Michael Leek, Community Development Director SUBJECT: Text Amendment Regarding Seasonal Sales ofItems such as pumpkins, com, and Christmas trees MEETING DATE: November 6, 2003 REVIEW PERIOD: Not applicable as an application is not pending INTRODUCTION: This season, planning staff received a number of inquiries about use of vacant property for short- term, seasonal sales of items. Such sales have clearly occurred in the City in the past, however, in reviewing the zoning code, the basis for allowing them does not appear to be clear. Staff believes that there is merit in clarifying the basis for allowing such seasonal sales, and provide a relatively easy approval process that allows the City to keep track of where such sales are occurring. Because such use only occurs, or is likely to occur in the Highway Business (B-1) Zone, it seems appropriate to consider only a change to that district's language. ALTERNATIVES: 1. Offer and approve Ordinance No. 688, an ordinance relating to seasonal sales in the B-1 Zone as presented. 2. Offer and approve Ordinance No. 688, an ordinance relating to seasonal sales in the B-1 with reVISIOns. 3. Do not pass Ordinance No. 688. 4. Table the matter for additional information. PLANNING COMMISSION RECOMMENDATION: The Planning Commission reviewed the proposed text amendment at its meeting of November 6, 2003, and recommended approval unanimously. Michael Leek Community Development Director G:\CC\2003\11-18\TAseasonalsales.doc 2 ORDINANCE NO. 688, FOURTH SERIES AN ORDINANCE OF THE CITY OF SHAKOPEE, MINNESOTA, AMENDING CHAPTER 11, ZONING ORDINANCE, SEC. 11.36 REGARDING SEASONAL SALES IN THE HIGHWAY BUSINESS (B-1) ZONE THE CITY COUNCIL OF THE CITY OF SHAKOPEE, MINNESOTA, ORDAINS: Section 1 - That City Code Chapter 11, Zoning, Section 11.36, is hereby amended by adding the language that is underlined. SEC. 11.36. HIGHWAY BUSINESS ZONE (B-1). Subd. 5. Permitted Accessory Uses. F. Temporary. seasonal sales of farm produced items such as fruits. vegetables. and Christmas trees with prior review and written approval from the Zoning Administrator or designee. Section 2 - Effective Date. This ordinance becomes effective from and after its passage and publication. Adopted in session of the City Council of the City of Shakopee, Minnesota held the day of ,2003.
