INTRODUCTION:
On November 5, 2003 the Council voted to direct staffto prepare an ordinance for consideration on
November 18,2003 approving the requested rezoning. A draft ordinance (No. 691) is attached for
the Council's consideration.
ALTERNATIVES:
1. Offer and pass Ordinance No. 691, an Ordinance approving the requested rezoning of 42
acres in Valley Green Corporate Center from Business Park (BP) to Medium-Density
Residential (R-2).
2. Do not pass Ordinance No. 691, an Ordinance approving the requested rezoning of 42 acres
in Valley Green Corporate Center from Business Park (BP) to Medium-Density Residential
(R-2).
3. Table the matter and request additional information.

ORDINANCE NO. 691, FOURTH SERIES
AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA,
AMENDING THE ZONING MAP ADOPTED IN CITY CODE SEC. 11.03 BY
REZONING LAND GENERALLY LOCATED SOUTH OF TRUNK HIGHWAY 169,
NORTH OF CSAH 16, EAST OF CSAH 83, AND WEST OF DEAN LAKE FROM
BUSINESS PARK (BP) TO MEDIUM-DENSITY RESIDENTIAL (R-2)
WHEREAS, Ryan Companies U.S., Inc. (Ryan), applicant, and Valley Green Business
Park (Valley Green), property owners have requested the rezoning of land from Business Park
(BP) to Medium-Density Residential (R-2) Zone; and
WHEREAS, the subject property is legally described as shown on Exhibit A, attached
hereto:
WHEREAS, notices were duly sent and posted, and a public hearing was held before the
Planning Commission on October 23,2003, at which time all persons present were given an
opportunity to be heard; and
WHEREAS, the Planning Commission forwarded the request to the City Council with
no recommendation; and
WHEREAS, the City Council heard the matter at its meeting of November 5,2003, and
found that the proposed rezoning is consistent with the Comprehensive Plan for the area ofthe
City within which it is located.
NOW THEREFORE, the city council of the City of Shako pee does hereby ordain as
follows;
Section I: That the following findings of fact are hereby adopted relative to the
requested rezoning;
Finding #1 Although the original zoning is not in error, the City Council has subsequently
approved re-guiding 42 acres of the subject site to "residential PUD.' The current
Business Park zoning is thus not consistent with the Comprehensive Plan as
amended.
Finding #2 By approving the requested land use change from business park to "residential
PUD the City Council has determined that significant changes in community goals
and policies have taken place;
Finding #3 Significant changes in development patterns have occurred. The economic
conditions in the City, Twin Cities Metropolitan Region, and indeed the Us.
generally, have resulted in very weak demand for premiere business park
development sites. At the same time the demand for high amenity sites for high

value residential development remains very high in the Region and the City of
Shako pee.
Finding #4 The requested zoning will be consistent with the amended Comprehensive Plan land
use map.
Section 2 - That the zoning map adopted in City Code Sec. 11.03 is hereby amended by
rezoning the property referenced herein, from Business Park (BP) to Medium-Density
Residential (R-2) Zone
Section 3 - Effective Date. This ordinance becomes effective from and after its passage
and publication.
Passed in session of the City Council of the City of Shakopee,
Minnesota held this day of ,2003.
