comments from several reviewing agencies. The Shakopee Fire Inspector
commented that the development shall comply with Shakopee Fire Prevention Bureau
policies. Shakopee Public Utilities (SPUC) commented that water service plans must be
approved by the SPUC Water Superintendent prior to construction, and backflow
prevention is required on the fire loop (2 locations). The approved RLS resolution for this
property (in 2001) included a condition that "Park dedication fees are not applicable for
this survey, but that Park Dedication Fees shall apply to the future development of Tract A
in amounts consistent with the City's adopted Fee Schedule". The current City's adopted
Fee Schedule notes that commercial/industrial developments shall pay $4,470 per acre,
which would equate to $43,122.09 for this development.
City Engineering reviewed the plans and provided Planning staff and the applicant with
comments that should be addressed at the time of building permit submittal, if this
application is approved.
Planning staff reviewed the project and commented that screening (3 feet high, minimum)
is required along a portion of the south side of the parking lot adjacent to Hwy. 169, and
that the submitted landscape plan shall be revised to comply with the City Code
requirements. The applicant has noted that wall signage is proposed on the south side of
the building, with a pylon sign proposed near the west entrance, and that a directional sign
is proposed near the east entrance. Those signs shall not be located over any utility
services. The Code states that any freestanding sign shall be a monUlllent type sign, not a
pylon sign, and that sign permits will be required for all signs. The site plan identifies 342
parking spaces, which exceeds the City Code requirement of 337 spaces. A lighting plan
was submitted that appears to comply with the City Code requirements. The applicant has
noted that the majority of the building will be decorative colored precast panels, with the
entrances located on the south side of the building and highlighted with glass curtain wall,
architectural metal roofing, EIFS, rock-face colored concrete blocks, and back-lit glass
block.
Staff proposes that if this project is recommended for approval, that the following
conditions be imposed as part ofthe Planned Unit Development:
1. Development of the site shall generally comply with the site plan received by the
City on September 11, 2003, attached as Exhibit B.
2. Staff shall verify that the retail center is in compliance with City Code requirements
at time of building permit submittal.
AL TERNATIVES:
1. Recommend approval of the PUD to the City Council, subject to the conditions
presented.
2. Recommend approval of the PUD to the City Council, subject to revised conditions.
3. Recommend denial of the PUD to the City Council.
4. Continue the public hearing for additional information.
5. Table the request for additional infonnation.
RECOMMENDATION:
Staff recommends Alternative No.1, approval of the PUD, subject to the conditions
presented.
ACTION REQUESTED:
Offer a motion to approve the PUD as recommended and move its adoption.
